Village Board of Trustees Regular Meeting February 4, 2020 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor at the William J. Vescio Community Center, at 1 Library Road, Briarcliff Manor, New York on the 4th of February, 2020 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Cesare DeRose, Jr., Trustee Kevin Hunt, Trustee Edward E. Midgley, Trustee Also Present Philip Zegarelli, Village Manager Daniel Pozin, Village Attorney Christine Dennett, Village Clerk David Turiano, Village Engineer Pledge of Allegiance Public Hearings: Repeal and Replace Chapter 155 Peace and Good Order with Chapter 165 Protection of Public Property Deputy Mayor Chatzky gave a synopsis of the proposed changes. There were no public comments. Upon motion by Trustee Hunt, seconded by Trustee DeRose, the Board voted unanimously to close the Public Hearing. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the proposed local law to repeal and replace Chapter 155 Peace and Good Order with Chapter 165 Protection of Public Property of the Code of the Village of Briarcliff Manor is hereby adopted. Amend Chapter 186 Streets and Sidewalks Deputy Mayor Chatzky gave a synopsis of the proposed changes. 1 There were no public comments. Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to close the Public Hearing. Upon motion by Deputy Mayor Chatzky, seconded by Trustee DeRose, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that a the proposed local law to amend Chapter 186 Streets and Sidewalks, Article 4 of the Code of the Village of Briarcliff Manor is hereby adopted. Amend Chapter 220 Fences Deputy Mayor Chatzky gave a synopsis of the proposed changes. Mr. William Vescio of 144 Old Briarcliff Road stated he applauded the Board for amending the Village Code and bringing it to today’s standards but there needed to be better enforcement. Upon motion by Trustee DeRose, seconded by Trustee Hunt, the Board voted unanimously to close the Public Hearing. Upon motion by Trustee Hunt, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the proposed local law to amend Chapter 220, Attachment 1, Table 1, Fences of the Code of the Village of Briarcliff Manor is hereby adopted. Amend Chapter 38, Village Manager Deputy Mayor Chatzky gave a synopsis of the proposed changes. There were no public comments. Upon motion by Trustee Hunt, seconded by Trustee DeRose, the Board voted unanimously to adjourn the Public Hearing to February 25, 2020. Amend Chapter 54, Residency Requirements Deputy Mayor Chatzky gave a synopsis of the proposed changes. There were no public comments. 2 Upon motion by Trustee Hunt, seconded by Trustee Midgley, the Board voted unanimously to adjourn the Public Hearing to February 25, 2020. Board of Trustees Announcements  The Fire Department offered safety tips for the use of portable generators.  The Library is hosting a number of programs for all ages. Visit the website for more information.  The Recreation Winter Brochure is on the website.  Platform Tennis Season is underway. Permits are required.  The Board sent their condolences to the Waterhouse family for the loss of Larry Waterhouse, Jr.  Senator Carlucci has proposed legislation to advance the study of Route 9A to make it safer. Resident support is requested.  Happy Birthday to Phil Zegarelli on Thursday. The Board thanked him for his tireless service to the Village and stated the Village was lucky to have him. Village Manager’s Report by Village Manager Zegarelli  The Complete Count Census has met on two occasions.  The Library Board will have recommendations to fill the vacancies for the next meeting.  Bond bidding was very competitive. Thank you to Robin Rizzo for all her help.  The next Board of Trustees Meetings will be on February 25th.  The NIXLE emergency alert system is being utilized by the Village. Village Engineer’s Report by Village Engineer Turiano  DPW Fuel Island: Work has commenced on the new Fuel Island Tanks at DPW. Expected completion, April 15, 2020.  Residential Street Light Replacement: Project awarded, expected March 1st commencement.  Capital Project Work Session, February 5th in the Lodge Room at the Club of Briarcliff Manor.  Streetscape: Workshop on Monday, January 13, 2020. Workshop summary expected. Next steps will be schematic drawings, work session forum.  Law Park Drainage: Meeting held today with consultant (HEC), discussed mainline rooting. Considering taking main line piping offline, Law Park Pond – Local Drainage Only to Pond.  Scarborough Park Shoreline Stabilization: Village received preliminary construction drawings detailing stabilization.  Village Hall ADA: New schematic plans for the courtroom have been received by the Engineer’s office just this morning. 30% construction documents will be received in approximately 4 weeks.  Pool Gutter Phase I: Engineer is working on Electrical Updates in Filter Room.  The Club Field Drainage: Project is 50% completed. 3   Replace (2) Boilers at Law Park: plumbing, gas and heating work substantially complete.  Hydrant Replacement Program: Expected letting month of March or 2020.  