Village Board of Trustees Regular Meeting June 16, 2020 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held remotely via Zoom on the 16thof June, 2020 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Edward E. Midgley, Trustee Sabine K. Werner, Trustee Also Present Philip Zegarelli, Village Manager Daniel Pozin, Village Attorney Christine Dennett, Village Clerk David Turiano, Village Engineer Kathryn Nivins, Village Treasurer Pledge of Allegiance Continuation of Public Hearings Amend Chapter 220-2, Zoning Definitions Amend Chapter 220-3, Zoning Districts and Map Amend Chapter 195, Taxation Amend Chapter 220-5, Planned Office and Laboratory B District Amend Chapter 220-6, Special Permit Uses Amend the Comprehensive Plan Related to the BZone The Board opened all six hearings together. Deputy Mayor Chatzky gave a terrific synopsis of the proposed changes. Mr. Peter Chavkin of Biddle Real Estate Ventures stated they were the contract vendee for 600 Albany Post Road and looked forward to working with the Board and sharing their proposal. 1 Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to adjourn the public hearings to July 7, 2020 at 7:30pm. Public Hearings Amend Chapter 220-4 Schedule Controlling Lands and Buildings Deputy Mayor Chatzky gave a marvelous synopsis of the proposed changes. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Werner, the Board voted unanimously to adjourn the public hearing to July 7, 2020 at 7:30pm. Amend Chapter 153 Parks and Recreation Deputy Mayor Chatzky gave an excellent synopsis of the proposed changes. Upon motion by Trustee Werner, seconded by Deputy Mayor Chatzky, the Board voted unanimously to adjourn the public hearing to July 7, 2020 at 7:30pm. Renew a Special Use Permit - Briarcliff Congregational Church and Garden House School Mr. Brian Lewis, representing the Church stated there were no changes in their operation since the last approval and requested the Board approve their renewal request. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to close the public hearing. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Werner, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Special Use Permit issued to Briarcliff Congregational Church and Garden House School is hereby renewed subject to the same conditions included in the original Special Use Permit approval dated July 13, 1995 and as amended on January 4, 2007 and March 20, 2019. BE IT FURTHER RESOLVED that the Special Use Permit renewal shall be renewed July 13, 2020 and shall extend to July 12, 2025. BE IT FURTHER RESOLVED that should the Briarcliff Congregational Church and Garden House School desire to renew this Special Use Permit for another five year period, commencing in 2025, the Church/School shall be responsible for requesting the renewal at least sixty (60) days prior to the expiration of the Special Use Permit. Board of Trustees Announcements 2  The Library has many virtual programs and curbside pickup available. Visit their website for more information.  The Fire and Ambulance Departments are seeking volunteers.  Happy Birthday to Village Attorney Dan Pozin and former First Lady of Briarcliff Manor Sara Vescio.  Condolences to Brian Boyle’s family on his passing. He was a dedicated member of the Fire Department and will be greatly missed.  The Board is seeking volunteers for the Architectural Review Advisory Committee. Letters of interest should be sent to BOT@briarcliffmanor.org.  The Board thanked Village Staff for all the hard work they’ve been doing and keeping the Village fully operational. Village Manager’s Report by Village Manager Zegarelli  A follow-up meeting is being scheduled with the County after the Pleasantville Road walk through.  The Historic Hudson River Towns “HHRT” audio drive through app is up and running.  The Law Park tree plantings are nearly complete.  The Pocket Park is being redesigned and replanted.  Scarborough Park signage is being installed and will be opened thereafter.  The Village’s Census response rate is at a 77% response rate.  A plan to reopen Village Offices to the public is being worked on.  Tax Bills have been sent out and are due by July 1st.  The pool is ready for when the Governor allows it to open.  A Park and View movie will be held at Law Park on June 26th.  A private childcare list is available.  The donated lantern will be rehabilitated and placed in Law Park. Village Engineer’s Report by Village Engineer Turiano  Capital Project Work Session for June 30, 2020 at 6:00pm.  Law Park Drainage: Targeted to begin in early 2021 on Tuttle Road.  Streetscape: Design choices for paving, trees and furniture need to be decided.  