CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING MARCH 16, 2020 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, March 16, 2020, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 Smith Street with Mayor Carson Ross presiding. COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Eric Johnson, Assistant City Administrator Christine Cates, City Attorney Jacqueline Sommer, and City Clerk Sheryl Morgan. CALL MEETING TO Mayor Ross called the meeting to order at 6:00 p.m. and led in the ORDER Pledge of Allegiance. Mayor Ross stated that Councilmember Ericson has requested Consent Agenda Item 3i - Purchase of four license plate readers be pulled from the Consent Agenda for separate consideration. CONSENT AGENDA Councilmember Culpepper moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Kaylor. • Minutes of the February 19, 2020 and March 2, 2020 City Council Meetings • Resolution No. 24-2020 approving a contract in the amount of $862,158.00 with Garland/DBS, Inc., for the roof replacement at the Adams Pointe Conference Center • Resolution No. 25-2020 approving a contract in the amount of $87,086.00 with McConnell & Associates Corp. for Rotary Park basketball court renovations • Resolution No. 26-2020 authorizing a farm lease agreement with Wright Liberty Farms, LLC for City owned property near Atherton, Missouri • Resolution No. 27-2020 approving a Memorandum of Understanding between the City of Blue Springs and the Western Missouri Cyber Crimes Task Force for the placement of a Field Investigator • Resolution No. 28-2020 approving a contract in the amount of $60,498.90 with Adam's Lawn and Fence LLC for grounds and turf maintenance of City Parks • Resolution No. 29-2020 approving a contract in the amount of $103,775.00with Stirling Lawn and Landscape Inc. dba US Lawns of Kansas City. for grounds and turf maintenance of City public buildings, rights-of-way, and other City owned properties • Liquor License for Mirza Khan I, LLC dba Conoco located at 2401 NW 7 Highway Blue Springs, MO 64014, to sell intoxicating liquors in original package, for consumption off premises, to March 16, 2020 City Council Minutes Page 2 include Sunday retail selling of intoxicating liquors by the drink, on the premises; or in original package for consumption on or off premises • Resolution No. 31-2020 approving the withdrawal of membership in Midwest Public Risk of Missouri, to terminate participation in the insurance pool with regard to health, dental, and vision insurance coverage and with regard to property, liability, and worker's compensation coverage, effective July 1, 2020 The above Consent Agenda items were approved with the following vote: Kaylor-Aye Ericson - Aye Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Mayor Ross - Aye RESOLUTION NO. 30-2020 Councilmember Ericson stated he thought the purchase of the license - LICENSE PLATE plate readers was a good use of the Public Safety Sales Tax funds. READER SYSTEMS Councilmember Culpepper moved to approve Resolution No. 30- 2020 approving a contract in the amount of $71,578.00 from Turn-Key Mobile, Inc. for the purchase and installation of a total of four License Plate Reader systems. The motion was seconded by Councilmember Kaylor and carried unanimously. PUBLIC HEARING - Mayor Ross advised the Council that the applicant, S-Squared REZONE Development, on behalf of the owner, J. Stephen Grantham, withdrew (RZ-12-19-7161) AND PD their application for Rezoning (RZ-12-19-7161) and Planned CONCEPT PLAN Development Concept Plan (PDC-12-19-7162) for Deer Creek. (PDC-12-19-7162) FOR DEER CREEK INTRODUCTION AND 1ST Councilmember Fowler introduced Bill No. 4742 approving the Final READING-BILL NO. 4742 Plat for Jones Place, Lots 1-10 located northeast of the intersection of - FINAL PLAT FOR JONES SW 8th Street and SW Jones Street (PF-09-19-7056). City Clerk PLACE (PF-08-19-7056) Sheryl Morgan made the first reading of Bill No. 4742 by title; copies of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4742 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Lievsay and carried unanimously. 2ND READING- BILL NO. Ms. Morgan made the second reading of Bill No. 4742 by title. 4742 Councilmember Fowler moved to adopt Bill No. 4742 upon its second reading and give it ORDINANCE NO. 4895, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Lievsay and carried with the following vote: Fowler-Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Edmondson - Aye Lievsay - Aye March 16, 2020 City Council Minutes Page 3 Mayor Ross-Aye INTRODUCTION AND 1 ST Councilmember Culpepper introduced Bill No. 4743 approving the READING - BILL NO. 4743 Final Plat for Eagles Ridge Estates PR-O 2nd Plat, Lots 38 thru 69 - FINAL PLAT FOR and Tracts D & E, located +/- 200-ft. east of the intersection of SW 3rd EAGLES RIDGE ESTATES Street and SW Eagles Ridge Drive (PF-09-19-7057). City Clerk Sheryl (PF-09-19-7057) Morgan made the first reading of Bill No. 4743 by title; copies of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4743 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Lievsay and carried unanimously. 2ND READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4743 by title. 4743 Councilmember Fowler moved to adopt Bill No. 4743 upon its second reading and give it ORDINANCE NO. 4896, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Lievsay and carried with the following vote: Ericson - Aye Kaylor-Aye Edmondson - Aye Lievsay - Aye Culpepper - Aye Fowler-Aye Mayor Ross - Aye INTRODUCTION AND 1 ST Councilmember Culpepper introduced Bill No. 4744 terminating the READING - BILL NO. 4744 Chapter 353 tax abatement issued to Target Time Defense on June -TERMINATING TAX 15, 2015 by Ordinance No. 4545 on June 15, 2015. Approval of this ABATEMENT FOR Bill will return the property to full tax assessment beginning in the tax TARGET TIME DEFENSE year 2020. City Clerk Sheryl Morgan made the first reading of Bill No. 4744 by title; copies of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4744 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Culpepper and carried unanimously. 2ND READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4744 by title. 4744 Councilmember Fowler moved to adopt Bill No. 4744 upon its second reading and give it ORDINANCE NO. 4897, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Culpepper and carried with the following vote: Edmondson - Aye Lievsay - Aye Culpepper - Aye Fowler-Aye Kaylor-Aye Ericson - Aye Mayor Ross - Aye PRESENTATION - HUMAN Mayor Ross announced that the presentation from the Human RELATIONS COMMISSION Relations Commission was being postponed and the new date will be ANNUAL REPORT announced in the future. March 16, 2020 City Council Minutes Page 4 MAYORAL Mayor Ross read a statement about the closure of City facilities and ANNOUNCEMENTS processes due to the COVID-19 virus . Community Services League will be stepping up to provide for people in need during this timeframe . Thoughts to ponder: "We may encounter many defeats, but we must not be defeated. " (Maya Angelou) CLOSED SESSION At 6:08 p.m ., Councilmember Kaylor moved for the Council go into closed session pursuant to Section 610.021 (2), Revised Statutes of Missouri, for the purpose of privileged communications between a governmental body or its representative and legal counsel relating to real estate, and that any minutes, documents and other records discussed or taken during the closed session remain closed, and that the special meeting of this body stand adjourned at the completion of such session.
