CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING MARCH 6, 2023 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, March 6, 2023, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 SW Smith Street, Blue Springs, Missouri with Mayor Carson Ross presiding. COUNCILMEMBERS IN Jerry Kaylor - ABSENT Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Mike Ekey, City Attorney Sarah Carnes, and City Clerk Sheryl Morgan. CALL MEETING TO Mayor Ross called the meeting to order at 6:00 p.m. and Scouts from ORDER AND Troop 692 of the American Legion led in the pledge of allegiance. The CONFIRMATION OF City Clerk confirmed a quorum of the Council was present. QUORUM CONSENT AGENDA Councilmember Culpepper moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Ericson. • Minutes of the February 6, 2023 City Council Meeting • Resolution No. 08-2023 approving the disposition of Information Technology, City Clerk, Community Development, and Economic Development department records which have met the required retention period as prescribed by the Blue Springs Records Retention, Management, and Destruction Policy dated Nov. 28, 2016, and in accordance with the Missouri Secretary of State's records retention guidelines. • Board and Commission Appointments Economic Development Council: New Appointment: Adam Hathhorn (Term exp. 5/2023) Planning Commission: New Appointment: Richard How (Term exp. 05/2023) • Resolution No. 09"2023 approving an Amendment to Labor Agreement between the City and the International Association of Machinists and Aerospace Workers Local 778 for certain Public Works employees for FY 2023 • Resolution No. 10-2023 approving a purchase in the amount of $126,335.25 from Viking-Cives Midwest, Inc. for a Dump Truck, CIP project PR-73 • Resolution No. 11-2023 approving payment in the amount of $115,514.27 for emergency repair invoices for work completed in the months of November and December 2022, and January 2023 • Resolution No. 12-2023 approving contracts with Beemer Construction Co., Inc., Genesis Environmental Solutions, Inc., J & N Utilities, Inc., Quality Plumbing, Inc., Shedigs It, LLC, and Wiedenmann, Inc. based on the annual budget for on-call March 6, 2023 City Council Minutes Page 2 infrastructure repair and replacement The above Consent Agenda items were approved with the following vote: Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Ericson- Aye Mayor Ross - Aye Kaylor - ABSENT PUBLIC HEARING - Mayor Ross opened the Public Hearing to consider a vacation of right- VACATIONS FOR of-way for a temporary cul-de-sac and vacation of platted utility CHAPMAN RIDGE 3RD easements for Chapman Ridge 3rd Plat generally located north of E PLAT Colbern Road and west of SE Chapman Ridge Drive at 6:03 p.m. (VAC-01-23-8605) (VAC-01-23-8605). The minutes of the public hearing were recorded by a certified court reporter. City Clerk Sheryl Morgan entered one exhibit into the record. STAFF REPORT Associate Planner Adair Bright reviewed the details of the proposed vacations and addressed questions from the Council. APPLICANT Applicant Jim Long was present to answer any questions from Council. The Mayor hearing no further comments for or against, closed the public hearing at 6:07 p.m. INTRODUCTION AND Councilmember Culpepper introduced Bill No. 5061 approving a 1ST READING - BILL vacation of right-of-way for a temporary cul-de-sac generally located NO. 5061 -VACATION north of E Colbern Road and west of SE Chapman Ridge Drive (VAC- OF RIGHT-OF-WAY FOR 01-23-8605). City Clerk Sheryl Morgan made the first reading of Bill CHAPMAN RIDGE 3Ro No. 5061 by title; copies of the proposed Bill having previously been PLAT made available to the public. (VAC-01-23-8605) Councilmember Fowler moved to approve Bill No. 5061 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Lievsay and carried unanimously. 2ND READING - BILL Ms. Morgan made the second reading of Bill No. 5061 by title. NO. 5061 Councilmember Fowler moved to adopt Bill No. 5061 upon its second reading and give it ORDINANCE NO. 5190, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Lievsay and carried with the following vote: Fowler-Aye Culpepper - Aye Ericson- Aye Lievsay - Aye Edmondson - Aye Mayor Ross - Aye Kaylor-ABSENT INTRODUCTION AND Councilmember Culpepper introduced Bill No. 5062 approving a 1ST READING - BILL vacation of platted utility easements generally located north of E NO. 5062-VACATION Colbern Road and west of SE Chapman Ridge Drive (VAC-01-23- March 6, 2023 City Council Minutes Page 3 OF UTILITY 8605). City Clerk Sheryl Morgan made the first reading of Bill No. EASEMENTS FOR 5062 by title; copies of the proposed Bill having previously been made CHAPMAN RIDGE 3RD available to the public. PLAT (VAC-01-23-8605) Councilmember Fowler moved to approve Bill No. 5062 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Lievsay and carried unanimously. 2ND READING - BILL Ms. Morgan made the second reading of Bill No. 5062 by title. NO. 5062 Councilmember Fowler moved to adopt Bill No. 5062 upon its second reading and give it ORDINANCE NO. 5191, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Lievsay and carried with the following vote: Ericson- Aye Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Mayor Ross - Aye Kaylor - ABSENT PUBLIC HEARING - Mayor Ross opened the Public Hearing to consider amendments to AMEND UNIFIED various sections of Chapters 401-411 of the City of Blue Springs DEVELOPMENT CODE Unified Development Code related to recreational marijuana at 6:09 REGARDING p.m. (UDCT-01-23-8609). The minutes of the public hearing were RECREATIONAL recorded by a certified court reporter. City Clerk Sheryl Morgan MARIJUANA entered one exhibit into the record. (UDCT-01-23-8609) STAFF REPORT Director of Community Development Mike Mallon reviewed the details of the proposed Unified Development Code amendments and addressed questions from the Council. The Mayor hearing no further comments for or against, closed the public hearing at 6:20 p.m. INTRODUCTION AND Councilmember Culpepper introduced Bill No. 5063 approving 1ST READING - BILL amendments to various sections of Chapters 401-411 of the City of NO. 5063 - AMEND Blue Springs Unified Development Code related to recreational UNIFIED marijuana p.m. (UDCT-01-23-8609). City Clerk Sheryl Morgan made DEVELOPMENT CODE the first reading of Bill No. 5063 by title; copies of the proposed Bill REGARDING having previously been made available to the public. RECREATIONAL MARIJUANA Councilmember Fowler moved to approve Bill No. 5063 upon its first (UDCT-01-23-8609) reading and proceed with the second reading. Motion seconded by Councilmember Lievsay and carried 5-1 with Councilmember Ericson voting no. 2ND READING - BILL Ms. Morgan made the second reading of Bill No. 5063 by title. NO. 5063 Councilmember Fowler moved to adopt Bill No. 5063 upon its second reading and give it ORDINANCE NO. 5192, with a copy attached hereto and made a part of the minutes. The AWARDS Sunset Optimist Club of Blue Springs received the Organization Citation Award, Brandon Jackley of Chick-fil-A Blue Springs received the Musco Give Back Award and Mary Herrington was awarded the Parks Resource Distinguished Service Award.
