Village Board of Trustees Regular Meeting September 22, 2020 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held remotely via Zoom on the 22nd of September, 2020 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Edward E. Midgley, Trustee Sabine Werner, Trustee Also Present Philip Zegarelli, Village Manager Daniel Pozin, Village Attorney Christine Dennett, Village Clerk David Turiano, Village Engineer Pledge of Allegiance Swearing in of Village Trustees Village Clerk Dennett swore in recently elected Trustees, Kevin Hunt and Sabine Werner. Police Sergeant Promotion Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that Frederick Galbraith is hereby promoted to the position of Police Sergeant at an annual salary of $132,514.05 effective at 12:01 a.m. on September 23, 2020. Amend Chapter 220-2, Zoning Definitions Amend Chapter 220-3, Zoning Districts and Maps Amend Chapter 220-4 Schedule Controlling Lands and Buildings Amend Chapter 220-5, Planned Office and Laboratory B District Amend Chapter 220-6, Special Permit Uses Amend Chapter 220 to add a new section 9.4 entitled “Wireless Telecommunication Services Facilities” Amend Chapter 220, Table 3, Permitted Principal and Accessory Uses (Commercial) Amend Chapter 220, Table 4, Permitted Lot Sizes, Setbacks, Height Requirements (Commercial) Amend Chapter 195, Taxation Amend the Comprehensive Plan related to the BZone Amend Chapter 220, Table 1, Permitted Principal and Accessory Uses Amend Chapter 220, Table 5, Exceptions and Modifications Amend Chapter 172, Signs The Board opened all thirteen hearings together. Mayor Vescio gave a synopsis of the proposed legislation. Mr. Dan Levine of 293 Scarborough Road asked what the status of the violations were for 345 Scarborough Road. Village Engineer Turiano stated they were developing a plan to maintain and safe up the site and were scheduled to be in court October 7, 2020. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Werner, the Board voted unanimously to adjourn the public hearings to October 6, 2020 at 7:30pm. Board of Trustees Announcements • The Library has many virtual programs and curbside pickup available. Visit their website for more information. • The Fire Department gave residents safety tips for using fire pits. Volunteers are always needed. Village Manager’s Report by Village Manager Zegarelli • Senators Carlucci and Harkham are cosponsoring Senate Bill 8795 for a study to improve the Route 9A Corridor. Support is requested by residents and link is on the Village website. • There is an 81% Census response rate. • The mobile shredder will be on Van Lu Van Road on October 3rd from 10am-1pm. 2  • The latest edition of the Manor of Speaking is out. • Paving will begin on October 5th. • The Village received a AAA bond rating. • Westchester County will move the water main near Congregation Sons of Israel. Village Engineer’s Report by Village Engineer Turiano • 235 Elm Road had a site inspection and everything was in neat order and the property is being maintained. • 11 Fountain Road filed a Building Permit for accessibility and fire safety. • Shaft 6 is being decommissioned and will potentially be converted into a comfort station. • Heat Smart Westchester is a program the Village is looking in to joining. • There is an uptick in HVAC, generator and solar permits. • Streetscape: 60% design drawings will be received soon. • Village Hall ADA: Will be put out to bid shortly. Committee Reports Beautification Committee: • Fall decorations will be put up soon and over 600 bulbs will be planted. Recreation Advisory Committee: • October 17th – Window Painting. • October 24th – Scarecrow Making • October 31st – Trunk or Treat • Recreation has launched the Geocaching Challenge – a new, self-directed activity that can be enjoyed by residents of all ages. • DPW will create a dust path around the Club Field over the winter. • Next meeting: October 21, 7PM, Community Center Public Comments There were no public comments. Award of Bids VM1920-7 Hydrant Replacement Program Upon motion by Trustee Werner, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: WHEREAS the Village received 10 bids for the Hydrant Replacement Project (VM-1920-7); and 3 NOW, THEREFORE, BE IT RESOLVED that the bid for the Hydrant Replacement Project (VM-1920-7) is hereby awarded to Bilotta Construction Corp. per their bid price of $223,150 and charged to budget code H8397.201.19228. BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and directed to execute a contract with Bilotta Construction Corp. for said project. VM1920-11 Annual Paving Program Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: WHEREAS the Village received 8 bids for the Annual Paving Project (VM-1920- 11); and NOW, THEREFORE, BE IT RESOLVED that the bid for the Annual Paving Project (VM-1920-11) is hereby awarded to Westchester Hills Landscaping per their item quantity of $98 per ton not to exceed $703,111.11 and charged as follows: Budget Code Amount H5110.201.19212 (Summer Borrowing) $400,000.00 H5110.201.18218 (Remaining 18/19 Capital) $26,779.39 EWR (Extreme Winter Recovery, DOT Program) $35,294.51 CHIPS $196,242.83 PAVE NY $44,802.81 TOTAL: $703,111.11 BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and directed to execute a contract with Westchester Hills Landscaping for said project. VM1920-10 Epoxy Striping Program Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: WHEREAS the Village received 1 bid for the Epoxy Striping Project (VM-1920- 10); and NOW, THEREFORE, BE IT RESOLVED that the bid for the Epoxy Striping Project (VM-1920-10) is hereby awarded to Safety Marking, Inc. with their bid proposal of $.576 per linear foot not to exceed $43,200 which will be charged to budget code H.5110.201.19215. 4 BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and directed to execute a contract with Safety Marking, Inc. for said project. Schedule Public Hearings • Amend Chapter 207-8, U-Turns • Amend Chapter 207-32, Parking at the Scarborough Station • Amend Chapter 131, Freshwater Wetlands • Chapter 164, Public Assemblies, Celebrations and Parades Deputy Mayor Chatzky gave a synopsis of the proposed legislation. Upon motion by Trustee Werner, seconded by Trustee Midgley, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that a Public Hearing is hereby scheduled for the October 6, 2020 Board of Trustees meeting at 7:30pm to hear and discuss a proposed local law to amend Chapter 207-8 “U-turns” of the Code of the Village of Briarcliff Manor. BE IT RESOLVED that a Public Hearing is hereby scheduled for the October 6, 2020 Board of Trustees meeting at 7:30pm to hear and discuss a proposed local law to amend Chapter 207-32 “Parking at Scarborough Station” of the Code of the Village of Briarcliff Manor. BE IT RESOLVED that a Public Hearing is hereby scheduled for the October 6, 2020 Board of Trustees meeting at 7:30pm to hear and discuss a proposed local law to amend Chapter 131 “Freshwater Wetlands” of the Code of the Village of Briarcliff Manor. BE IT RESOLVED that a Public Hearing is hereby scheduled for the October 6, 2020 Board of Trustees meeting at 7:30pm to hear and discuss a proposed local law to add a new Chapter 164 “Public Assemblies, Celebrations and Parades” of the Code of the Village of Briarcliff Manor. Fire Department Memberships The Board thanked all the new members and their families and stated they were amazed at how many applications they were approving. Upon motion by Trustee Hunt, seconded by Trustee Werner, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Austin Li to the Briarcliff Manor Fire Company. 5 BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the under 18 membership of Gianna Galiani to the Scarborough Engine Company. BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of James Hamski to the Scarborough Engine Company. BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the under 18 membership of Daniel Hannan to the Scarborough Engine Company. BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the under 18 membership of Joshua Linett to the Briarcliff Manor Hook and Ladder Company. BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the under 18 membership of Jason Sendek to the Briarcliff Manor Hook and Ladder Company.
