CONSENT AGENDA The purpose of the consent agenda is to expedite business by grouping non-controversial items together to be dealt with by one Commission motion without discussion. Any member of the Commission, staff, or the public may ask that any item(s) on the consent agenda be removed and placed as the last item under new business to receive full discussion. Such requests will be automatically respected. A. City Commission Minutes Approve the September 12, 2023 regular meeting minutes as presented B. Compensation Commission Appointments Confirm Mayor Conklin’s reappointment of Cindy Banner and George Ellwanger for terms expiring September 30, 2028. C. Police Department Drone Purchase Approve the Police Department request to purchase an Avata Drone from Unmanned Vehicle Technologies (UVT) for an amount no-to-exceed $1,691.93 and authorize the City Manager to submit necessary documents. D. ATT Metro Act Right of Way Permit Extension Approve the ATT Metro Act Right of Way Permit Extension request for a five year extension as presented and authorize the City Manager to submit the necessary documents. E. Tub Grinder Rental Recommendation Approve the recommendation from Director of DPW and Utilities Doug Varney to award a purchase order contract to Bedrock Express Ltd of Ortonville, MI for Tub Grinder Rental and Chip Removal in an amount not-to-exceed $30,000 and authorize the City Manager to execute the necessary documents. F. Grant Request for Completion of Pavilion at Peninsula Beach Approve the recommendation from City Manager Michael Cain to authorize staff to collaborate with the Boyne City Rotary Club and submit a grant request to the Charlevoix County Community Foundation in the amount of $2,500. 5. Pearl Street Historic District Study Committee Update Consider the recommendation from Planning Director Scott McPherson to approve the recommendation from the Pearl Street Historic District Dissolution Committee to no longer pursue the dissolution of the District as per the process established per MCL399.214 and take all necessary steps to repeal the Pearl Street Historic District Ordinance and disband the Historic District Commission. 10. NEW BUSINESS A. Wilson Township 425 Agreement Consider the recommendation from City Manager Michael Cain to authorize the City Manager working with Rhonda Stowers of Plunkett Cooney and representatives of Wilson Township to develop a draft 425 agreement for further review and consideration by the governing bodies of both the City of Boyne City and Wilson Township. B. Waterfront Road Ends Consider the recommendation from City Manager Michael Cain to determine desired next steps, including which if any properties to be surveyed or reflagged and whether letters to or other actions are desired. C. Master Plan Update Requests for Proposals Consider the recommendation from Planning Director Scott McPherson to approve the Planning Department to seek RFP’s from qualified planning consultants for the development of a master plan update. D. Portable Tow-Behind Air Compressor Purchase Consider the recommendation from Director of DPW and Utilities Doug Varney to award a purchase order contract to Carleton Equipment of Saginaw, MI for the purchase of a Doosan P 185 Air Compressor with 100 feet Hose Reel in an amount not-to-exceed $27,978 per the proposal dated 9/15/2023 and authorize the City Manager to execute the necessary documents. E. Water Main Valve Replacement at Mae Lane Consider the recommendation from Director of DPW and Utilities Doug Varney to award a purchase order contract to Manthei Construction for repairs to the water main valve located on Mae Lane on a Time and Material basis with the understanding that the amount is not-to-exceed $11,070 per the bid dated 9/8/2023 and to authorize the City Manager to execute the necessary documents. F. Legal Services Discussion of Requests for Qualifications and City Commission Review and Approval Processes G. Commission Discussion for October 24th Meeting Time H. Closed Session Requests 1. Consider the request from City Manager Michael Cain to go into closed session for the purpose of attorney client privilege discussion pursuant to Section 8(h) of the Open Meetings Act (MCL 15.268(1)(h)) to discuss material protected by the attorney client privilege, which is exempt from disclosure under the Freedom of Information Act (MCL 15.243(1)(g)). 2. Consider the request from City Manager Michael Cain to go into closed session for a periodic personnel evaluation of a public officer as provided in MCL 15.268 (a) of the Michigan Open Meetings Act (PA 267 of 1976). 11.
