Village Board of Trustees Regular Meeting December 3, 2019 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor at the William J. Vescio Community Center, at 1 Library Road, Briarcliff Manor, New York on the 3rd of December, 2019 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Cesare DeRose, Jr., Trustee Kevin Hunt, Trustee Edward E. Midgley, Trustee Also Present Philip Zegarelli, Village Manager Daniel Pozin, Village Attorney Christine Dennett, Village Clerk David Turiano, Village Engineer Pledge of Allegiance Board of Trustees Announcements  The Fire Department gave cold weather and space heater safety tips.  The Library is hosting a number of programs for all ages. Visit the website for more information.  The Community Bonfire and Sing-a-long will be on December 8th.  Platform Tennis Season is underway. Permits are required.  Law Park Ice Skating Permits are available.  Letters to Santa are due by December 16th.  Santa’s Express will be on December 15th.  The Library Board has two vacancies. Anyone interested should send a letter of interest to the Board. Village Managers Report by Village Manager Zegarelli  The Pocantico River Bridge is open.  Law Park Pond project is winterized.  A grant was filed to do a historic tree inventory and forest management plan.  Leaf Collection well underway and will continue through December.  Scarborough Station Parking Permits for 2020 are sale. 1  The Public Hearing to relocate the cell monopole at the Club and will be on the December 12 Planning Board Agenda.  The Farm Road pipe replacement project is complete.  2nd half village taxes are due by December 31.  PBA toy and coat drive through December 14.  Overnight parking restrictions are in effect until March 31.  The Staff Holiday party is this Friday at 1pm.  Black paint will be requested on the Route 100/9A Bridge. Committee Reports  The Recreation Advisory Committee has joined a hiking app mapping the Village trails and the contract to fix the drainage issues at the Club Field is being awarded.  The Beautification Committee has a meeting scheduled on December 4. Public Comments Bruce Yeager of 450 Central Drive requested clarification of the soccer field grading height. Mayor Vescio stated he would meet with Mr. Yeager to review the plans. Mrs. Norma Durkin of 169 Holbrook Road asked if the fence installed at 345 Scarborough Road was permitted and stated it was out of character with the neighborhood. Village Engineer Turiano stated they had a permit for the fence and he would do a final inspection to make sure it was in compliance. Mr. Leo Kelmar of 181 Holbrook Road asked what the dates of the moratorium are. Mayor Vescio stated the one year moratorium was enacted on June 6, 2019 and had the option of a three month extension. Traffic Study Presentation by Provident Design Engineering Mr. Brian Dempsey of Provident Design Engineering reviewed the preliminary results of the traffic conditions at six intersections and stated the formal report would be done within a month. Tax Certiorari – Deercliff Builders Inc. Upon motion by Trustee Hunt, seconded by Trustee DeRose the Board voted unanimously to approve the following resolution: 2 WHEREAS, Deercliff Builders, Inc. (1250 Pleasantville Road), instituted tax certiorari proceedings pursuant to Article 7 of the Real Property Tax Law of the State of New York; and WHEREAS, the tax certiorari filings were for Town of Ossining assessment years 2015-2018; and WHEREAS, the tax certiorari filings relate to Village of Briarcliff Manor fiscal years 2016-2017, 2017-2018, 2018-2019 and 2019-2020; and WHEREAS, an Consent Judgment of the Supreme Court of the State of New York, County of Westchester, was entered on October 22, 2019; WHEREAS, the Consent Judgment was received after the finalization of the approval of the Village budget for Fiscal Year 2019-2020; NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the refund for Fiscal Years 2016-2017 and 2017-2018 totaling $1,004.29 charged to A1964.423 based upon assessment values reduced in accordance with the Consent Judgment. Anyone interested should send a letter of interest to BOT@briarcliffmanor.org. 3 Adopt DPW Policies and Procedures – Chapter 125 Garbage and Recycling Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: FINAL POLICY NEEDED Amend Master Fee Schedule Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Board of Trustees does hereby amend the Master Fee Schedule for the Village of Briarcliff Manor as follows: Garbage 1.5 yard Dumpster 2x per week 2,500 Recycling Bulk Metal Pickup 40 Recycle Bins 20 Recycle Bags 0.50 Solid Waste Chapter 125-Private Carting Companies Hauling Removal Waste Per Dumpster/Per Year 500 Schedule Streetscape Presentation The next presentation will be on January 13, 2020 at 7:00pm. All residents, business owners and landlords are encouraged to attend. Award of RFP and Authorize Village Manager to Execute an Agreement with TriTurf Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees hereby engages TriTurf, Inc. for The Club Field Drainage Improvements project based upon their RFP response in the amount of $34,995.00, and BE IT FURTHER resolved that the Village Manger is authorized and directed to execute such documents as necessary for such engagement. Minutes 4 Upon motion by Trustee Hunt, seconded by Trustee DeRose, the Board voted unanimously to approve the minutes of November 19, 2019 as amended.
