(Draft Time Line PLAN UPDATE made a part of these minutes) Last week the City Council approved the contract with Gould Evans and their associates. Staff will start meeting with Gould Evans to start looking at their “Public Engagement Plan.” We are looking at formalizing the Steering Committee by the end of the month with a launch in March. Staff is looking to present a draft plan to the Planning Commission in August for review and a final plan in October. Technically the plan doesn’t have to be approved by City Council but we at least want to keep them up to date on the process. Staff is looking at updating not only the Comprehensive Plan but the Unified Development Code as well. There are plenty of opportunities for the Planning Commissioners to be involved. In May of this year we will be looking at conducting a Smart Growth America – Sustainable Land Use Code Audit workshop. What ideas we get out of that workshop we may use in the UDC. OTHER BUSINESS 2013 NATIONAL The 2013 National Planning Conference is scheduled for April 13-17, 2013. PLANNING The conference will be held in Chicago. Project Site (Aerial Photo) Page 2 of 6 Project: Aspen Pet Cremations Plan Case Number: CUP-1-13-3800 BACKGROUND INFORMATION/SUMMARY: Aspen Pet Cremations is proposing to operate a pet crematory at 2434 NW Duncan Road, near the southeast corner of NW Duncan Road and NW Woods Chapel Road. Section 405.010 of the UDC states that a Conditional Use Permit is required for a “cemetery” use as defined in Section 411.010. Currently the property where the proposed pet crematorium is to be located is non- conforming. The parking configuration, parking lot, and landscaping do not meet the current development standards. The applicant is proposing to change the use in over 25% of the floor area of the building. In accordance with Section 409.050, Other Non- Conformities, the applicant is required to provide site upgrades in order to bring the site closer to compliance with today’s standards. PREVIOUS ACTIONS/APPROVALS: No previous actions have been taken on the property. FUTURE APPLICATIONS/REVIEWS ANTICIPATED OR REQUIRED: The applicant is considering applying for an Alternative Sign Plan in order to allow a monument sign to be mounted closer to the property line than the required ten (10) feet setback. CONDITIONAL USE PERMIT Project Description: The applicant is proposing a change of use from vacant to a “cemetery” use for a pet crematory. The applicant will update the site to meet the current Unified Development Code standards with Alternative Compliance Landscape Plan. Land Use: A “cemetery” land use is defined in the Unified Development Code as “Land used or intended to be used for burial or cremation of the dead, whether human or animal, including a mausoleum or columbarium,” and requires a conditional use permit for zoning districts in which this use is allowed. Section 405.020.D D. Cemeteries provides the following standards for cemeteries, crematories and mausoleums. Page 3 of 6 Project: Aspen Pet Cremations Plan Case Number: CUP-1-13-3800 1. Entrances. All cemeteries, crematories and mausoleums shall provide entrances on an arterial or collector street with ingress and egress so designed as to minimize traffic congestion. The proposed use includes a dual driveway accessing NW Duncan Road, which is classified as a major collector street. 2. Landscape buffer. A landscape buffer shall be provided along all property lines abutting any SF-7 or less intensive district. Such buffers shall meet the standards of Section 407.040. The property is not adjacent to SF-7 or less intensive, but is required by the standards of section 407.040 to provide a buffer on the North and West side of the property. Landscaping: The applicant is applying for an Alternative Compliance Landscape Plan. The site would require one hundred and ninety seven (197) plant units total. The north buffer would require approximately forty five (45) plant units and the west buffer would require approximately one hundred and four (104) plan units. The buffer sizes are over 10% of the total site size, which exceeds the limit set by section 407.040.F.6. in the Unified Development Code. The developer is still required to add plant material within remaining buffers or elsewhere on the site. There are twenty four (24) plant units required for the parking lot landscaping and two hundred and twenty (220) square feet of landscaping area required in the parking lot landscaping. Forty-six (46) plan units are required for the open space landscaping. The applicant estimates the total parking required for the proposed use to be six (6) off-street parking spaces. The applicant is proposing twelve (12) parking spaces provided, including a van ADA Accessible parking space. Four of the parking spaces, including the van ADA Accessible parking space, would be accessed directly from NW Duncan Road as currently exists. Four (4) of the other spaces would be parallel parking spaces on the East side of the site and four (4) of the parking spaces would be perpendicular to Duncan on the Northeast side of the building. Access: The access is designed to be a dual driveway. The drive would enter and exit onto NW Duncan Road. There is also existing parking that would continue to enter and exit directly onto Duncan Road. The Unified Development Code restricts driveways to be thirty (30) feet in width, except those dual driveways approved by the City Engineer. The applicant will repave areas in the parking lot and drive that need repair. There is currently no intent to curb the East side of the property’s parking lot. Section 407.010.k.4 states that curbing shall be provided for parking areas and access drives. As such the east side of the parking lot shall be curbed to the end of the parking area prior to issuance of an occupancy permit, or alternatively the applicant may request a variance to Section 407.010.K.4 and, if granted, may be issued building/occupancy permit without construction of the east curb. Screening: The applicant is not planning on using an outdoor dumpster or trash receptacle. In consideration of a Conditional Use Permit request, the Conditional Use Permit Review Criteria and Findings of Fact of Section 403.060.F of the UDC shall apply. Review for compliance with these standards shall be conducted in accordance with the Conditional Use Permit Procedures of UDC Section 404.060. Review Criteria And Findings Of Fact. In reviewing any application for a Conditional Use Permit, the Planning Commission shall identify and evaluate all factors relevant to the application. All findings of fact shall be made a part of the public records of the meetings of the Planning Commission. The criteria to be considered by the Planning Commission shall include, but not be limited to, the following: 1. If the proposed conditional use complies with all applicable provisions of this Development Code and will conform to the general intent and purpose of this Development Code; 2. If the proposed conditional use at the specified location will contribute to and promote the welfare or convenience of the public; Page 5 of 6 Project: Aspen Pet Cremations Plan Case Number: CUP-1-13-3800 3. If the proposed conditional use will not cause substantial injury to the value of other property in the neighborhood in which it is to be located; 4. If the location and size of the conditional use, the nature and intensity of the operation involved in or conducted in connection with it, and the location of the site with respect to streets giving access to it are such that the conditional use will not dominate the immediate neighborhood so as to prevent development and use of neighboring property in accordance with the applicable zoning district regulations. In determining whether the conditional use will dominate the immediate neighborhood, consideration shall be given to: a. The location, nature and height of buildings, structures, walls and fences on the site; and b. The nature and extent of proposed landscaping and buffering on the site. 5. If adequate utility, drainage, and other such necessary facilities have been or will be provided; and 6. If adequate access roads or entrance and exit drives will be provided and shall be so designed to prevent traffic hazards and to minimize traffic congestion in public streets and alleys. STAFF RECOMMENDATION: Staff recommends approval of the conditional use permit application subject to the following condition: 1. The east side of the parking lot and eastern most access drive shall be curbed to the end of the parking area prior to issuance of an occupancy permit, or alternatively the applicant may request a variance to Section 407.010.K.4 and, if granted, may be issued building/occupancy permit without construction of the east curb.
