CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING SEPTEMBER 16, 2019 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, September 16, 2019, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 Smith Street with Mayor Carson Ross presiding. COUNCILMEMBERS IN Jerry Kaylor · Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Eric Johnson, Assistant City Administrator Christine Cates, City Attorney Jacqueline Sommer, and Deputy City Clerk Julia Porter. CALL MEETING TO Mayor Ross called the meeting to order at 6:00 p.m. and led in the ORDER Pledge of Allegiance. CONSENT AGENDA Councilmember Culpepper moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Edmondson. • Minutes of the September 4, 2019 City Council Meeting • Resolution No. 55-2019 approving a data sharing agreement with MARC/Operation Green Light The Consent Agenda was approved with the following vote: Kaylor-Aye Ericson - Aye Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Mayor Ross - Aye 2ND READING - BILL NO. Ms. Porter made the second reading of Bill No. 4690 approving the FY 4690 - FY 2019-20 2019-20 Budget by title -the public hearing was held and first reading BUDGET of Bill 4690 approved at the September 4, 2019 City Council meeting. Councilmember Fowler moved to adopt Bill No. 4690 upon its second reading and give it ORDINANCE NO. 4850, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Culpepper carried with the following vote: Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Mayor Ross - Aye RESOLUTION 56-2019- Councilmember Culpepper moved to adopt Resolution No. 56-2019 PAVING CONTRACT approving a contract in the amount of $1,626,945.00 with Tandem Paving Co, Inc. for projects included in the FY2019-20 Capital Improvement Program, specifically paving of Rotary Park Trail PR-11- 18, Adams Dairy Parkway Trail PR-10-18 and the Adams Pointe Golf September 16, 2019 City Council Minutes Page2 Club PR-04-18. Motion seconded by Councilmember Fowler and carried unanimously. INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 4693 approving the READING - BILL NO. Final Plat for Ridgewood Place at Chapman Farms 2nd Plat, Lots 35- 4693 - FINAL PLAT FOR 98 and Tracts D-G (PF-06-19-6980). Deputy City Clerk Julia Porter RIDGEWOOD PLACE AT made the first reading of Bill No. 4693 by title; copies of the proposed CHAPMAN FARMS 2ND Bill having previously been made availctble to the public. PLAT (PF-06-19-6980) Councilmember Fowler moved to approve Bill No. 4693 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Edmondson and carried unanimously. 2ND READING - BILL NO. Ms. Porter made the second reading of Bill No. 4693 by title. 4693 Councilmember Fowler moved to adopt Bill No. 4693 upon its second reading and give it ORDINANCE NO. 4851, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Ericson and carried with the following vote: Fowler-Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Edmondson - Aye Lievsay - Aye Mayor Ross - Aye INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 4694 adopting and READING - BILL NO. enacting a new Code of Ordinances, City of Blue Springs, Missouri, 4694 - ADOPTING AND which shall supersede all other general and permanent ordinances of ENACTING A NEW CODE the City passed on or before June 3, 2019, to recodify to make OF ORDINANCES corrections, revisions, and updates to incorporate statutory and other changes. Deputy City Clerk Julia Porter made the first reading of Bill No. 4694 by title; copies of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4694 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Ericson and carried unanimously. 2ND READING - BILL NO. Ms. Porter made the second reading of Bill No. 4694 by title. 4694 Councilmember Fowler moved to adopt Bill No. 4694 upon its second reading and give it ORDINANCE NO. 4852, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Culpepper and carried with the following vote: Ericson - Aye Kaylor-Aye Edmondson - Aye Lievsay-Aye Culpepper - Aye Fowler-Aye Mayor Ross - Aye INTRODUCTION AND 1 ST Councilmember Culpepper introduced Bill No. 4695 amending READING - BILL NO. Sections 625.010, 625.020, and 625.025 of the Code of Ordinances to 4695 - AMEND THE raise the minimum age from 18 to 21 for cigarette and other tobacco CODE OF ORDINANCES products sale and purchase. TOBACCO PRODUCTS Councilmember Fowler moved to approve Bill No. 4695 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Culpepper. STAFF NOTE Voice votes in opposition to the first reading were made. The opposition votes appeared to be a majority of the Council, however a roll call vote was not taken to identify the dissenting Councilmembers. The Deputy City Clerk proceeded to the second reading in error. 2ND READING - BILL NO. Ms. Porter made the second read ing of Bill No. 4695 by title. 4695 Councilmember Fowler moved to adopt Bill No. 4695 upon its second reading and give it the appropriate ordinance number, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Ericson and failed with the following vote: Edmondson - NO Lievsay- NO Culpepper - Aye Fowler- NO Kaylor-Aye Ericson - Aye Mayor Ross - NO MAYORAL Thoughts to Ponder: ANNOUNCEMENTS "Don 't talk about it, be about it." (Bob Burns) ADJOURNMENT At 6:09 p.m. , there was no further business to come before the Council, Councilmember Kaylor moved the meeting be adjourned .
