CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING JANUARY 19, 2021 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Tuesday, January 19, 2021, 6:00 p.m. with Mayor Carson Ross presiding. Pursuant to Jackson County Executive Order dated November 18, 2020 and any subsequent amendments and Phase 2.5 of the Eastern Jackson County Recovery Plan limiting public gatherings, the City Council participated in this meeting via video-conference and telephone to ensure safe social distancing measures were taken as provided in Sections 610.020(1) and 610.020(4) RSMo. The public was able to attend via telephone conference. COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Eric Johnson, Assistant City Administrator Christine Cates, City Attorney Jacqueline Sommer, and City Clerk Sheryl Morgan. CALL MEETING TO Mayor Ross called the meeting to order at 6:00 p.m. City Clerk Sheryl ORDER Morgan confirmed a quorum of the Council was present. CONSENT AGENDA Councilmember Culpepper moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Ericson. • Minutes of the January 4, 2021 City Council Meeting • Resolution No. 03-2021 approving a 1-year contract renewal in the amount of $50,000.00 per task with 3MAT Co. dba Precision Concrete Cutting Midwest for trip hazard removal The above Consent Agenda items were approved with the follow vote: Kaylor-Aye Ericson - Aye Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Mayor Ross - Aye PUBLIC HEARING - Mayor Ross opened the Public Hearing to consider a General GENERAL DEVELOPMENT Development Plan for the 5.82 +/- acre office-warehouse or PLAN FOR NE CORNER contractor's office development with located at the NE corner of OF ADAMS DAIRY Adams Dairy Parkway and US 40 Highway (GDP-12-20-7611) at 6:02 PARKWAY AND US 40 p.m. The minutes of the public hearing were recorded by a certified HIGHWAY (GDP-12-20-7611) court reporter. City Clerk Sheryl Morgan entered one exhibit into the record. STAFF REPORT Senior Planner Nathan Jurey outlined the details of the proposed General Development Plan and answered questions from Council. January 19, 2021 City Council Minutes Page 2 APPLICANT Applicant and property owner Dennis Johnson of DJDA Properties, LLC addressed Council and answered questions about the project. The Mayor hearing no comments for or against, closed the public hearing at 6:32 p.m. INTRODUCTION AND 1ST Councilmember Edmondson introduced Bill No. 4832 approving a READING - BILL NO. 4832 General Development Plan for the 5.82 +/- acre office-warehouse or -GENERAL contractor's office development with located at the NE corner of DEVELOPMENT PLAN Adams Dairy Parkway and US 40 Highway (GDP-12-20-7611). City FOR NE CORNER OF Clerk Sheryl Morgan made the first reading of Bill No. 4832 by title; ADAMS DAIRY PARKWAY AND US 40 HIGHWAY copies of the proposed Bill having previously been made available to (GDP-12-20-7611) the public. Councilmember Kaylor moved to approve Bill No. 4832 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Fowler. MOTION TO AMEND BILL Councilmember Edmondson moved to edit the second paragraph of NO. 4832 Section 2 of Bill No. 4832 by replacing the words "be reduced to zero percent (0%) as allowed by UDC Section 406.030.B.2 (Open Space Exceptions) & Table 406.030.2 (Open Space Amount)" with "shall remain at fifteen percent (15%) unless reduced or waived by the City Council through the Conditional Use Permit process as allowed in the UDC". City Clerk Sheryl Morgan made the first reading of Bill No. 4833 PRIVATE SECURITY by title; copies of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4833 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Ericson and carried unanimously. Motion seconded by Councilmember Culpepper and carried with the following vote: Culpepper - Aye Fowler-Aye Kaylor-Aye Ericson - Aye Lievsay - Aye Edmondson - Aye Mayor Ross - Aye DISCUSSION - PARKS Director of Parks and Recreation Dennis Dovel and Parks SALES TAX Commission Chair Keith Hannaman presented the recommendation by the Parks Commission regarding the dedicated Parks Sales Tax and addressed questions from Council. INTRODUCTION AND 1 ST Councilmember Culpepper introduced Bill No. 4834 calling for an READING - BILL NO. 4834 election for the continuance of the ½-cent dedicated Parks Sales Tax - CALLING FOR AN for twenty years on the April 6, 2021 ballot. City Clerk Sheryl Morgan ELECTION FOR THE made the first reading of Bill No. 4834 by title; copies of the proposed CONTINUANCE OF THE Bill having previously been made available to the public. PARKS SALES TAX Councilmember Fowler moved to approve Bill No. 4834 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Lievsay. 1sr MOTION TO AMEND Councilmember Lievsay moved to remove the 20-year sunset and BILL NO. 4834 change the funding categories to make maintenance funding first, trails and playgrounds second, aquatics next, and then park development. Motion seconded by Councilmember Ericson. After Council discussion, Councilmember Ericson withdrew his second, and Councilmember Lievsay withdrew the pending motion to amend. 2No MOTION TO AMEND Councilmember Lievsay moved to amend Bill No. 4834 to remove all references to the 20-year sunset, and to remove the words "for twenty (20) years" from the Question and Notice of Election. (Norman Cousins) CLOSED SESSION At 7:46 p.m. , Councilmember Ericson moved for the Council go into closed session pursuant to Section 610 .021 (2) and (3) , Revised Statutes of Missouri , for the purpose of privileged communications between a governmental body or its representative and legal counsel relating to real estate and personnel matters, and that any minutes, documents and other records discussed or taken during the closed session remain closed, and that the special meeting of this body stand adjourned at the completion of such session .
