CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING NOVEMBER 21, 2022 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, November 21, 2022, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 SW Smith Street, Blue Springs, Missouri with Mayor Carson Ross presiding. COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Mike Ekey, City Attorney Sarah Carnes, and City Clerk Sheryl Morgan. CALL MEETING TO Mayor Ross called the meeting to order at 6:00 p.m. and Scouts from ORDER AND Pack 306 of United Church of the Resurrection led in the pledge of CONFIRMATION OF allegiance. The City Clerk confirmed a quorum of the Council was QUORUM present. CONSENT AGENDA Councilmember Ericson moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Kaylor. • Minutes of the November 7, 2022 City Council Meeting • Resolution 99-2022 approving a two-year contract in the amount of $348,320 with HOR Engineering for planning, design and implementation of services to improve and expand the Sni-A-Bar Wastewater Treatment Plant SNl-06. • Resolution 100-2022 authorizing the City Administrator to make a payment to Evergy for the installation of electrical services at the Southern Jackson County Fire Protection District's new Wyatt Road Station ST-54. The above Consent Agenda items were approved with the following vote: Kaylor-Aye Ericson- Aye Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Mayor Ross - Aye PUBLIC HEARING - Mayor Ross opened the Public Hearing to consider approval of a CONDITIONAL USE Conditional Use Permit with Alternative Development Standards for PERMIT FOR GERBER- Gerber-Blue Springs an autobody/collision repair shop on the property BLUE SPRINGS located at 1550 SE US Hwy 40 (CUP-10-22-8502) at 6:03 p.m. The (CUP-10-22-8502) minutes of the public hearing were recorded by a certified court reporter. City Clerk Sheryl Morgan entered one exhibit into the record. STAFF REPORT Associate Planner Shana Kelly reviewed the details of the proposed Conditional Use Permit and addressed questions from the Council. November 21, 2022 City Council Minutes Page 2 The Mayor, hearing no further comments for or against, closed the public hearing at 6:07 p.m. INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 5038 approving a READING - BILL NO. 5038 Conditional Use Permit for Gerber-Blue Springs. City Clerk Sheryl - CONDITIONAL USE Morgan made the first reading of Bill No. 5038 by title; copies of the PERMIT FOR GERBER- proposed Bill having previously been made available to the public. BLUE SPRINGS (CUP-10-22-8502) Councilmember Fowler moved to approve Bill No. 5038 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and carried unanimously. 2ND READING - BILL NO. Ms. Morgan made the second reading of Bill No. 5038 by title. 5038 Councilmember Fowler moved to adopt Bill No. 5038 upon its second reading and give it ORDINANCE NO. 5167, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Mayor Ross - Aye INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 5039 authorizing the READING - BILL NO. 5039 Mayor to enter into a memorandum of understanding to secure a - MEMORANDUM OF License Agreement for a City Monument with the Missouri Highways UNDERSTANDING WITH and Transportation Commission (MoDOT). City Clerk Sheryl Morgan MoDOT FOR A CITY made the first reading of Bill No. 5039 by title; copies of the proposed MONUMENT Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 5039 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and, after Council discussion, carried with a vote of 6-1 (Councilmember Ericson voting no). 2ND READING - BILL NO. Ms. Morgan made the second reading of Bill No. 5039 by title. 5039 Councilmember Fowler moved to adopt Bill No. 5039 upon its second reading and give it ORDINANCE NO. 5168, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Fowler-Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Edmondson - Aye Lievsay - Aye Mayor Ross - Aye INTRODUCTION AND 1ST Councilmember Culpepper introduced Bill No. 5040 approving a READING - BILL NO. 5040 contract in the amount of $13,967 with the Kansas City Area - CONTRACT WITH Transportation Authority (KCATA) to provide commuter bus services KANSAS CITY AREA from Blue Springs to the downtown Kansas City area. City Clerk TRANSPORTATION Sheryl Morgan made the first reading of Bill No. 5040 by title; copies AUTHORITY FOR BUS SERVICES November 21, 2022 City Council Minutes Page 3 of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 5040 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Ericson. Mayor Ross stated that he would be recusing himself from the vote on this matter as his son-in-law is the interim Chief Executive Officer of KCATA. Council requested staff to contact neighboring cities to discuss cost-sharing for this contract in the future. After Council discussion, carried with a 6-0 vote with Mayor Ross having recused himself. 2ND READING - BILL NO. Ms. Morgan made the second reading of Bill No. 5040 by title. 5040 Councilmember Fowler moved to adopt Bill No. 5040 upon its second reading and give it ORDINANCE NO. 5169, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Ericson - Aye Kaylor-Aye Edmondson - Aye Lievsay -Aye Culpepper - Aye Fowler-Aye Mayor Ross - Recused VISITORS Earl Williams addressed Council regarding sidewalks, signs and drains in his neighborhood.