Pump Station Demolition (Dalmeny)  Gas Station on North State Road: Out of service and looking in to it. Committee Reports  The Recreation Advisory Committee will do a presentation at the next Board of Trustees meeting.  The Beautification has a meeting scheduled on February 5 th at 7:30pm. Public Comments Mr. Roger Battacharia of 16 Holbrook Road stated Holbrook Road had a speeding issue and asked that it be addressed. Mayor Vescio stated the Police would set up the speed notification sign and patrol the area. Mr. Peter Chavkin of Biddle Real Estate Ventures stated his company was the contract vendee for 600 Albany Post Road and he was thrilled to participate in any way the Board saw fit. BZone Presentations Provident Design Engineering– Traffic Study Mr. Brian Dempsey stated they studied 6 intersections in the Village and reviewed his report. The Board had general discussion regarding possible solutions and requested the Buckhout Road intersection be studied as well. Cleary Consulting Mr. Patrick Cleary reviewed the draft report and discussed potential uses for each site. The Board had general discussion regarding the report and the next steps in the process and asked that the reports be posted on the Village website and thanked Mr. Dempsey and Mr. Cleary for their presentations. Acceptance of Donations – Friends of the Library The Board thanked the Friends of the Library for their donation. 4 Upon motion by Trustee DeRose, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees hereby accepts a donation in the amount of $1,000 from the Friends of the Library for the purchase library materials as part of the Alice Goldstein Memorial Fund. Increase Revenue – Gifts (L0108.2705) by $1,000 Increase Expenses – Special Matching Expenses (L7410.206) by $1,000 BE IT RESOLVED, that the Board of Trustees hereby accepts a donation in the amount of $565 from the Friends of the Library for the purchase of museum passes for the Intrepid Air and Space Museum and the Bruce Museum providing residents with free admission. Increase Revenue – Gifts (L0108.2705) by $565 Increase Expenses – Special Matching Expenses (L7410.206) by $565 Tax Certioraris – Briar Hill Upon motion by Trustee Hunt, seconded by Trustee DeRose, the Board voted unanimously to approve the following resolution: WHEREAS, Briar Hill Owners Corp. (207-225 Schrade Road and 300-360 North State Road), instituted tax certiorari proceedings pursuant to Article 7 of the Real Property Tax Law of the State of New York; and WHEREAS, the tax certiorari filings were for Town of Ossining assessment years 2015-2018; and WHEREAS, the tax certiorari filings relate to Village of Briarcliff Manor Fiscal Years 2016-2017, 2017-2018, 2018-2019 and 2019-2020; and WHEREAS, an Consent Judgment of the Supreme Court of the State of New York, County of Westchester, was entered on January 3, 2020; WHEREAS, the Consent Judgment was received after the finalization of the approval of the Village budget for Fiscal Year 2019-2020; NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the refund for Fiscal Years 2016-2017, 2017-2018, 2018-2019 and 5  2019-2020 totaling $17,061.90 charged to A1964.423 based upon assessment values reduced in accordance with the Consent Judgment. BE IT FURTHER RESOLVED that Susan Cabral is hereby designated as Inspector of Election and Chairperson. BE IT FURTHER RESOLVED that Joyce Perlmutter, Joyce Silverstein, and Audrey May June are hereby appointed as Alternate Inspectors of Election. BE IT FURTHER RESOLVED that the compensation for each Inspector of Election other than the Inspector designated as Chairperson is hereby fixed at Two Hundred and Twenty Five ($225) dollars per day or prorated to $14 per hour worked if necessary. BE IT FURTHER RESOLVED that the compensation for the Inspector of Election that is designated as Chairperson shall be Two Hundred Seventy-Five ($275) dollars per day. Authorize the Mayor to Execute an Agreement with the Village Manager The Board stated they were thrilled to have Phil for another 18 months and he was a major asset to the Village. Upon motion by Trustee Hunt, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: 6 BE IT RESOLVED that the Mayor is authorized to execute an agreement with Philip Zegarelli for his service from April 1, 2020 through September 30, 2021 as Village Manager, Deputy Village Clerk and Deputy Registrar; and BE IT FURTHER RESOLVED that this agreement supersedes the agreement between the Village and Village Manager Zegarelli approved by resolution adopted on May 3, 2017; and BE IT FURTHER RESOLVED that to the extent any provision of that prior agreement conflicts with any provision of this agreement, that prior agreement provision shall have no force and effect on the terms of Village Manager Zegarelli’s employment after April 1, 2020. Fire Department Membership – O’Donnell The Board thanked Mr. O’Donnell for volunteering. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Kevin O’Donnell to the Hook and Ladder Company. Minutes Upon motion by Deputy Mayor Chatzky, seconded by Trustee DeRose, the Board voted unanimously to approve the minutes of January 21, 2020. Adjournment Upon motion by Deputy Mayor Chatzky, seconded by Trustee DeRose, the Board voted unanimously to adjourn the Regular Meeting at 9:42pm.
