PROCEEDINGS OF THE CITY COUNCIL OF BOSSIER CITY STATE OF LOUISIANA TAKEN AT A REGULAR MEETING AUGUST 1, 2023 The City Council of the City of Bossier City, State of Louisiana, met in Regular session in Council Chambers, 620 Benton Road, Bossier City, Louisiana, August 1, 2023 at 3:00 PM Invocation was given by Council Member Jeff Darby. Mayor Chandler presented Proclamation to LSU Championship Baseball Team catcher and Bossier City Resident – Hayden Travinski. (First Reading) (Chandler) Reason for add on - Mayor Chandler requests adding this item to the agenda following receipt of Ordinance and election timeline. Audience members Wes Marriott and David Crockett spoke in favor of Council adding this item to the agenda and explained why. Mr. Montgomery asked Mr. Jacobs his opinion on moving forward. Mr. Jacobs reported that his opinion is to wait until outside legal counsel provides her opinion which Ms. Bell has told him it should be in office sometime Friday. No further comment Vote in favor of motion is unanimous Unfinished Business – The following Ordinance offered and adopted: Ordinance No. 76 Of 2023  AN ORDINANCE APPROPRIATING $200,000 IN FUNDS FROM THE 2018 LCDA BOND FUND TO SUPPLEMENT THE $500,000 APPROPRIATED IN THE 2023 PUBLIC UTILITIES CAPITAL BUDGET FOR MISCELLANEOUS WATER LOOPS NECESSARY FOR IMPROVING WATER FLOW FOR FIRE PROTECTION __________________________________________________________________________ WHEREAS the Public Utilities Department appropriated $500,000 in the 2023 Capital Budget for miscellaneous water loops necessary for improving fire flow for fire protection; and WHEREAS the final construction cost estimate for the base bid item (East Texas Ave./Macey Lane) is $659,247.00; and WHEREAS there are funds available to supplement the difference between the budgeted amount and final construction cost estimate in the 2018 LCDA Bond Fund; and WHEREAS the supplementing funds will be reimbursed with excess Water Operating Fund revenue as it becomes available; and WHEREAS these funds will be used for the miscellaneous water loop project. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Bossier City, Louisiana, in regular session convened that $200,000 is hereby appropriated from the 2018 LCDA Bond Fund to provide the required supplemental funds for the miscellaneous water loop project. BE IT FURTHER ORDAINED, that the matching funds appropriated from the 2018 LCDA Bond Fund will be reimbursed by the Water Operating Fund as excess revenue becomes available. BE IT FURTHER ORDAINED, that the Mayor is authorized to sign any and all documents in connection with the furtherance of this Ordinance. AYES: Mr. Montgomery, Jr., Mr. Smith, Mr. Hammons, Mr. Darby, Mr. Williams, Mr. Free and Mr. Maggio NAYS: none ABSENT: none ABSTAIN: none _____________________________ _____________________________ Jeff Free, President Phyllis McGraw, City Clerk The following Ordinance offered and adopted: Ordinance No. 77 Of 2023 AN ORDINANCE TO APPROPRIATE THE SUM OF TWO MILLION DOLLARS ($2,000,000.00) FROM THE SALES TAX CAPITAL FUND FOR THE PURCHASE OF 2 NEW PUMPER FIRE TRUCKS FOR THE BOSSIER CITY FIRE DEPARTMENT. ______________________________________________________________________________ WHEREAS, the Bossier City Fire Department, in order to protect the health, safety and welfare of its citizens, is in need of two (2) “pumper” fire-trucks; and WHEREAS, it is customary for the Fire Department to order one such vehicle per year in order to maintain modernization and reliability standards of its current fleet; and WHEREAS, there continues to exist significant delays in the manufacturing process in addition to the ever increasing expense and cost of said type of vehicles; and WHEREAS, it is necessary to order and purchase two such vehicles and appropriate funds by execution of an immediate purchase order to ensure the availability of said vehicles and control the costs therefore; NOW, THEREFORE BE IT ORDAINED that the City Council of Bossier City, Louisiana, in regular session convened hereby authorizes the immediate purchase of two (2) “pumper” fire trucks of a make, model, and capability to be determined by the Fire Chief of the Bossier City Fire Department in the amount not to exceed two million dollars ($2,000,000.00). BE IT FURTHER ORDAINED that the 2023 Sales Tax Capital budget is hereby amended to increase expenditures for fire trucks by two million dollars ($2,000,000.00) and decrease Fund Balance by two million dollars ($2,000,000.00). AYES: Mr. Montgomery, Jr., Mr. Smith, Mr. Hammons, Mr. Darby, Mr. Williams, Mr. Free and Mr. Maggio NAYS: none ABSENT: none ABSTAIN: none _____________________________ _____________________________ Jeff Free, President Phyllis McGraw, City Clerk The following Ordinance offered and adopted: Ordinance No. 