CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING SEPTEMBER 4, 2019 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Wednesday, September 4, 2019, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 Smith Street with Mayor Carson Ross presiding. · COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were Assistant City Administrator Christine Cates, City Attorney Jacqueline Sommer, and City Clerk Sheryl Morgan. CALL MEETING TO Mayor Ross called the meeting to order at 6:00 p.m. and led in the ORDER Pledge of Allegiance. CONSENT AGENDA Councilmember Culpepper moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Fowler. • Minutes of the August 19, 2019 City Council Meeting and August 22, 2019 City Council Budget Work Session • Resolution No. 53-2019 approve the disposition of Information Technology, Human Resources, City Clerk, and Finance department records which have met the required retention period The Consent Agenda was approved with the following vote: Kaylor-Aye Ericson - Aye Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Mayor Ross - Aye PUBLIC HEARING - Mayor Ross opened the Public Hearing to receive public comment on FY2019-20 BUDGET the proposed Fiscal Year 2019-20 Budget at 6:02 p.m. The minutes of the public hearing were recorded by a certified court reporter. City Clerk Sheryl Morgan entered one exhibit into the record. STAFF REPORT Assistant City Administrator Christine Cates reviewed the highlights of the proposed FY 2019-20 Budget. Council held a Work Session to review the proposed Budget on August 22, 2019. Ms. Cates stated that during the work session, the budget for GC-08-18 Golf Cart Path Improvements was discussed and in order to reduce project costs and complete the project at one time, the proposed budget has been increased from $77,571,031 by $800,000 to $78,371,031. City Clerk Sheryl Morgan made the first - FY 2019-20 BUDGET reading of Bill No. 4690 by title; copies of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4690 upon its first reading and proceed with the second reading at the next meeting of the City Council on September 16, 2019. Motion seconded by Councilmember Culpepper. MOTION TO AMEND Councilmember Lievsay moved to amend the FY 2019-20 Budget by moving $300,000.00 from the City's Unassigned Fund Balance to the LAGERS fund. Motion seconded by Councilmember Edmondson and the motion failed with the following vote after Council discussion with the following votes: COUNCIL DISCUSSION Council discussed staff pay and pension benefits, and the funds needed to change the City's pension plan from a LAGERS L-7 plan to an L-6 plan. PUBLIC HEARING - Mayor Ross opened the Public Hearing to consider amendments to AMENDMENTS TO THE the Unified Development Code relating to Medical Marijuana at 6:24 UNIFIED DEVELOPMENT p.m. The minutes of the public hearing were recorded by a certified CODE RELATING TO court reporter. City Clerk Sheryl Morgan entered one exhibit into the MEDICAL MARIJUANA record. STAFF REPORT Mike Mallon, Assistant Director of Community Development reviewed the details of the proposed amendments. The Mayor hearing no further comments for or against, closed the public hearing at 6:32 p.m. INTRODUCTION AND 1ST Councilmember Kaylor introduced Bill No. 4691 amending sections READING - BILL NO. 405.050.A.34, Medical Marijuana Dispensary; Section 405.050.A.35. 4691 - AMENDMENTS TO Medical Marijuana Cultivation Facility; Section 405.050.A.36. Medical THE UNIFIED Marijuana Testing Facility; Section 405.050.A.37 Medical Marijuana- DEVELOPMENT CODE infused Products Manufacturing Facility; Section 405.050.A.38 RELATING TO MEDICAL MARIJUANA Medical Marijuana Uses; and Section 405.050.A.39 Medical Marijuana Transportation Facility, of the Unified Development Code of the Code of Ordinances to clarify the measurement methods and separation distances for medical marijuana facilities. Motion seconded by Councilmember Ericson and, after Council discussion, carried unanimously. 2ND READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4691 by title. 4691 Councilmember Fowler moved to adopt Bill No. 4691 upon its second reading and give it ORDINANCE NO. 4848, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Ericson and carried with the following vote: Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Mayor Ross - Aye PUBLIC HEARING - Mayor Ross opened the Public Hearing to consider an amendment to AMENDMENT TO the Downtown Development Code contained within the City's Unified DOWNTOWN Development Code of the Code of Ordinances relating to appeal DEVELOPMENT CODE processes for the Downtown Review Board at 6:35 p.m. The minutes of the public hearing were recorded by a certified court reporter. City Clerk Sheryl Morgan entered one exhibit into the record. Councilmember Fowler moved to approve Bill No. 4692 upon its first reading and proceed with the second reading. Mayor Ross expressed his heartfelt gratitude and appreciation for the outpouring of love and support shown by so many with the passing of the First Lady, Eloise Ross. Mayor Ross stated that although she is no longer with us in body, her spirit will forever remain in our hearts. CLOSED SESSION At 6:39 p.m ., Councilmember Culpepper moved for the Council go into closed session pursuant to Section 610. 021 (2) , Revised Statutes of Missouri, for the purpose of privileged communications between a governmental body or its representative and legal counsel relating to real estate, and that any minutes, documents and other records discussed or taken during the closed session remain closed , and that this body stand adjourned at the completion of such session.
