Regular Meeting
April 16, 2019
7:30 p.m.
The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor,
New York was held in the Village of Briarcliff Manor at the William J. Vescio
Community Center, at 1 Library Road, Briarcliff Manor, New York on the 16th of
April, 2019 commencing at 7:30 p.m.

Continuation Public Hearing Fiscal Year 2019-2020 Tentative Budget
Village Manager Zegarelli stated the Public Hearing was opened on April 2, 2019
and no further comments were received.
Upon motion by Trustee DeRose, seconded by Deputy Mayor Chatzky, the
Board voted unanimously to approve the following resolution:
BE IT RESOLVED, that the Public Hearing for the Fiscal Year 2019-2020
Tentative Budget is hereby closed.
BE IT FURTHER RESOLVED, that a Special Meeting is hereby scheduled for
April 23, 2019 at 7:30pm to Adopt the Budget for Fiscal Year 2019-2020.
Board of Trustees Announcements by Trustee Hunt
• The Fire Department is seeking volunteers.
• The Library has many upcoming events and the Spring/Summer Brochure
is available. Visit the website for more information.
• The Library will be closed on Easter.

• The Recreation Spring/Summer Brochure is available. Camp registration
begins May 1st.
• Summer Employment applications are being accepted.
• Stay connected and sign up for weekly updates.
• Construction will begin on Pleasantville Road next week. Seek alternate
routes and put your children on the bus.
• The Board is seeking volunteers for various Boards and Committees.
Village Managers Report by Village Manager Zegarelli
• Village Manager Zegarelli gave a presentation on the 8 month FY2018-
2019 Budget.
• Signs are being installed at some of the trailheads in the Village to
encourage more use of the trail system.
• Spring cleanup and tree trimming is underway by the Department of
Public Works.
• The website update is mostly complete.
• Unpaid water bills will be levied to tax on May 8th.
• The Mobile Passport Unit will be in front of Village Hall on May 7th.
Public Comments
There were no public comments.
Rejection of Lowest Bidder for Plumbing Maintenance Services
Upon motion by Trustee Midgley, seconded by Deputy Mayor Chatzky, the Board
voted unanimously to approve the following resolution:
WHEREAS, the Village of Briarcliff Manor (“Village”) duly bid and opened bids on
December 18, 2018, for “VM 1819-6 Plumbing Maintenance Services”; and
WHEREAS, the Village Engineer has provided the Village Board with a
memorandum dated April 10, 2019, a copy of which shall be annexed to this
Resolution, detailing a deficiency and non-conformity in the low bid submitted by
Joe Lombardo Plumbing and Heating of Rockland Inc.; and
WHEREAS, the said low bidder is located in Suffern, New York and does not
meet the requirement under Section 4 of the bid specifications that the bidder be
located within 20 miles of the Village; and
WHEREAS, the Village Engineer has recommended that the Village Board reject
the bid of Joe Lombardo Plumbing and Heating of Rockland Inc.
NOW THEREFORE, BE IT

RESOLVED, the Village Board finds that the variances between the bid of Joe
Lombardo Plumbing and Heating of Rockland Inc. and the Village’s bid
specifications are material and substantial, and be it further
RESOLVED, that the Village Board rejects the bid of Joe Lombardo Plumbing
and Heating of Rockland Inc.
Authorize the Village Manager to Execute a Tri-Village Inter-Municipal
Agreement – UV Connection (AKA Eastview Water Transmission Main)
Upon motion by Deputy Mayor Chatzky, seconded by Trustee DeRose, the
Board voted unanimously to approve the following resolution:
WHEREAS, the Villages of Briarcliff Manor, Sleepy Hollow and Tarrytown (the
“Villages”) share the same connection to the Catskill Aqueduct which provides
each Village with its primary source of water supply; and
WHEREAS, in light of planned shutdowns of the Catskill Aqueduct, the Villages
wish to proceed jointly with a project to construct and thereafter utilize, maintain
and repair, a connection to the Delaware Aqueduct in order to establish an
alternate long term, adequate and potable water supply for residents of the
Villages during time periods with the Catskill Aqueduct connection is inoperable,
unavailable, and/or otherwise unusable (the “Project”); and
WHEREAS, the Villages wish to enter into an Intermunicipal Agreement (“IMA”)
providing for among other things, that Briarcliff Manor shall take the lead on
behalf of the Villages in processing the Project with each of the Villages being
responsible for their respective proportionate share of all costs and expenses of
the Project; and
NOW THEREFORE, BE IT RESOLVED, that the Village Manager is hereby
authorized to execute an Intermunicipal Agreement with the Villages of Sleepy
Hollow and Tarrytown relative to the Project in substantially the form and
substance as annexed to this Resolution, subject to non-material revisions that
the Village Manager and Village Counsel shall both deem appropriate.
BE IT FURTHER RESOLVED, that this Resolution shall take effect immediately.
Budget Amendment – UV Connection/Eastview Water Transmission Main
Upon motion by Trustee DeRose, seconded by Trustee Hunt, the Board voted
unanimously to approve the following resolution:

