Braintree Board of Health Meeting Held Via Zoom Thursday, June 10, 2021, 7:00 p.m. IN ATTENDANCE: Dr. Arthur Bregoli, Chairman Dr. Philip Nedelman, Vice Chairman Juliana Melchionda, Member ALSO PRESENT: Marybeth McGrath, Director of ML & I Dr. Bregoli called the meeting to order at 7:10 p.m. by roll call vote: Dr. Bregoli-yes; Dr. Nedelman-yes; Ms. Melchionda-yes Approval of Meeting Minutes: May 13, 2021 The vote was tabled as the minutes were not yet available. List of Complaints: The Board reviewed a list of complaints received from May 10-June 4, 2021. New Business: Request for Variance of Lifeguard Provision, Jonathan’s Landing Condominium, 400 John Mahar Highway Dr. Bregoli stated that they have approved this request in the past. They are requesting that no lifeguard be on duty during low bather hours in the morning from 8:30 to noon. A lifeguard will be on duty from 12:00 to 8:00 p.m. seven days a week. Motion By: Dr. Nedelman to approve the request for variance of lifeguard provision, Jonathan’s Landing Condominium, 400 John Mahar Hwy. Second By: Ms. Melchionda Unanimously Voted by roll call: Dr. Bregoli-yes; Dr. Nedelman-yes; Ms. Melchionda-yes Request for Keeping of Animals Permit Sebastian Salazar, 8 Arnold Street (12 chickens) Sebastian Salazar was present before the Board via Zoom. Dr. Bregoli asked if there are any direct abutters and the resident indicated no. There is a second tenant who is in favor of this request. They will be composting the waste and the Braintree Board of Health, June 10, 2021 Page 2 of 2 chickens will not be roaming the property. They already have the chickens but were unaware that they required a permit. Ms. Melchionda asked if there are any roosters and the applicant indicated they no longer have a rooster. Ms. McGrath stated the applicant did have a rooster but it has been removed as they are not allowed. They keep the property tidy and the coop is very nice. Ms. McGrath expressed concern that the coop is alongside the Monatiquot River, which is part of this property so it should be moved 10 feet from the river. Dr. Nedelman expressed concern that the Board usually grants permits to property owners, not tenants. Ms. McGrath stated she has spoken to the property owner who is in agreement to allow the tenants to keep the chickens. Dr. Nedelman stated he would like to see that in writing. The applicant produced a letter from the property owner and will provide a copy for the record. Motion By: Ms. Melchionda to approve the request for up to 12 chickens, conditionally, pending letter of approval by property owner and moving the coop 10 feet from river/property line, 8 Arnold Street Second By: Dr. Nedelman Unanimously Voted by roll call: Dr. Bregoli-yes; Dr. Nedelman-yes; Ms. Melchionda-yes Informational: Ms. McGrath stated she is going to send out a schedule of proposed meeting dates and asked members to let her know if the dates work with their schedules. Ms. McGrath stated the COVID-19 numbers are very good, mainly staying at zero. All state restrictions have now been lifted. She is hoping this trend continues. Ms. McGrath stated the testing of the beaches will begin on June 22. Norfolk County Mosquito Control has begun Thursday evening ground applications. Ms. Melchionda asked if the next meeting will be in person or continue to be on Zoom. Ms. McGrath stated the Governor has put forth a request to the legislature to continue to allow Zoom meetings, but it has not yet been approved.
