CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING NOVEMBER 6, 2023 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, November 6, 2023, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 SW Smith Street, Blue Springs, Missouri with Mayor Carson Ross presiding. COUNCILMEMBERS IN Jerry Kaylor Galen Ericson ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Christine Cates, City Attorney Sarah Carnes, and City Clerk Sheryl Morgan. CALL MEETING TO Mayor Ross called the meeting to order at 6:00 p.m. and led in the ORDER AND pledge of allegiance. The City Clerk confirmed a quorum of the Council CONFIRMATION OF was present. QUORUM CONSENT AGENDA Councilmember Edmondson moved to approve the following Consent Agenda items and the motion was seconded by Councilmember Ericson. • Minutes of the October 16, 2023 City Council Meeting • Resolution 102-2023 approving the disposition of Information Technology, Public Works and Police department records which have met the required retention period as prescribed by the Blue Springs Records Retention, Management, and Destruction Policy dated November 28, 2016 and in accordance with the Missouri Secretary of State's records retention guidelines • Resolution 103-2023 approving a contract with Athco Acquisition Corp. for the purchase and installation of playground equipment and surface at Keystone Park in the amount of $795,858.00 This project is included in the FY2023-24 CIP as project# PR-13 The above Consent Agenda items were approved with the following vote: Kaylor-Aye Ericson- Aye Lievsay - Aye Edmondson - Aye Fowler-Aye Culpepper - Aye Mayor Ross - Aye RESOLUTION 104-2023 Council member Fowler moved to adopt Resolution 104-2023 approving an Intergovernmental Cooperative Agreement Between Main Center Redevelopment Corporation and the City of Blue Springs, Missouri. Motion seconded by Councilmember Lievsay and carried unanimously. RESOLUTION 105-2023 Councilmember Culpepper moved to adopt Resolution 105-2023 approving - Americfmehts to the Bylaws of the Main Center Redevelopment Corporation. Motion seconded by Councilmember November 6, 2023 City Council Minutes Page 2 Fowler and carried unanimously. RESOLUTION 106-2023 Council member Culpepper moved to adopt Resolution 106-2023 approving the extension of the Main Center Redevelopment Corporation Incentive Policy for one additional year. Motion seconded by Councilmember Fowler and carried unanimously. INTRODUCTION AND Councilmember Culpepper introduced Bill No. 5149 amending Section 1ST READING- BILL 805.030.D of the Code of Ordinances to allow for the continuation of NO. 5149- MAIN credits for certain fees in the Main Center Redevelopment Corporation CENTER for a period of one additional year. City Clerk Sheryl Morgan made the REDEVELOPMENT first reading of Bill No. 5149 by title; copies of the proposed Bill having CORPORATION CODE previously been made available to the public. AMENDMENTS FOR FEES Councilmember Fowler moved to approve Bill No. 5149 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and carried unanimously. 2ND READING - BILL Ms. Morgan made the second reading of Bill No. 5149 by title. NO. 5149 Councilmember Edmondson moved to adopt Bill No. 5149 upon its second reading and give it ORDINANCE NO. 5271, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Culpepper and carried with the following vote: Lievsay - Aye Edmondson -Aye Fowler-Aye Culpepper - Aye Ericson - Aye Kaylor-Aye Mayor Ross - Aye INTRODUCTION AND Councilmember Culpepper introduced Bill No. 5150 terminating tax 1ST READING- BILL increment financing with the 7 Highway and 40 Highway NO. 5150 - 7 HIGHWAY redevelopment area, dissolving the related special allocation fund, AND 40 HIGHWAY and authorizing certain related actions. City Clerk Sheryl Morgan REDEVELOPMENT made the first reading of Bill No. 5150 by title; copies of the proposed AREA TAX INCREMENT Bill having previously been made available to the public. FINANCING TERMINATION Councilmember Fowler moved to approve Bill No. 5150 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Kaylor and carried unanimously. 2ND READING - BILL Ms. Morgan made the second reading of Bill No. 5150 by title. NO. 5150 Councilmember Edmondson moved to adopt Bill No. 5150 upon its second reading and give it ORDINANCE NO. 5272, with a copy attached hereto and made a part of the minutes. City Clerk Sheryl Morgan made the first reading of PROVIDER FEES Bill No. 5151 by title; copies of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 5151 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Ericson and carried unanimously. 2ND READING - BILL Ms. Morgan made the second reading of Bill No. 5151 by title. NO. 5151 Councilmember Edmondson moved to adopt Bill No. 5151 upon its second reading and give it ORDINANCE NO. 5273, with a copy attached hereto and made a part of the minutes. City Clerk Sheryl Morgan made the first reading of Bill No. 5152 COUNCIL WATERSHED by title; copies of the proposed Bill having previously been made FEASIBILITY STUDY- available to the public. PHASE TWO Councilmember Fowler moved to approve Bill No. 5152 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Ericson and carried unanimously. 2ND READING - BILL Ms. Morgan made the second reading of Bill No. 5152 by title. NO. 5152 Councilmember Edmondson moved to adopt Bill No. 5152 upon its second reading and give it ORDINANCE NO. 5274, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilmember Ericson and carried with the following vote: Edmondson - Aye Lievsay - Aye Culpepper - Aye Fowler-Aye Kaylor-Aye Ericson - Aye Mayor Ross - Aye PRESENTATION- Jason Morado, Vice President and Director of Community Research BUSINESS SURVEY for ETC Institute, presented the results of the 2023 Business Community Survey and addressed questions from Council. A copy of the Presentation is attached to these Minutes and incorporated herein. DISCUSSION - Councilmember Culpepper led a discussion on backyard chickens BACKYARD CHICKENS relating to the pending initiative petition process and the previous November 6, 2023 City Council Minutes Page 4 direction from Council for staff to research neighboring communities' policies regarding chickens. Councilmember Culpepper moved to direct the City Administrator to discontinue research and drafting of a Bill for Council consideration amending the Code related to backyard chickens until further direction from the Council is provided. Motion seconded by Councilmember Kaylor and carried with a vote of 5-2 as follows: Culpepper - Aye Fowler-Aye Kaylor-Aye Ericson - Aye Lievsay- No Edmondson - No Mayor Ross -Aye MAYORAL Tomorrow is election day in Jackson County to consider a Use Tax for ANNOUNCEMENTS Jackson County residents. Thoughts to Ponder: "You're only as pretty as you treat people." (Unknown) At 6:42 p.m., Councilmember Kaylor moved for the Council go into closed session pursuant to Section 610.021 (2) Revised Statutes of Missouri, for the purpose of privileged communications between a governmental body or its representative and legal counsel relating to Kaylor and that any minutes, documents and other records discussed or taken during the closed session remain closed, and that the special meeting of this body stand adjourned at the completion of such session.
