CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING SEPTEMBER 19, 2022 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, September 19, 2022, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 SW Smith Street, Blue Springs, Missouri with Mayor Pro Tern Chris Lievsay presiding. COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Mike Ekey, Assistant City Administrator Christine Cates, City Attorney Jacqueline Sommer, City Clerk Sheryl Morgan, and Assistant City Clerk Erin Ford. Mayor Ross was absent. CALL MEETING TO Mayor Pro Tern Lievsay called the meeting to order at 6:00 p.m. and ORDER AND Councilmember Ericson led in the pledge of allegiance. The Assistant CONFIRMATION OF City Clerk confirmed a quorum of the Council was present. QUORUM CONSENT AGENDA Councilmember Ericson moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Culpepper. COUNCIL DISCUSSION Councilmembers Kaylor and Culpepper made comments regarding Resolution 71-2022 - 74-2022. • Minutes of the September 6, 2022 City Council Meeting • Resolution No. 71-2022 adopting Memorandum of Understanding for FY 2023 with the Fraternal Order of Police, West Central Missouri Regional Lodge 50, for employees with the rank of Police Officer. • Resolution No. 72-2022 adopting a Memorandum of Understanding for FY 2023 with the Fraternal Order of Police, West Central Missouri Regional Lodge 50, for employees with the rank of Sergeant. • Resolution No. 73-2022 adopting a Memorandum of Understanding for FY 2023 Fraternal Order of Police, West Central Missouri Regional Lodge 50, employees with the rank of Lieutenant. • Resolution No. 74-2022 adopting a Memorandum of Understanding with International Association of Machinists and Aerospace Workers Local 778 for certain Public Works employees. The above Consent Agenda items were approved with the following vote: Kaylor-Aye Edmondson - Aye September 19, 2022 City Council Minutes Page 2 Fowler-Aye Culpepper - Aye Ericson - Aye Mayor Pro Tern Lievsay - Aye Mayor Ross - Absent PUBLIC HEARING - 2022 Mayor Pro Tern Lievsay opened the Public Hearing to receive public PROPERTY TAX LEVY comment on the 2022 Property Tax Levy for the City of Blue Springs at 6:04 p.m. The minutes of the public hearing were recorded by a certified court reporter. Assistant City Clerk Erin Ford entered one exhibit into the record. STAFF REPORT Assistant City Administrator Christine Cates reviewed the details of the 2022 Property Tax Levy and addressed questions from the Council. The Mayor Pro Tern hearing no further comments for or against, closed the public hearing at 6:06 p.m. INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 5023 establishing the READING - BILL NO. 5023 2022 Property Tax Levy. Assistant City Clerk Erin Ford made the first - 2022 PROPERTY TAX reading of Bill No. 5023 by title; copies of the proposed Bill having LEVY previously been made available to the public. Councilmember Fowler moved to approve Bill No. 5023 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and carried unanimously. 2ND READING - BILL NO. Ms. Ford made the second reading of Bill No. 5023 by title. 5023 Councilmember Fowler moved to adopt Bill No. 5023 upon its second reading and give it ORDINANCE NO. 5151, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Fowler-Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Edmondson - Aye Mayor Pro Tern Lievsay - Aye Mayor Ross - Absent 2ND READING - BILL NO. Ms. Ford made the second reading of Bill No. 5020 approving the 5020 Fiscal Year 2022-23 Budget by title. The Public Hearing was held and the first reading of Bill No. 5020 was approved at the September 6, 2022 City Council meeting. Councilmember Fowler moved to adopt Bill No. 5020 upon its second reading and give it ORDINANCE NO. 5152, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Ericson - Aye Kaylor-Aye Edmondson - Aye Fowler- No Culpepper - Aye Mayor Pro Tern Lievsay-Aye Mayor Ross - Absent September 19, 2022 City Council Minutes Page 3 INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 5024 approving a Fuel READING - BILL NO. 5024 Service Agreement with the Central Jackson County Fire Protection - FUEL SERVICE District for fleet vehicle fuel sales. Assistant City Clerk Erin Ford made AGREEMENT WITH the first reading of Bill No. 5024 by title; copies of the proposed Bill CENTRAL JACKSON having previously been made available to the public. COUNTY FIRE PROTECTION DISTRICT Councilmember Fowler moved to approve Bill No. 5024 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and carried unanimously. 2ND READING - BILL NO. Ms. Ford made the second reading of Bill No. 5024 by title. 5024 Councilmember Fowler moved to adopt Bill No. 5024 upon its second reading and give it ORDINANCE NO. 5153, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Edmondson - Aye Fowler-Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Mayor Pro Tern Lievsay- Aye Mayor Ross - Absent INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 5025 approving an READING - BILL NO. 5025 Intergovernmental Agreement with the Land Bank of Blue Springs, -INTERGOVERNMENTAL Missouri to provide administrative and operational support. Assistant AGREEMENT WITH THE City Clerk Erin Ford made the first reading of Bill No. 5025 by title; LAND BANK OF BLUE copies of the proposed Bill having previously been made available to SPRINGS, MISSOURI the public. Councilmember Fowler moved to approve Bill No. 5025 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and carried unanimously. 2ND READING - BILL NO. Ms. Ford made the second reading of Bill No. 5025 by title. 5025 Councilmember Fowler moved to adopt Bill No. 5025 upon its second reading and give it ORDINANCE NO. 5154, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Culpepper - Aye Ericson - Aye Kaylor-Aye Edmondson - Aye Fowler-Aye Mayor Pro Tern Lievsay - Aye Mayor Ross - Absent INTRODUCTION AND 1ST Council member Culpepper introduced Bill No. 5026 amending Section READING - BILL NO. 5026 122.020 of the Code of Ordinances, City of Blue Springs, Missouri to - AMEND SECTION add certain utility customer usage and billing records to the records 122.020 OF THE CODE OF that are authorized to be closed under the Missouri Sunshine Law. ORDINANCES RELATING Assistant City Clerk Erin Ford made the first reading of Bill No. 5026 TO THE SUNSHINE LAW by title; copies of the proposed Bill having previously been made available to the public. September 19, 2022 City Council Minutes Page 4 Councilmember Fowler moved to approve Bill No. 5026 upon its first reading and proceed with the second reading . Motion seconded by Councilmember Kaylor and carried unanimously. 2ND READING - BILL NO. Ms. Ford made the second reading of Bill No. 5026 by title . 5026 Councilmember Fowler moved to adopt Bill No. 5026 upon its second reading and give it ORDINANCE NO. 5155, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Kaylor-Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Ericson - Aye Mayor Pro Tern Lievsay - Aye Mayor Ross - Absent MAYORAL Mayor Pro Tern Lievsay introduced his wife Grace, son Benjamin and ANNOUNCEMENTS daughter Emily who attended the Council meeting . Mayor Pro Tern Lievsay recognized the retirement and last City Council meeting of City Attorney Jacqueline Sommer. ADJOURNMENT At 6:14 p.m., there was no further business to come before the Council, Councilmember Kaylor moved the meeting be adjourned. Motion seconded by Councilmember Culpepper and carried unanimously. ATTEST