78 Of 2023 AN ORDINANCE TO SELL ADJUDICATED PROPERTY WHEREAS, the City of Bossier City is the owner of numerous properties adjudicated to the City by operation of law due to delinquent ad valorem property taxes; and WHEREAS, the City of Bossier City is responsible for the care and maintenance of said properties causing significant expense and the use of considerable City resources; and WHEREAS, the City of Bossier City would benefit in terms of resources and reduction of expense if said properties were sold to third parties and returning said properties in commerce by the sale to private parties and/or private business entities; and WHEREAS, L.R.S. 47:2201 allows the City to sell at public sale said properties pursuant to proper notice and advertisement; NOW, THEREFORE, BE IT ORDAINED, by the City Council of Bossier City, Louisiana, in regular session convened, that the City of Bossier City shall sell, at its sole discretion, any adjudicated property which it purportedly owns without warranty and/or warranty of merchantability of title in “as-is condition” at public sale for the minimum amount allowed by law as set by L.R.S. 47:2202 (A) which allows for said sale for the total amount of statutory impositions, any existing governmental liens, and the cost of sale. Said public sale shall take the form of either live auction or sealed bid; the form of said public sale shall be in the discretion of the City Attorney of Bossier City after proper notice and publication as required by L.R.S. 47:2206. NOW, THEREFORE, BE IT FUTHER ORDAINED, by the City Council of Bossier City, Louisiana, in regular session convened, that the City Attorney shall be given plenary authority to develop any rules, regulations and/or administrative procedures necessary to implement any such sale of said adjudicated property in order to promote efficient procedure of any such sale. WHEREAS, the Public Utilities Department responded to an emergency sewer main collapse on Bardot Lane requiring immediate action to restore the gravity sewer collection system; and WHEREAS, the Public Utilities Department needs emergency support to make the repair due to the size, scale, depth, and repair location; and WHEREAS, the total anticipated cost of the repair is estimated at $600,000.00 in labor, equipment, and material to complete the repair efforts; and WHEREAS, $600,000.00 shall be appropriated from the Sewer Capital Contingency Fund. NOW, THEREFORE, BE IT RESOLVED, in regular session convened that the City Council of Bossier City, Louisiana, does hereby declare that an emergency exists and authorizes the Mayor to appropriate $600,000.00 to come from the Sewer Capital and Contingency fund to be used for the purpose of making repairs to restore the sewer collection system on Bardot Lane; and authorizes the City to enter into any necessary contracts for completion of the work. BE IT FURTHER ORDAINED, that the Mayor is authorized to sign any and all documents in connection with the furtherance of this Ordinance. BE IT FURTHER ORDAINED, that the 2023 Sewer Capital and Contingency Budget is hereby amended to increase expenditures for required repairs by $600,000.00 and decrease Fund Balance by $600,000.00. Mr. Hammons asked about litigation or insurance reimbursement for these repairs. Mr. Jacobs reported on accident and investigation and that no reimbursement would be forthcoming. The following Ordinance offered and adopted: Ordinance No. 83 Of 2023 AN ORDINANCE DECLARING THAT AN EMERGENCY DOES EXIST IN THE CITY OF BOSSIER CITY AFFECTING PROPERTY, PUBLIC HEALTH, AND SAFETY DUE TO THE NEED TO REPLACE THE COMMUNICATION TOWER AT FIRE STATION #4 AT A COST OF ONE HUNDRED FIVE THOUSAND AND NO/100 ($105,000.00) TO COME FROM THE 2023 EMS CAPITAL AND CONTINGENCY FUND. WHEREAS, the communication tower serving south Bossier City located at Fire Station #4 was destroyed due to an automobile collision; and WHEREAS, said communication tower is necessary to protect the health, safety and welfare of the citizens of Bossier City in event of a fire and/or medical emergency; and WHEREAS, said tower needs to be immediately replaced and the driver of the offending vehicle is deceased as a result of the collision with said tower and possessed no liability insurance; and WHEREAS, the cost of replacement of said tower and surrounding fencing is in the amount of ONE HUNDRED FIVE THOUSAND AND NO/100 ($105,000.00); NOW, THEREFORE, BE IT ORDAINED, by the City Council of Bossier City, Louisiana, in regular session convened, that an emergency exists in the City of Bossier City affecting property, public health, and safety due to the need to replace the communication tower at Fire Station #4; BE IT FURTHER ORDAINED, that ONE HUNDRED FIVE THOUSAND AND NO/100 ($105,000.00) be appropriated from the 2023 EMS Capital and