Regular Meeting
January 21, 2020
7:30 p.m.
A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor,
New York was held in the Village of Briarcliff Manor at the William J. Vescio
Community Center, at 1 Library Road, Briarcliff Manor, New York on the 21st of
January, 2020 commencing at 7:30 p.m.

Public Hearings:
Repeal and Replace Chapter 155 Peace and Good Order with Chapter 165
Protection of Public Property
Deputy Mayor Chatzky gave a synopsis of the proposed changes.
There were no public comments. The Board stated anyone interested could
email any comments to BOT@briarcliffmanor.org.
Upon motion by Trustee DeRose, seconded by Trustee Hunt, the Board voted
unanimously to adjourn the Public Hearing to February 4, 2020 at 7:30pm.
Amend Chapter 186 Streets and Sidewalks
Deputy Mayor Chatzky gave a synopsis of the proposed changes.
There were no public comments.
Upon motion by Trustee Hunt, seconded by Trustee Midgley, the Board voted
unanimously to adjourn the Public Hearing to February 4, 2020 at 7:30pm.

Amend Chapter 220 Fences
Deputy Mayor Chatzky gave a synopsis of the proposed changes.
There were no public comments.
Upon motion by Trustee DeRose, seconded by Deputy Mayor Chatzky, the
Board voted unanimously to adjourn the Public Hearing to February 4, 2020 at
7:30pm.
Board of Trustees Announcements
The Fire Department offered safety tips for the use of lithium ion batteries.
The Library is hosting a number of programs for all ages. Visit the website
for more information.
The Recreation Winter Brochure is on the website.
Platform Tennis Season is underway. Permits are required.
Law Park Ice Skating Permits are available.
The Library Board has vacancies. Anyone interested should send a letter
of interest to the Board.
BZone work is progressing and the Board is awaiting a reports from the
consultants. A presentation will be given on February 4th.
Village Manager’s Report by Village Manager Zegarelli
A sidewalk meeting will be held soon with Westchester County.
The Pocantico River Bridge is open. The project Engineer will take a look
at the height of the wall on the Todd Lane side.
The UV Delaware Connection will be online tomorrow.
Leaf Collection is complete. Christmas Trees will be picked up until the
end of January.
2nd half village taxes were due by December 31. Penalties now apply.
The Work Session scheduled for January 28th is canceled and there will
be a Capital Work Session on February 5th. February’s Board of Trustees
Meetings will be on February 4th and 25th.
The NIXLE emergency alert system is being utilized by the Village.
Village Engineer’s Report by Village Engineer Turiano
DPW Fuel Island: Work has commenced on the new Fuel Island Tanks at DPW.
Expected completion, April 15, 2020.
Residential Street Light Replacement: Project awarded, expected March 1st
commencement.
Streetscape: Workshop on Monday, January 13, 2020. Workshop summary
expected. Next steps will be schematic drawings, work session forum.
Law Park Drainage: Meeting held today with consultant (HEC), discussed
mainline rooting. Considering taking main line piping offline, Law Park Pond –
Local Drainage Only to Pond.

Scarborough Park Shoreline Stabilization: Village received preliminary
construction drawings detailing stabilization.
Village Hall ADA: New schematic plans for the courtroom have been received
by the Engineer’s office just this morning. 30% construction documents will be
received in approximately 4 weeks.
Pool Gutter Phase I: Engineer is working on Electrical Updates in Filter Room.
The Club Field Drainage: Project is 50% completed.
Replace (2) Boilers at Law Park: plumbing, gas and heating work substantially
complete.
Hydrant Replacement Program: Expected letting month of March or 2020.
Hazmat Remediation Long Hill Rd Station
Pump Station Demolition (Dalmeny)
The Board thanked Village Engineer Turiano for all his work and a very
comprehensive report.

Public Comments
There were no public comments.
Town of Ossining and Town of Mount Pleasant Fire District Contracts: NYS
Village Law Section 209-D Distribution: Resolution to Award 35% of
Contract Amounts
Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the
Board voted unanimously to approve the following resolution:
Whereas, the Village of Briarcliff Manor (VBM) has historically provided fire
services to and now renewed a series of Fire District Service Agreements (Fire
Contracts) with the Town of Ossining (TOS) and the Town of Mount Pleasant
(TMP) for 24/7 fire service.to be provided for by the VBM Fire Department
(VBMFD); and
Whereas, the fire services to be provided by the VBMFD are within specific VBM
contiguous areas of the unincorporated areas of both the TOS and the TMP; and,
Whereas, NYS Village Law, Section 209-D, permits a village to distribute to its
fire department up to 35% of such contract amounts to its fire department for
performing such services; and
Whereas, the VBMFD Chief, the VBMFD Fire Council and separate VBMFD
firemanic companies together with the M/BOT by separate resolution have
approved these same fire contracts;

Now Therefore be it:
RESOLVED, that the VBM Board of Trustees hereby authorizes and approves
the distribution of 35% of the contractual amounts of the Fire Contracts to the
VBMFD Fire Council, and be it further
RESOLVED, that the Village Manager shall authorize the Village Treasurer to
pay such amounts in a timely fashion upon receipt of good funds from the TOS
and the TMP.

Fire Department Memberships
The Board thanked them for volunteering and stated they were a phenomenal
group of people.
Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board
voted unanimously to approve the following resolution:
BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor
hereby approves the membership of Charlotte Molinelli to the Hook and Ladder
Company.
BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor
hereby approves the under 18 membership of Aditya Sridhar to the Briarcliff
Fire Company.
BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor
hereby approves the membership of Nicholas R. Miller to the Briarcliff Fire
Company.
BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor
hereby approves the membership of Robert Contento to the Hook and Ladder
Company.
Census Committee Appointments
The Mayor appointed the following residents to the Census Committee and
thanked them for volunteering:

Schedule Public Hearings
Upon motion by Trustee Hunt, seconded by Trustee DeRose, the Board voted
unanimously to approve the following resolution:
BE IT RESOLVED that a Public Hearing is hereby scheduled for the February
4, 2020 Board of Trustees meeting at 7:30pm to hear and discuss a proposed
local law to amend Chapter 38, Village Manager of the Code of the Village of
Briarcliff Manor.
BE IT RESOLVED that a Public Hearing is hereby scheduled for the February
4, 2020 Board of Trustees meeting at 7:30pm to hear and discuss a proposed
local law to amend Chapter 54, Residency Requirements of the Code of the
Village of Briarcliff Manor.
Minutes
Upon motion by Deputy Mayor Chatzky, seconded by Trustee DeRose, the
Board voted unanimously to approve the minutes of January 7, 2020 as
amended.
Adjournment
Upon motion by Deputy Mayor Chatzky, seconded by Trustee DeRose, the
Board voted unanimously to adjourn the Regular Meeting at 8:28pm and entered
into Executive Session to discuss potential litigation and personnel matters.
