CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING DECEMBER 5, 2022 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, December 5, 2022, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 SW Smith Street, Blue Springs, Missouri with Mayor Carson Ross presiding. COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Mike Ekey, Deputy City Administrator Christine Cates, City Attorney Sarah Carnes, and Deputy City Clerk Julia Porter. CAL[_ MEETING TO Mayor Ross called the meeting to order at 6:00 p.m. and led in the ORDER AND pledge of allegiance. The Deputy City Clerk confirmed a quorum of the CONFIRMATION OF Council was present. QUORUM CONSENT AGENDA Council member Ericson requested Item 3c Resolution No. 102-2022 approving a purchase in the amount of $326,839 from Blue Springs Ford Sales, Inc. for five Ford hybrid utility patrol vehicles and two Ford F150 patrol trucks be pulled from the Consent Agenda for separate consideration. Councilmember Edmondson moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Culpepper. • Minutes of the November 21, 2022 City Council Meeting • Resolution 101-2022 approving a contract in the amount of $242,330 with Tandem Paving Company, Inc., for installation of footings and site work for restroom building installation at Young Park and Blue Springs Park; included in CIP projects PR-02 and PR-15, respectively The above Consent Agenda items were approved with the following vote: Kaylor-Aye Ericson- Aye Lievsay-Aye Edmondson -Aye Fowler-Aye Culpepper - Aye Mayor Ross - Aye ITEM 3c- PURCHASE After Council discussion, Councilmember Kaylor moved to approve OF PATROL VEHICLES item 3c - Resolution No. 102-2022 approving a purchase in the amount of $326,839 from Blue Springs Ford Sales, Inc. for five Ford hybrid utility patrol vehicles and two Ford F150 patrol trucks. Motion seconded by Councilmember Ericson and carried unanimously. December 5, 2022 City Council Minutes Page 2 PUBLIC HEARING - Mayor Ross advised the Council the applicant, John Broker, Dwellings DWELLINGS BY by Design KC, has requested a continuance of the public hearing to DESIGN REZONING the December 19, 2022 Council Meeting. Councilmember Culpepper (RZ-11-22-8508) & moved to continue the public hearing on the consideration to rezone GENERAL from Sub-Urban and General Urban to Urban Center (RZ-11-22-8508) DEVELOPMENT PLAN for the 1.1317+/- acre multi-family residential development with a (GDP-11-22-8509) - General Development Plan (GDP-11-22-8509) located at 106 NW 9th MOTION TO CONTINUE Street and 110 SW 9th Street to the December 19, 2022 Council meeting. Motion seconded by Councilmember Kaylor and carried unanimously. INTRODUCTION AND Councilmember Culpepper introduced Bill No. 5041 repealing Section 1ST READING- BILL 220.290 of the City of Blue Springs Code of Ordinances relating to NO. 5041-REPEAL Interference With Custody. Deputy City Clerk Julia Porter made the SECTION 220.290 first reading of Bill No. 5041 by title; copies of the proposed Bill having RELATING TO previously been made available to the public. INTERFERENCE WITH CUSTODY Councilmember Fowler moved to approve Bill No. 5041 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and carried unanimously. 2ND READING - BILL Ms. Porter made the second reading of Bill No. 5041 by title. NO. 5041 Councilmember Fowler moved to adopt Bill No. 5041 upon its second reading and give it ORDINANCE NO. 5170, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Ericson- Aye Kaylor-Aye Mayor Ross - Aye INTRODUCTION AND Councilmember Culpepper introduced Bill No. 5042 amending Section 1ST READING - BILL 220.255 of the City of Blue Springs Code of Ordinances relating to NO. 5042 - AMEND Domestic Assault penalties. Deputy City Clerk Julia Porter made the SECTION 220.255 first reading of Bill No. 5042 by title; copies of the proposed Bill having RELATING TO THE previously been made available to the public. DOMESTIC ASSAULT PENALTIES Councilmember Fowler moved to approve Bill No. 5042 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and carried unanimously. 2ND READING - BILL Ms. Porter made the second reading of Bill No. 5042 by title. NO. 5042 Councilmember Fowler moved to adopt Bill No. 5042 upon its second reading and give it ORDINANCE NO. 5171, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Fowler-Aye Culpepper - Aye Ericson- Aye Kaylor-Aye Edmondson - Aye Lievsay - Aye Mayor Ross - Aye December 5, 2022 City Council Minutes Page 3 INTRODUCTION AND Councilmember Culpepper introduced Bill No. 5043 amending 1ST READING - BILL Ordinance No. 4633 approving the Final Plat for Colonial Gardens 1st NO. 5043 - AMEND Plat extending the date for completion of the development approval ORDINANCE 4633 process for public improvements and requiring the annexation of nine FINAL PLAT FOR acres into the City to June 19, 2023. Deputy City Clerk Julia Porter COLONIAL GARDENS made the first reading of Bill No. 5043 by title; copies of the proposed 1sr PLAT Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 5043 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Lievsay and, after Council discussion, carried unanimously. 2ND READING - BILL Ms. Porter made the second reading of Bill No. 5043 by title. NO. 5043 Councilmember Fowler moved to adopt Bill No. 5043 upon its second reading and give it ORDINANCE NO. 5172, with a copy attached hereto and made a part of the minutes. DUNCAN ROAD MAYORAL The Mayor's Christmas Tree Lighting Ceremony starts at 5:30 p.m. on ANNOUNCEMENTS December 6, 2022 at City Hall. There will be cookies, crafts, and a visit from Santa.
