Village Board of Trustees Regular Meeting February 25, 2020 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor at the William J. Vescio Community Center, at 1 Library Road, Briarcliff Manor, New York on the 25th of February, 2020 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Edward E. Midgley, Trustee Also Present Philip Zegarelli, Village Manager John Murtagh, Acting Village Attorney Christine Dennett, Village Clerk David Turiano, Village Engineer Absent Cesare DeRose, Jr., Trustee Pledge of Allegiance Continued Public Hearings: Amend Chapter 38, Village Manager Deputy Mayor Chatzky gave a synopsis of the proposed changes. There were no public comments. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to close the public hearing. Amend Chapter 54, Residency Requirements Deputy Mayor Chatzky gave a synopsis of the proposed changes. There were no public comments. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to close the public hearing. 1 Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: WHEREAS the amended law is simply a restatement, or reaffirmation, of the intent of the existing law for Chapter 38, Village Manager. BE IT RESOLVED that a the proposed local law to amend Chapter 38, Village Manager of the Code of the Village of Briarcliff Manor. BE IT RESOLVED that a the proposed local law to amend Chapter 54, Residency Requirements of the Code of the Village of Briarcliff Manor. Board of Trustees Announcements  The Fire Department offered tips to keep pets safe.  The Library is hosting a number of programs for all ages. Visit the website for more information.  The Recreation Summer Brochure will be available shortly and registration will begin in March.  Platform Tennis Season is underway. Permits are required.  The plastic ban bag goes into effect March 1st.  The Town of Ossining is beginning a food scrapping program that’s open to all town residents.  Senator Carlucci has proposed legislation to advance the study of Route 9A to make it safer. Resident support is requested.  There is a call for volunteers for various Boards and Committees.  Happy Birthday to Joan Austin. She brought the erosion issue at Scarborough Park to the Board’s attention a year ago and it’s being addressed. Village Manager’s Report by Village Manager Zegarelli  The Complete Count Census Committee is up and running and working on a campaign to get more public support.  Please curb your dogs and pick up the waste. Village Engineer’s Report by Village Engineer Turiano  DPW Fuel Island: Work has commenced on the new Fuel Island Tanks at DPW. Expected completion, April 15, 2020.  Residential Street Light Replacement: The street lights were ordered.  Streetscape: Design drawings are anticipated and material selection will be next.  Law Park Drainage: Additional work is needed and a budget discussion will occur.  Scarborough Park Shoreline Stabilization: Mobilizing shortly.  Village Hall ADA: New schematic plans for the courtroom have been received by the Engineer’s office just this morning. 35% construction documents have been received. 2  Pool Gutter Phase I: Engineer is working on Electrical Updates in Filter Room.  The Club Field Drainage: Project is complete.  Replace (2) Boilers at Law Park: Work is complete.  Hydrant Replacement Program: Expected letting month of March or 2020.  Pump Station Demolition (Dalmeny)  The Club Cell Tree: Many moving parts and coordinated efforts. June target date.  The server room is being moved to the basement. Committee Reports  The Beautification is focusing on Spring plantings and a village-wide cleanup program.  Georgina Gualdino, Recreation Advisory Committee Chairperson and Henry Jamin, Superintendent of Recreation gave a presentation of upcoming projects in the Village parks and trails. The Board thanked the Committee and Henry for all their time and work put into the Village. Public Comments Mr. Steven Kavee of Ingham Road, stated he sent a letter regarding parking restrictions on Ingham Road and requested it be addressed. He also suggested pollinator pathway and rain way gardens in the Village. The Board had general discussion regarding the potential options regarding the Ingham Road concerns. Mr. Zdenek Ulman stated he was the diver in the pond dredging project and requested a meeting with the Board to discuss it. Mayor Vescio stated the Village did not have a contract with Marine Diving, the contract was with Con-Tech and if Con-Tech wanted to schedule a meeting, they could do so. Appoint Village Treasurer The Board thanked Keith Austin for his help with the search and Village Manager Zegarelli and Robin Rizzo and welcomed Katie to the Village staff. Upon motion by Trustee Hunt, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that Kathryn Nivins is hereby appointed to the position of Village Treasurer and Receiver of Taxes effective March 2, 2020 to fill the unexpired term of Robin L. Rizzo at the annual salary of $130,000. 3 Village of Briarcliff Manor v. Foremost Construction – Authorize Settlement of Litigation The Board had general discussion regarding the settlement. Upon motion by Trustee Hunt, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Village Manager and Village Counsel are authorized to execute all documents and take all actions necessary to settle pending litigation known as Foremost Development LLC v. The Village of Briarcliff Manor, Index No. 70899/2019, upon the terms presented by and discussed with Village Counsel and the Village Engineer in Executive Session. Budget Amendment – Cleary Consulting Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the budget for fiscal year 2019-2020 is hereby amended as follows: SPECIAL PROJECTS – B ZONE Increase Expense A1010.490.18209 Special Project $20,000 Cleary Consulting Increase Revenue A0599 Fund Balance $20,000 Fire Department Memberships The Board thanked them for joining the Department. Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Mayer Goldberger to the Scarborough Engine Company. BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the under 18 membership of Maxwell Gustin to the Scarborough Engine Company. 4 BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the under 18 membership of Christian Sassano to the Scarborough Engine Company. Library Board Appointments The Board thanked all that submitted resumes and thanked them for volunteering. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby appoints Stephanie Casper as a Member of the Library Board to fill the unexpired term of Jeffrey Robins which expires on December 31, 2022. BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby appoints Amanda Bromberg as a Member of the Library Board which expires on December 31, 2024. BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby appoints Jakob Hesketh as a Member of the Library Board which expires on December 31, 2024. Declaration of Surplus Vehicle Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees does hereby declare the Village owned vehicles and equipment listed below as surplus and further authorizes their sale pursuant to a public bid. 1. 1995 PIERCE Vin #4P1CT02D7SA000604 Resolution to Appoint Trustees to Administer the Village of Briarcliff Manor Service Award Program, Glens Falls National Bank and Trust Company Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: RESOLVED, that with respect to the Village of Briarcliff Manor Service Award Program, Glens Falls National Bank and Trust Company has been appointed Trustee of said plan. The following authorized parties shall serve as the Administrative Delegates of said plan and trust effective March 2, 2020. Philip E Zegarelli - Village Manager 5 Kathryn Nivins– Village Treasurer Remove Robin Rizzo effective March 2, 2020 Each Administrative Delegate, individually, may act and Glens Falls National Bank and Trust Company may rely on the written direction of either one of the above listed Administrative Delegates. Trustee Hunt – Aye Deputy Mayor Chatzky – Aye Trustee Midgley – Aye Mayor Vescio – Aye Trustee DeRose – Absent Appointment of Deputy Village Treasurer Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that Robin L. Rizzo is hereby appointed to the position of Deputy Village Treasurer, effective March 2, 2020, at the annual salary of $98,000. BE IT FURTHER RESOLVED that the term of this appointment shall end on April 7, 2020 and may be extended for a period of time determined by the Mayor and Board of Trustees. Census Committee Appointment Mayor Vescio appointed Michelle Torosian to the Census Committee. Town of Ossining Proposed Bike Lanes to N. State Road via Chappaqua Road to Route 100 Discussion The Board had general discussion and stated they would review and get further details from the Town. Minutes Upon motion by Deputy Mayor Chatzky, seconded by Trustee DeRose, the Board voted unanimously to approve the minutes of February 4, 2020 as amended.