Cross Access Easements: Working with various owners to gain access.  Village Hall ADA: A meeting was held with the Beautification Committee regarding the plantings.  Cell Tree: The building permit was issued.  Fuel Island: Work is complete and the old one needs to be demolished.  DPW Water Garage: Work is underway. Committee Reports Beautification Committee:  Hanging baskets were installed.  The Pocket Park is being replanted using sustainable plantings and will be a pollinator pathway. 3  Thanks to the Committee for all their efforts. Recreation Advisory Committee:  Their next meeting will be on June 17th. Public Comments There were no public comments. Authorize Village Manager to Execute an Inter-Municipal Agreement – Westchester County Solid Waste and Recyclables Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute an Inter-Municipal Agreement with Westchester County for Solid Waste Management and Recyclables Disposal Services through October 21, 2024. and WHEREAS, GML § 217(h) authorizes a LOSAP sponsor to allow different forms of payment; and 7 WHEREAS, under the current LOSAP provisions, when a participant attains the Entitlement Age the participant has the option to be paid the account balance as a lump sum or in two annual installments; and WHEREAS, currently, if a participant dies before the Entitlement Age, the payment to the designated beneficiary is a lump sum; and WHEREAS, as a result of a recent death of a participant, the Board has been made aware that giving a designated beneficiary the same option to be paid in two installments would provide advantages to the beneficiary; and WHEREAS, the Board has been advised that based on the current administrative fee schedules, it will incur a non-recurring additional administrative cost of $53 if a designated beneficiary actually elects to be paid in two annual installments, which is the same non-recurring expense incurred when a participant elects to be paid two annual installments at the entitlement age; and WHEREAS, the Board desires to give reasonable flexibility to beneficiaries when managing their financial affairs; NOW, THEREFORE BE IT RESOLVED, that the Board of Trustees hereby amends the Plan Document effective immediately to provide that upon the death of a pre-Entitlement Age participant, the designated beneficiary may elect to be paid in two annual installments in lieu of the lump sum. The first installment will be equal to one - half of the Accrued Service Award at the time of distribution. The second installment will be paid as soon as administratively feasible after the next following January 1. Such payment will be the remaining Accrued Service Award as of the date of distribution. RESOLVED, that, the Village Clerk is authorized to provide a copy of this resolution to Firefly Admin Inc., and Firefly Admin Inc. is authorized update the administrative procedures, forms, and documents as necessary to carry out this intent of this resolution. Fire Department Memberships The Board thanked the new members for volunteering and stated the Dengler family was very dedicated to the Department. Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: 8 BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the under 18 membership of Theobald Dengler XI to the Scarborough Engine Company. BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Sarah Hoffman to the Scarborough Engine Company. Acceptance of a Donation The Board thanked the Broghammer Family for their generous donation. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees hereby accepts a donation in the amount of $1,000 from the Broghammer Family for the purposes of purchasing a tree to be planted for Michael Variano and amend the 20/21 Budget as proposed below: Increase Revenue – Gifts (A0101.2705) by $1,000 Increase Expenses – Special Matching Expenses (A8510.496) by $1,000 Recreation Advisory Committee Appointment The Board thanked Mr. Alvich for his enthusiasm and for volunteering to join the committee. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby makes the following appointment: James Alvich as a member of the Recreation Advisory Committee for a term to expire on April 1, 2021. Minutes Upon motion by Deputy Mayor Chatzky, seconded by Trustee Werner, the Board voted unanimously to approve the minutes June 2, 2020 as amended. Adjournment 9 Upon motion by Trustee Werner, seconded by Trustee Hunt, the Board voted unanimously to adjourn into Executive Session to discuss legal and personnel matters. The Board reconvened at 10:00pm. Upon motion by Trustee Werner, seconded by Deputy Mayor Chatzky, the Board voted unanimously to adjourn the Regular Meeting at 10:01pm.
