CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING OCTOBER 16, 2023 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, October 16, 2023, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 SW Smith Street, Blue Springs, Missouri with Mayor Carson Ross presiding. COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Christine Cates, City Attorney Sarah Carnes, and City Clerk Sheryl Morgan. CALL MEETING TO Mayor Ross called the meeting to order at 6:00 p.m. and led in the ORDER AND pledge of allegiance. The City Clerk confirmed a quorum of the Council CONFIRMATION OF was present. QUORUM CONSENT AGENDA Councilmember Edmondson moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Ericson. • Minutes of the October 2, 2023 City Council Meeting • Resolution 98-2023 rescinding Resolution No. 48-2023 approved by the City Council on August 7, 2023 and approve a purchase in the amount of $50,399 from Whalley Computer Associates, Inc. for Uninterruptable Power Supply (UPS) System for all City locations • Resolution 99-2023 approving a contract in the amount of $277,339.00 with The Public Restroom Company for the replacement of Ward Park Restroom facilities. This project is approved as CIP project PR-20 - Ward Park Improvements. • Resolution 100-2023 approving updates to the City's Purchasing Policy to increase the purchasing thresholds and to clarify requirements for reserve purchase orders • Resolution 101-2023 ratify an emergency repair expense in the amount of $50,840.24 with Rodriguez Mechanical Contractors for emergency repairs to sanitary sewer lateral for Calvary Baptist Church and fire hydrant installation for the public water system The above Consent Agenda items were approved with the following vote: Kaylor-Aye Ericson- Aye Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Mayor Ross - Aye PUBLIC HEARING - Mayor Ross opened the Public Hearing to consider amendments to AMENDMENTS TO the Unified Development Code to adopt the new Flood Insurance UNIFIED Study from the Federal Emergency Management Agency (UDCT-09- DEVELOPMENT CODE 23-8882) at 6:03 p.m. The minutes of the public hearing were recorded October 16, 2023 City Council Minutes Page 2 RELATING TO by a certified court reporter. City Cieri< Sheryl Morgan entered one FLOODPLAINS exhibit into the record. (UDCT-09-23-8882) STAFF REPORT Community Development Director Mike Mallon reviewed the details of the proposed amendments to the Unified Development Code and addressed questions from the Council. The Mayor hearing no further comments for or against, closed the public hearing at 6:05 p.m. INTRODUCTION AND Councilmember Culpepper introduced Bill No. 5144 approving 1ST READING - BILL amendments to the Unified Development Code to adopt the new Flood NO. 5144- Insurance Study from the Federal Emergency Management Agency AMENDMENTS TO (UDCT-09-23-8882). City Clerk Sheryl Morgan made the first reading UNIFIED of Bill No. 5144 by title; copies of the proposed Bill having previously DEVELOPMENT CODE been made available to the public. RELATING TO FLOODPLAINS Councilmember Fowler moved to approve Bill No. 5144 upon its first (UDCT-09-23-8882) reading and proceed with the second reading. Motion seconded by Councilmember Lievsay and carried unanimously. 2ND READING - BILL Ms. Morgan made the second reading of Bill No. 5144 by title. NO. 5144 Councilmember Edmondson moved to adopt Bill No. 5144 upon its second reading and give it ORDINANCE NO. 5265, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Mayor Ross - Aye INTRODUCTION AND Councilmember Culpepper introduced Bill No. 5145 approving an 1ST READING - BILL Annexation Agreement with the fee simple owners, Jim L. Rand, Jeff NO. 5145- Siems, and Carrie B. Siems, of property located south of SE ANNEXATION Sunnyside School Road and west of SE Adams Dairy Parkway. City AGREEMENT FOR Clerk Sheryl Morgan made the first reading of Bill No. 5145 by title; PROPERTY SOUTH OF copies of the proposed Bill having previously been made available to SE SUNNYSIDE the public. SCHOOL ROAD AND WEST OF SE ADAMS Councilmember Fowler moved to approve Bill No. 5145 upon its first DAIRY PARKWAY reading and proceed with the second reading. Motion seconded by (ANNX-09-23-8877) Councilmember Kaylor and carried unanimously. 2ND READING - BILL Ms. Morgan made the second reading of Bill No. 5145 by title. NO. 5145 Councilmember Edmondson moved to adopt Bill No. 5145 upon its second reading and give it ORDINANCE NO. 5266, with a copy attached hereto and made a part of the minutes. The NO. 5136 Public Hearing was held, and the first reading of Bill No. 5136 was approved at the October 2, 2023 City Council meeting. Councilmember Edmondson moved to adopt Bill No. 5136 upon its second reading and give it ORDINANCE NO. 5267, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Ericson and carried with the following vote: Ericson - Aye Kaylor-Aye Edmondson - Aye Lievsay - Aye Culpepper - Aye Fowler-Aye Mayor Ross - Aye INTRODUCTION AND Councilmember Culpepper introduced Bill No. 5146 approving the 1ST READING - BILL Final Plat for Four Pillars 5th Plat (PF-08-23-8870), located south of NO. 5146 NE Roanoke Drive and east of Four Pillars 4th Plat. City Clerk Sheryl FINAL PLAT FOR FOUR Morgan made the first reading of Bill No. 5146 by title; copies of the PILLARS 5TH PLAT proposed Bill having previously been made available to the public. (PF-08-23-8870) Councilmember Fowler moved to approve Bill No. 5146 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Ericson and carried unanimously. 2ND READING - BILL Ms. Morgan made the second reading of Bill No. 5146 by title. NO. 5146 Councilmember Edmondson moved to adopt Bill No. 5146 upon its second reading and give it ORDINANCE NO. 5268, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Kaylor and carried with the following vote: Edmondson - Aye Lievsay - Aye Culpepper - Aye Fowler-Aye Kaylor-Aye Ericson - Aye Mayor Ross - Aye INTRODUCTION AND Councilmember Culpepper introduced Bill No. 5147 accepting the 1ST READING - BILL conveyance of a permanent sanitary sewer easement, from Kaw NO. 5147 - SEWER Management Group, L.L.C. for Coronado Plaza West. City Clerk EASEMENT FOR Sheryl Morgan made the first reading of Bill No. 5147 by title; copies CORONADO PLAZA of the proposed Bill having previously been made available to the WEST public. Councilmember Fowler moved to approve Bill No. 5147 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and carried unanimously. City RELATING TO Clerk Sheryl Morgan made the first reading of Bill No. 5148 by title; MUNICIPAL COURT copies of the proposed Bill having previously been made available to OPERATIONS the public. Councilmember Fowler moved to approve Bill No. 5148 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Lievsay and carried unanimously. 2ND READING - BILL Ms. Morgan made the second reading of Bill No. 5148 by title. NO. 5148 Councilmember Edmondson moved to adopt Bill No. 5148 upon its second reading and give it ORDINANCE NO. 5270, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Ericson and carried with the following vote: Kaylor-Aye Ericson - Aye Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Mayor Ross -Aye VISITORS Adriane Handy and Amanda Ramirez spoke in support of backyard hens. (Winston Churchill) CLOSED SESSION At 6:23 p.m., Councilmember Culpepper moved for the Council go into closed session pursuant to Section 610.021 (1) Revised Statutes of Missouri, for the purpose of privileged communications between a governmental body or its representative and legal counsel relating to Litigation and that any minutes, documents and other records discussed or taken during the closed session remain closed, and that the special meeting of this body stand adjourned at the completion of October 16, 2023 City Council Minutes Page 5 such session .