Contingency Fund to replace the communication tower at Fire Station #4. BE IT FURTHER ORDAINED, that the 2023 Emergency Medical Services Capital Projects budget is hereby amended to increase expenditures to replace the communication tower at Fire Station #4 by $105,000.00 and decrease fund balance by $105,000.00. Seconded by: Mr. Smith Mr. Hammons asked about need for increase and future cost increases. Mr. Rauschenbach reported that this is needed due to increases in costs in chemicals, power and lab work. Due to hot weather have been selling more water as well. Seconded by: Mr. Maggio Mr. Darby asked about need for new gates. Mr. Nottingham reported on request and concerns from Ms. Bonnevier and why new gates are needed. No further comment Vote in favor of motion is unanimous Agenda Item called - Adopt a Resolution authorizing Mayor Thomas H. Chandler to execute the attached Intergovernmental Cooperative Endeavor Agreement between the City of Bossier City and the Bossier Parish Police Jury for the reimbursement of costs associated with debris removal. Mr. Darby asked Mayor Chandler for update on debris removal and what do citizens need to know about requirements. Mayor Chandler had Mr. Rich report on removal. Mr. Rich reported that city on second round of removal but some areas are more challenging. He reported that vegetative storm debris will be picked up but citizens need to try to keep between sidewalk and curb or in an area city could reach from street. He reported that citizens need to call for Live Oak to pick up anything else. Further discussion from Council members and Mr. Rich on issues City is facing due to storms and how they are combatting tall grass until they can get back on schedule of grass cutting. Mr. Smith asked Mr. Rich to thank his crew on behalf of the City Council for all they have done. Audience members David Johnson and Debra Ross thanked Mr. Rich and his crew for their hard work. Ms. Ross also brought up issues she would like to see City to address. City will look into it. Mr. Darby thanked Mr. Rich for having his crew in Barksdale Annex on day 1 for debris cleanup. The following Resolution offered and adopted: Resolution No. 65 of 2023 A RESOLUTION AUTHORIZING MAYOR THOMAS H. CHANDLER TO EXECUTE THE ATTACHED INTERGOVERNMENTAL COOPERATIVE ENDEAVOR AGREEMENT BETWEEN THE CITY OF BOSSIER CITY AND BOSSIER PARISH POLICE JURY FOR THE REIMBURSEMENT OF COSTS ASSOCIATED WITH DEBRIS REMOVAL. ______________________________________________________________________________ WHEREAS, the City of Bossier City and the Bossier Parish Police Jury are political subdivisions of the State of Louisiana; and WHEREAS, Article VII, Section 14(C) of the Constitution of the State of Louisiana provides that For a public purpose, the state and its political subdivisions or political corporations may engage in cooperative endeavors with each other, with the United States or its agencies, or with any public or private association, corporation, or individual; and WHEREAS, a catastrophic storm on June 16, 2023 caused widespread damage to vegetation resulting in large quantities of debris; and WHEREAS, the Bossier Parish Police Jury will accept vegetative storm debris from the City at its designated locations; and  WHEREAS, the Bossier Parish Police Jury has entered into an agreement with the Governor’s Office of Homeland Security and Emergency Preparedness which encompasses the City of Bossier City; and WHEREAS, the Parish will seek reimbursement from the Governor’s Office of Homeland Security and Emergency Preparedness for 75% of the costs for all debris removal on behalf of the City of Bossier City; and WHEREAS, the Parish will reimburse the City of Bossier City for all costs associated with debris removal that are approved by GOHSEP. NOW, THEREFORE, BE IT ORDAINED, by the City Council of Bossier City, Louisiana, in regular session convened, that the Bossier City Council does hereby authorize Mayor Thomas H. Chandler to execute the attached Cooperative Endeavor Agreement between the City of Bossier City and the Bossier Parish Police Jury for the reimbursement of associated costs of debris removal approved by the Governor’s Office of Homeland Security and Emergency Preparedness. Mr. Rauschenbach reported that during the recent Sanitary Sewer Survey from Louisiana Department of Health, the city had zero findings. He noted that this survey is done twice per year and in all his years of working with a lot of cities, this is first time he has ever seen a report with zero findings. Great accomplishment to have zero blemish on water treatment and production. He thanked his staff for all their hard work and noted that they deserve the credit. Council members thanked Mr. Rauschenbach for his departments hard work. Further discussion on this issue.
