Village Board of Trustees Regular Meeting May 19, 2020 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held remotely via Zoom on the 19th of May, 2020 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Cesare DeRose, Jr., Trustee Kevin Hunt, Trustee Edward E. Midgley, Trustee Also Present Philip Zegarelli, Village Manager Daniel Pozin, Village Attorney Christine Dennett, Village Clerk David Turiano, Village Engineer Pledge of Allegiance Continuation of Public Hearings Amend Chapter 220-2, Zoning Definitions Amend Chapter 220-3, Zoning Districts and Map Amend Chapter 195, Taxation The Board opened all three hearings together. Deputy Mayor Chatzky gave an outstanding synopsis of the proposed changes. Mr. Jonathan Grebow of Ridgewood Real Estate Partners gave a presentation on potential development of his site located at 345 Scarborough Road. Upon motion by Trustee DeRose, seconded by Trustee Hunt, the Board voted unanimously to adjourn the public hearing to June 2, 2020 at 7:30pm. Public Hearings Amend Chapter 220-5, Planned Office and Laboratory B District Amend Chapter 220-6, Special Permit Uses 1 Amend Chapter 220-3, Zoning Districts and Maps Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to open the public hearings simultaneously. Deputy Mayor Chatzky gave a synopsis of the proposed changes. Upon motion by Trustee DeRose, seconded by Trustee Hunt, the Board voted unanimously to adjourn the public hearing to June 2, 2020 at 7:30pm. Board of Trustees Announcements  The Briarcliff Manor Fire Department offered grilling safety tips. Volunteers are always needed.  Briarcliff Cares is offering shopping trips to help seniors and others that have trouble getting to the store.  The Library has many virtual programs available. Visit their website for more information.  The Board thanked Village Staff for all the hard work they’ve been doing and keeping the Village fully operational.  The Board is seeking volunteers for the Beautification Committee and the Architectural Review Advisory Committee. Letters of interest should be sent to BOT@briarcliffmanor.org.  The Village mourns the loss of all those that have passed away due to COVID-19. Phyllis Smalley a longtime volunteer for the Fire Department and longtime resident Todd Heyda both passed away. Condolences to their families. Village Manager’s Report by Village Manager Zegarelli  The Village Election originally scheduled for March has now been scheduled for September 15th.  Village Court will remain closed into June.  The tennis courts will be opened for use by two people at a time.  The status of the Village Summer Camp is still undetermined.  The pool will be ready for when the Governor allows it to open.  The Village’s Census response is in the top five for the County. 75% response rate.  Tax Bills will be sent out soon and are due in June.  There will be a modest ceremony for Memorial Day that will be livestreamed.  Many coyotes have been seen throughout the Village. Residents are cautioned to keep an eye on their pets.  A Tree Planting Proposal being done for Law Park by the playground. Village Engineer’s Report by Village Engineer Turiano 2  COVID-19 Construction Regulations: Restrictions are in place and all non- essential work has ceased. Single workers are permitted and landscaping maintenance is permitted.  Streetscape: Design materials are being reviewed by the Board.  Law Park Drainage: Minimizing curb changes.  Cross Access Easements: Working with various owners to gain access.  Village Hall ADA: 95% plans have been received.  Long Hill Pump Station: Working to decommission it.  Cell Tree: Close to the issuance of a building permit. Village Engineer Turiano gave his annual stormwater management presentation noting the measures in place as required by law. Committee Reports Beautification Committee:  Hanging baskets will be installed in June.  Planters will be planted this week. Recreation Advisory Committee:  Their monthly meeting will be tomorrow via zoom.  A petition has been circulated regarding a bridge being built at Pocantico Park.  They will review the rules and regulations for Scarborough Park. Public Comments Mr. Roger Battacharia of 16 Holbrook Road thanked the Board and Village Staff for doing an amazing job and stated he had drainage concerns during rainstorms from runoff off of Scarborough Road. Extension of Moratorium Upon motion by Trustee DeRose, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: WHEREAS, on June 4, 2019, the Village Board of Trustees (“Village Board”) adopted Local Law No. 2 of 2019, entitled A LOCAL LAW IMPOSING A TEMPORARY MORATORIUM ON THE ACCEPTANCE, PROCESSING AND APPROVAL OF APPLICATIONS IN THE PLANNED OFFICE BUILDING AND LABORATORY B DISTRICT AND BUSINESS TRANSITIONAL BT DISTRICT (THE “B ZONE”) OF THE VILLAGE OF BRIARCLIFF MANOR, referred to herein as the “Moratorium Local Law”; and WHEREAS, the Moratorium Local Law was filed with the New York Secretary of State on, and is effective as of June 7, 2019; and 3 WHEREAS, in accordance with its terms, the Moratorium Local Law as adopted established a moratorium