Village Board of Trustees Regular Meeting June 2, 2020 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held remotely via Zoom on the 2nd of June, 2020 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Edward E. Midgley, Trustee Sabine K. Werner, Trustee Also Present Philip Zegarelli, Village Manager Daniel Pozin, Village Attorney Christine Dennett, Village Clerk David Turiano, Village Engineer Kathryn Nivins, Village Treasurer Pledge of Allegiance Acceptance of Resignation from a Planning Board Member Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT FURTHER RESOLVED, that the Board of Trustees hereby accepts the resignation of Sabine Werner as a Member of the Planning Board effective June 2, 2020. Mayoral Appointment and Swearing in of Village Trustee Mayor Vescio appointed Sabine K. Werner to fill the unexpired term of Trustee DeRose. Village Clerk Dennett swore in Trustee Werner. Continuation of Public Hearings Amend Chapter 220-2, Zoning Definitions Amend Chapter 220-3, Zoning Districts and Map 1 Amend Chapter 195, Taxation Amend Chapter 220-5, Planned Office and Laboratory B District Amend Chapter 220-6, Special Permit Uses The Board opened all five hearings together. Deputy Mayor Chatzky gave a superb synopsis of the proposed changes. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Werner, the Board voted unanimously to adjourn the public hearing to June 16, 2020 at 7:30pm. Public Hearing to Amend the Comprehensive Plan Related to the BZone Mayor Vescio gave an outstanding synopsis of the proposed changes. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to adjourn the public hearing to June 16, 2020 at 7:30pm. Board of Trustees Announcements  Condolences to the families of former Police Chief Joseph McHenry and Officer William Lewis who recently passed away. Their service as well as all retirees is greatly appreciated.  The Library has many virtual programs available. Visit their website for more information. Curbside pickup begins next week.  The Board thanked Village Staff for all the hard work they’ve been doing and keeping the Village fully operational.  The Board is seeking volunteers for the Beautification Committee and the Architectural Review Advisory Committee. Village Manager’s Report by Village Manager Zegarelli  The Village Election originally scheduled for March has now been scheduled for September 15th.  Village Court will remain closed into June.  Pleasantville Road is being repaved this week.  Summer Camp will not be held in the traditional format. Programs are being designed to fit the current standards.  The pool will be ready for when the Governor allows it to open.  The Village’s Census response is in the top five for the County. 79% response rate.  Tax Bills have been sent out and are due by July 1st.  The new tree installation is nearing completion Law Park by the playground. 2 Village Engineer’s Report by Village Engineer Turiano  Sanitary Sewer Evaluations: Proposals are being sought out.  Streetscape: Design materials are being reviewed by the Board.  Law Park Drainage: Minimizing curb changes. Tuttle Road has been moved up in the phasing.  Cross Access Easements: Working with various owners to gain access.  Village Hall ADA: 95% plans have been received.  Long Hill Pump Station: Working to decommission it.  Streetlight Installation: Underway  Cell Tree: Close to the issuance of a building permit. The Board scheduled a Capital Project Work Session for June 30, 2020 at 6:00pm. Committee Reports Beautification Committee:  Hanging baskets will be installed in June.  Planters have been planted.  A design for the Pocket Park is being reviewed. Recreation Advisory Committee:  Park Rules and Regulations are being reviewed.  Looking to extend the path around the pond at Law Park.  Share the Road signage has been requested.  A bridge is being discussed with the County at Pocantico Park.  Pickleball Court estimates are being reviewed. Public Comments Michael Souza of 144 Tuttle Road stated he was concerned with the state of the road and sidewalks on Tuttle Road. Larissa Wayne-Paulmeno of Tuttle Road stated the sidewalks needed to be redone on Tuttle Road and the drainage by Hawthorn Place should be looked at. The Board had general discussion about Tuttle Road and the plan to reconstruct it and stated the plan was expedited to happen a year and a half sooner than anticipated. Board Appointments Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: BE IT RESOLVED THAT Brian Crowley is hereby appointed as a Planning Board Member to fill the unexpired term of Sabine Werner to expire on April 1, 2024. 3 BE IT RESOLVED THAT Krista Mastrocola is hereby appointed as the Alternate Member of the Planning Board Member to fill the unexpired term of Brian Crowley to expire on April 1, 2021. Schedule a Public Hearing to Renew a Special Use Permit – Briarcliff Congregational Church and Garden House School Upon motion by Deputy Mayor Chatzky, seconded by Trustee Werner, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that a Public Hearing is hereby scheduled for June 16, 2020 at 7:30pm or soon thereafter to hear and consider an application for a renewal of a Special Use Permit to the Briarcliff Congregational Church and Garden House School. Schedule a Public Hearing to Amend Chapter 153 Parks and Recreation and Chapter 220-4 Schedule Controlling Lands and Buildings Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that a Public Hearing is hereby scheduled for the June 16, 2020 Board of Trustees meeting at 7:30pm to hear and discuss a proposed local law to amend Chapter 153 entitled “Parks and Recreation” of the Code of the Village of Briarcliff Manor. BE IT RESOLVED that a Public Hearing is hereby scheduled for the June 16, 2020 Board of Trustees meeting at 7:30pm to hear and discuss a proposed local law to amend Chapter 220-4 “Schedule Controlling Lands and Buildings” of the Code of the Village of Briarcliff Manor. RESOLVED FURTHER that the proposed local law to amend Chapter 220-4 of the Code of the Village of Briarcliff Manor is hereby directed to the Village Planning Board and to the Westchester County Planning Board for review and recommendation and to the Town of Ossining, Town of Mount Pleasant, and Village of Ossining for review and comment as they see fit. Minutes Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the minutes May 5, 2020. Adjournment 4 Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to adjourn into Executive Session to discuss legal and personnel matters at 9:14pm.
