Special Meeting Board of Trustees April 23, 2019 7:30 p.m. A Special Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the William J. Vescio Community Center, 1 Library Road, Briarcliff Manor, New York on the 23rd day of April, 2018 commencing on or about 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Cesare DeRose, Jr., Trustee Edward E. Midgley, Trustee Also Present Philip Zegarelli, Village Manager Daniel Pozin, Village Attorney David Turiano, Village Engineer Edward Ritter, Village Treasurer Absent Kevin Hunt, Trustee Pledge of Allegiance Mayor Vescio thanked Officer John Raffaele for his heroic efforts and saving the life of a motorist on Route 9A. BUDGET FY 2019-2020 RESOLUTION Upon motion by Trustee Midgley seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: Vote: Trustee Midgley – Aye Trustee DeRose- Aye Deputy Mayor Chatzky – Aye Mayor Vescio – Aye Trustee Hunt– Absent A RESOLUTION ADOPTING A BUDGET FOR THE FISCAL YEAR COMMENCING JUNE 1, 2019 AND ENDING MAY 31, 2020 WHEREAS, the Board of Trustees has met at the time and place specified in the notice of public hearing on the tentative budget and heard all persons desiring to be heard thereon; now, therefore be it 1 RESOLVED, that the tentative budget as amended and revised and as hereinafter set forth is hereby adopted and that there be and is hereby appropriated for the objects and purposes specified, including the amounts set forth required for the payment of principal and interest on indebtedness, the following amounts: General Fund Water Fund Debt Service Fund Library Fund Appropriations $18,205,728 $5,574,490 $5,275,935 $713,308 Estimated Revenues $18,205,728 $5,574,490 $4,363,835 $660,139 Retirement Reserve $0 $0 $0 $0 Appropriated Fund $0 $0 $ 912,100 $53,169 Balance General Fund Budgetary Appropriation to be raised by Real Estate Tax Levy $11,304,989 Town of Ossining Town of Mt. Pleasant Taxable Assessed Value $1,862,884,209 $2,574,467 Tax Rate per $1,000 $5.53 $389.46 TOWN OF OSSINING AND TOWN OF MOUNT PLEASANT FIRE DISTRICT CONTRACTS: NYS VILLAGE LAW SECTION 209-D DISTRIBUTION Upon motion by Deputy Mayor Chatzky, seconded by Trustee DeRose, the Board voted unanimously to approve the following resolution: Vote: Trustee Midgley – Aye Trustee DeRose- Aye Deputy Mayor Chatzky – Aye Mayor Vescio – Aye Trustee Hunt– Absent Whereas, the Village of Briarcliff Manor (VBM) has historically provided fire services to and now renewed a series of Fire District Service Agreements (Fire Contracts) with the Town of Ossining (TOS) and the Town of Mount Pleasant (TMP) for 24/7 fire service.to be provided for by the VBM Fire Department (VBMFD); and 2 Whereas, the fire services to be provided by the VBMFD are within specific VBM contiguous areas of the unincorporated areas of both the TOS and the TMP; and, Whereas, NYS Village Law, Section 209-D, permits a village to distribute to its fire department up to 35% of such contract amounts to its fire department for performing such services; and Whereas, the VBMFD Chief, the VBMFD Fire Council and separate VBMFD firemanic companies together with the M/BOT by separate resolution have approved these same fire contracts; Now Therefore be it: RESOLVED, that the VBM Board of Trustees hereby authorizes and approves the distribution of 35% of the contractual amounts of the Fire Contracts to the VBMFD Fire Council, and be it further RESOLVED, that the Village Manager shall authorize the Village Treasurer to pay such amounts in a timely fashion upon receipt of good funds from the TOS and the TMP. SCHEDULE A PUBLIC HEARING: LOCAL LAW TO AMEND CHAPTER 45 ENTITLED “PLANNING BOARD” AND CHAPTER 220-17 ENTITLED “BOARD OF APPEALS” IN THE CODE OF THE VILLAGE OF BRIARCLIFF MANOR Upon motion by Trustee DeRose, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that a Public Hearing is hereby scheduled for the May 7, 2019 at 7:30pm Board of Trustees meeting to hear and discuss a proposed local law to amend Chapter 45 entitled “Planning Board” and Chapter 220-17 entitled “Board of Appeals” in the Code of the Village of Briarcliff Manor.