BE IT RESOLVED that the budget for fiscal year 2018-2019 is hereby amended
as follows:
Increase Expense H8397.201.18204 UV Delaware $1,344,686.00
Increase Revenue H0101.2770 Misc. Capital Rev. $1,344,686.00
Award of Bid - Eastview Water Transmission Main Project
Upon motion by Trustee Hunt, seconded by Trustee Midgley, the Board voted
unanimously to approve the following resolution:
WHEREAS the Village received 7 bids for Eastview Water Transmission Main
Project (VM-1819-18); and
NOW, THEREFORE, BE IT RESOLVED that the bid for Eastview Water
Transmission Main Project (VM-1819-18); is hereby awarded to ELQ Industries,
Inc. per their bid of $1,728,491.50; and
BE IT FURTHER RESOLVED that the total project cost is $2,294,686 of which
the Village’s portion is $950,000 with the remaining amount of $775,603.87 being
reimbursed from the Village of Tarrytown and $569,082.13 being reimbursed
from the Village of Sleepy Hollow and will be charged to budget code
H.8397.201.18204; and
BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and
directed to execute a contract with ELQ Industries for said project.
Authorize the Village Manager to Execute an Information Technology
Services Agreement
Upon motion by Deputy Mayor Chatzky, seconded by Trustee DeRose, the
Board voted unanimously to approve the following resolution subject to mutually
agreed upon non-material changes:
BE IT RESOLVED that the Village Manager is hereby authorized and directed to
execute an Information Technology Services Agreement with Sullivan Data
Management from April 1, 2019 through March 31, 2020 for $46,500.
Confirmation of Fire Department Election
The Board congratulated the Chiefs and thanked them for volunteering and
dedicating their time.
Upon motion by Trustee DeRose, seconded by Trustee Hunt, the Board voted
unanimously to approve the following resolution:

BE IT RESOLVED that the Board of Trustees does hereby confirm the results of
the election of the Briarcliff Manor Fire Department conducted on April 4, 2019 as
follows:

Budget Amendment – Insurance Recovery
Upon motion by Trustee Hunt, seconded by Trustee Midgley, the Board voted
unanimously to approve the following resolution:
BE IT RESOLVED that the budget for fiscal year 2018-2019 is hereby amended
as follows:
INSURANCE RECOVERY
Increase Expense A5110.420 Street Maintenance Supplies $3,875.58
Increase Revenue A0101.2680 Insurance Recovery $3,875.58

Upon motion by Trustee Midgley, seconded by Deputy Mayor Chatzky, the Board
voted unanimously to approve the minutes of April 2, 2019 Organizational
Meeting and the April 2, 2019 Regular Meeting.
Adjournment
Please sign up for the weekly Village Manager’s Report through the website,
www.briarcliffmanor.org.
There will be a Work Session at 6:30pm and Special Meeting at 7:30pm to adopt
the Budget on April 23, 2019.
Upon motion by Trustee DeRose, seconded by Trustee Hunt, the Board voted
unanimously to adjourn the meeting at 8:10pm.