on certain stated development activities in connection with any B Zone property as defined therein in order to allow the Village Board sufficient time in which to undertake a comprehensive and extensive review of “The Village of Briarcliff Manor Comprehensive Plan Addendum – B/BT District Recommendations”, dated October 4, 2017, as amended, (the “Addendum”) to determine any amendments to Village Code Chapter 220 and the Addendum that may be necessary for the Village Board to address the needs of the Village, particularly in light of the aggregate size of the B Zone properties and the potential to significantly increase the Village’s population through development of these commercial properties with residential uses (the “Moratorium”); and WHEREAS, the Moratorium was intended to provide the Village Board with the required time to accomplish the technical aspects of its said review and to enact any required amendments, as it would be improper for development to proceed with respect to any B Zone property in a manner potentially contrary to Chapter 220 and the Addendum as they may ultimately be amended, and to protect the health, safety and welfare of the residents and property owners of the Village as well as the greater community; and WHEREAS, the Moratorium was established for a period of twelve (12) months subject to extension by resolution of the Village Board for good cause shown to a total of fifteen (15) months. NOW THEREFORE, BE IT RESOLVED that the Board of Trustees of the Village of Briarcliff Manor does hereby find that the COVID-19 pandemic and the resultant delays to the Village Board’s said review does constitute good cause for, and hereby approves the extension of the Moratorium to a total of fifteen (15) months, to expire on September 4, 2020. Authorize the Village Manager to Execute a Tri-Community Agreement for Fly Car Services Upon motion by Trustee Hunt, seconded by Trustee DeRose, the Board voted unanimously to approve the following resolution subject to any non-material changes: BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute an agreement with the Village of Croton on Hudson, NY and the Ossining Volunteer Ambulance Corps. Inc. (OVAC) for Fly Car Services for June 1, 2020 through May 31, 2023 and to negotiate such modifications and revisions to the contract as may be in the Village’s interest. Authorize Village Manager to Execute an Agreement with Woodard & Curran Engineering – SCADA System Support 4 Upon motion by Trustee DeRose, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution subject to any non- material changes: BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute an Annual Service Agreement with Woodard & Curran Engineering to provide support hours for maintenance and service for the SCADA system per their amount of $30,500. Resolution to Furlough Certain Part Time Personnel Upon motion by Trustee DeRose, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: WHEREAS, due to financial and budgetary reasons, including a significant change in Village operations resulting from a reduction in services to the public due to the COVID-19 pandemic, the Board of Trustees has determined that it is necessary to temporarily reduce the number of employees in the Village; and WHEREAS, as a result of this determination, certain part-time positions will have to be furloughed. NOW, THEREFORE, BE IT RESOLVED, that the following positions are furloughed, effective at the close of business on May 15, 2020: Position Number of Positions Library Clerk 2 Library Page 1 Fire Safety Inspector 1 Assistant Building Inspector 1 BE IT FURTHER RESOLVED that, due to the furlough of these positions, the following individuals will be temporarily furloughed, effective at the close of business on May 15, 2020: Name Francis Erlanger Harrison Isaac Joan Smythe Thomas Glass John Caldararo 5 Appointment of Beautification Committee Member Upon motion by Trustee DeRose, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that Dawn Orza is hereby appointed to the Beautification Committee. Acceptance of Resignation of Trustee DeRose Upon motion by Trustee Midgley, seconded by Trustee Hunt, with a no vote from Deputy Mayor Chatzky, the Board voted to accept the resignation of Trustee DeRose effective June 2, 2020. The Board thanked Trustee DeRose for his dedicated service and presented him with a street sign. Trustee DeRose thanked the Board, staff and residents for all their support during his six years on the Board. Schedule a Public Hearing to Amend the Comprehensive Plan related to the BZone Upon motion by Trustee DeRose, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that a Public Hearing is hereby scheduled for the June 2, 2020 Board of Trustees meeting at 7:30pm to hear and discuss amendments to the Comprehensive Plan related to the B Zone. Minutes Upon motion by Trustee DeRose, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the minutes May 5, 2020. Adjournment Upon motion by Trustee DeRose, seconded by Deputy Mayor Chatzky, the Board voted unanimously to adjourn the Regular Meeting at 9:11pm.
