Village Board of Trustees Regular Meeting July 25, 2018 8:00 p.m. The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor at the William J. Vescio Community Center, at 1 Library Road, Briarcliff Manor, New York on the 25th of July, 2018 commencing at 8:00 p.m. Present Cesare DeRose, Jr. Deputy Mayor/Acting Mayor Kevin Hunt, Trustee Mark L. Wilson, Trustee Bryan Zirman, Trustee Also Present Philip Zegarelli, Village Manager Christine Dennett, Village Clerk Daniel Pozin, Village Attorney David Turiano, Village Engineer Absent Lori A. Sullivan, Mayor Pledge of Allegiance Public Hearing to Amend Chapter 207 of the Code of the Village of Briarcliff Manor Relative to Parking Limits on Portions of Pleasantville Road and Municipal Lots Acting Mayor DeRose opened the Public Hearing. There were no public comments. Upon motion by Trustee Wilson, seconded by Trustee Zirman, the Board voted unanimously to close the Public Hearing. Upon motion by Trustee Hunt, seconded by Trustee Zirman, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the proposed Local Law to amend Chapter 207 of the Code of the Village of Briarcliff Manor relative to parking limits on portions of Pleasantville Road and in Municipal Lots is hereby adopted. Board of Trustees Announcements by Trustee Zirman 1 Village Attorney Pozin stated the resolution for a positive declaration for the B Zone (item four) would be taken off the agenda. He stated the Board felt there were other avenues to explore and needed additional time to consider them and the item would be tabled to a date uncertain.  Please visit the Village Website and sign up for the weekly Village Manager’s Report to stay informed.  The Library has many upcoming events. Visit the website for more information.  The 2018 pool/tennis season is underway. Get your passes!  The Spring/Summer Brochure is online.  Many specialty camps are being offered.  The Chamber of Commerce sponsored concert will be decided tomorrow morning. All residents should come out and enjoy and carry the momentum into next year. Village Managers Report by Village Manager Zegarelli  The Safe Routes to School project is nearly completed. The signal was installed on Pleasantville Road and Ingham Road.  The new playground is open with temporary fencing.  The Law Park Pond Dredging Project will be done in the Fall.  The 9A/North State Road ribbon cutting was held on July 22nd.  Pleasantville Road striping has begun.  The Pocantico River Bridge work is delayed and will be done next year.  Three trees fell in Law Park during a recent storm. Public Comments Mr. David Steinmetz stated he represented three of the properties in the BZone and he was hopeful the Board would move forward with the scoping session. He stated they fully understood the Board’s desire to be cautious but his clients had property rights. He stated the scoping sessions allowed for public input and he requested the Board moved forward with adopting the Positive Declaration. Mr. Dan Zucchi of 161 Locust Road requested the BZone item be removed from the agenda permanently and stated that he would be submitting a letter from a group of residents outlining their concerns. He requested the Board have the developers submit proposals instead of creating new laws and to reopen the 17/20 district negotiations. Appointment of Police Officer Upon motion by Trustee Hunt, seconded by Trustee Wilson, the Board voted unanimously to approve the following resolution: 2 BE IT RESOLVED that Cody Wilkinson of Poughkeepsie, New York is hereby appointed, effective August 10, 2018, to the position of Police Officer Grade 5 to be paid at an annual salary of $73,839.21 as per the Village of Briarcliff Manor PBA Collective Bargaining Agreement salary scale effective June 1, 2018. Budget Amendment Upon motion by Trustee Zirman, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the budget for fiscal year 2018-2019 is hereby amended as follows: GENERAL FUND Increase Revenue: A0101.2666 Sale of Equipment $59,045 Increase Expense: A1990.499 Contingency $59,045 WATER FUND Increase Revenue: F0101.2666 Sale of Equipment $3,000 Increase Expense: F1990.499 Contingency $3,000 Resolution Adopting Positive Declaration, Intent to Prepare Generic Environmental Impact Statement, and Scoping Session The resolution was tabled. Authorize the Village Manager to Execute an Agreement with Westchester County to Transfer Responsibility of Pleasantville Road Upon motion by Trustee Hunt, seconded by Trustee Zirman, the Board voted unanimously to approve the following resolution: WHEREAS, on June 20, 2018, the Board of Trustees authorized the Village Manager to execute an Inter-Municipal Agreement with Westchester County to transfer responsibility of Pleasantville Road to the Village of Briarcliff Manor pursuant to Section 115-b of the Highway Law (the IMA), subject to non- substantive changes deemed necessary by the Village Manager or Village Counsel; and WHEREAS, since that authorization, the IMA has been amended at the request of Village Counsel to provide for the joint inspection by the Village and County of the work performed on Pleasantville Road to ensure that such work has 3 been completed to the reasonable satisfaction of both the Village and the County prior to transfer of responsibility of Pleasantville Road to the Village. NOW THEREFORE BE IT RESOLVED that the Board of Trustees does hereby authorize the Village Manager to execute the IMA as so amended, subject to non-substantive changes deemed necessary by the Village Manager or Village Counsel. Minutes Upon motion by Trustee Zirman, seconded by Trustee Wilson, the Board voted unanimously to approve the minutes of July 11, 2018.
