Village Board of Trustees Regular Meeting December 1, 2020 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held remotely via Zoom on the 1st of December, 2020 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Edward E. Midgley, Trustee Sabine Werner, Trustee Also Present Philip Zegarelli, Village Manager Dan Pozin, Village Attorney Christine Dennett, Village Clerk David Turiano, Village Engineer Pledge of Allegiance Continuation of Public Hearing - Chapter 220-19 Fees Deputy Mayor Chatzky gave a brief synopsis the proposed law. There were no comments. Upon motion by Trustee Werner, seconded by Deputy Mayor Chatzky, the Board voted unanimously to close the Public Hearing. There were no comments. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board voted unanimously to close the Public Hearing. Upon motion by Trustee Werner, seconded by Deputy Mayor Chatzky, the Board voted unanimously to adjourn the Public Hearing to December 8, 2020. Deputy Mayor Chatzky gave a brief synopsis the proposed changes. There were no comments. Visit their website for more information. • There are several Recreation Programs available. Platform Tennis, a new Running Club, Geo-caching Challenge, Senior Shopping and many more. Sign up for their E-News and visit their site for more information. • The PBA is holding their annual toy and coat drive. • Please support the Village’s effort to make Route 9A safer. Village Manager’s Report by Village Manager Zegarelli • Overnight parking restrictions are in effect through March 31st. • Scarborough Station Parking Permits are on sale. • The next Police Reform Committee meeting is scheduled for December 7th. • Leaf pickup continues. 3  • Village Taxes are due by December 31st. • The Village was given an award by NYCOM for a shared services project. Police Outreach Report • The PBA is holding their annual toy and coat drive. • 9pm Routine. Make sure your cars and doors are locked and no valuables are left it the car. Village Engineer’s Report by Village Engineer Turiano • There is progress with cross access easements along Pleasantville Road. It will create connectivity with parking. • Several mixed use development projects are before the Planning Board. • 345 Scarborough Road is making progress in addressing their violations. • Village Hall ADA: Is out to bid and due back December 17th. Committee Reports Beautification Committee: • No report. Recreation Advisory Committee: • The next meeting is December 9th. Library Board: • No report. Public Comments Mr. Dominick DiSanzo, 33 year employee of the Village stated their contract was expired and was looking for the Board to facilitate negotiations. He stated they worked very hard and had a group of very talented employees. Mayor Vescio thanked Mr. DiSanzo and the CSEA for all that they do for the Village but stated the Board couldn’t intervene. He stated he hoped the contract would be resolved soon. Authorize Village Manager to Execute an Agreements Westchester County – Stop DWI Upon motion by Deputy Mayor Chatzky, seconded by Trustee Werner, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute an agreement with Westchester County for participation in the Stop DWI 4 Patrol/Datamaster Project for the period from January 1, 2021 through December 31, 2025. Roll Call: Trustee Hunt Aye Trustee Werner Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Second Addendum to the Agreement with ProPark America for Valet Parking Services at the Scarborough Station Upon motion by Deputy Mayor Chatzky, seconded by Trustee Werner, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute the Second Addendum to the agreement with ProPark America for valet parking services at the Scarborough Station to cover such period of time with such terms and conditions in keeping with the revised RFP and the provisions of Pro Park's agreement commencing January 1, 2021, and expiring on December 31, 2021 with an optional extension to December 31, 2022 at VBM’s Board of Trustees sole discretion. Roll Call: Trustee Hunt Aye Trustee Werner Aye Trustee Midgley Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Amendment to Cellular Lease Agreements Upon motion by Trustee Werner, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: Whereas, the Village of Briarcliff Manor is party to certain Wireless Communications Site Lease Agreements, as same were previously amended, relative to the use of the Village’s water tank located at The Club property, at 25 Scarborough Road (the “Property”); and Whereas, in accordance with its approvals for development of the Property, the owner thereof, SHI-III BRIARCLIFF REIT, LLC, is installing a stealth monopole on the Property; and 5 Whereas, the Village and the respective wireless carriers wish to further amend the respective leases to provide for the continued operation of the carriers on the stealth monopole upon the relocation/location of their wireless communications facilities thereto; and Now Therefore, Be It Resolved by the Village of Briarcliff Manor Board of Trustees that the Village Manager is hereby authorized to execute a Second Amendment to Wireless Communications Site Lease Agreement, in the form as submitted, subject to nonmaterial revisions as may be required in the discretion of the Village Manager in consultation with the Village Attorney, with the following entities: ● Cingular Wireless PCS, LLC (AT&T) ● New York SMSA Limited Partnership d/b/a Verizon Wireless, and ● T-Mobile Northeast LLC, as successor in interest to Omnipoint Communications, Inc. Adoption of Code Changes in Previously Adopted Legislation of the Code of the Village of Briarcliff Manor.
