ELECTION RESOLUTION FOR ANNUAL VILLAGE ELECTION 2022 BE IT RESOLVED that the Annual Village Election will be held in the Village of Briarcliff Manor at the Library and Community Center (1 Library Road) in said Village on Tuesday, March 15, 2022 between the hours of 6:00am and 9:00pm during which the polls will be open. BE IT FURTHER RESOLVED that the polling places for the Village of Briarcliff Manor, will be designated as follows, the Village’s Single Election District (Town Voting districts #15, #16, #17, #19, #26, #27 and #29) will vote in the Briarcliff Manor Library and Community Center (1 Library Road).  VILLAGE OF BRIARCLIFF MANOR BOARD OF TRUSTEES AGENDA FEBRUARY 1, 2022 2. ELECTION INSPECTORS FOR ANNUAL VILLAGE ELECTION 2022 BE IT RESOLVED that, Celianne Silverstein and Estelle Kersch are hereby appointed Inspectors of Election for the March 15, 2022 Village Election. BE IT FURTHER RESOLVED that Celianne Silverstein is hereby designated as Inspector of Election and Chairperson. BE IT FURTHER RESOLVED that Rhonda, Alomar, Georgina Gualdino, Lauren Gualdino, Joyce Perlmutter, Joyce Silverstein, and Audrey May June are hereby appointed as Alternate Inspectors of Election. BE IT FURTHER RESOLVED that the compensation for each Inspector of Election other than the Inspector designated as Chairperson is hereby fixed at Three Hundred and Fifty ($350) dollars per day or prorated to $22 per hour worked if necessary. CALL FOR PUBLIC SUPPORT FOR IMMEDIATE ACTION BY NEW YORK STATE TO REPAIR DEFECTIVE CONDITIONS AND DESIGN AND EXECUTE SAFETY ENHANCEMENTS TO ROUTE 9A IN THE VILLAGE OF BRIARCLIFF MANOR AND PASSAGE OF NYS SENATE BILL S2988 AND NYS ASSEMBLY BILL A11126 BE IT RESOLVED that Mayor and Board of Trustees of the Village of Briarcliff Manor, in our capacity to represent the best interests of all the residents of the community, and protect the non-residents who pass through our community, do hereby formally request officials from New York State and the County of Westchester address and remedy unsafe conditions on the portion of New York State Route 9A within the Village of Briarcliff Manor. Fillable sample letter/email of support for residents FURTHER RESOLVED that the Mayor and Board of Trustees of the Village of Briarcliff Manor, mourns those who have lost their lives or have been seriously injured traveling this dangerous stretch of roadway. FURTHER RESOLVED that the Mayor and Board of Trustees of the Village of Briarcliff Manor, through earlier mailings and emails, have documented the dangerous conditions and design defects of Route 9A, which have led to loss of life, damage to property, and a strain on municipal emergency services. This Board mourns those who have lost their lives or have been seriously injured traveling this dangerous stretch of roadway. FURTHER RESOLVED that the Mayor and Board of Trustees hereby issues this official resolution to the Governor of the State of New York, the Commissioner of the New York State Department of Transportation and the Westchester County Executive as further evidence of this Community’s concern and steadfast determination to improve these defective conditions. We strongly express our continuing alarm with the obsolete design and ongoing deterioration of Route 9A, together with the concomitant accidents and tragedies arising therefrom. FURTHER RESOLVED that this Mayor and Board of Trustees does hereby urge and formally request that immediate plans be made to design, cause to execute safety enhancements, and effect appropriate travelling conditions on Route 9A and that priority be given for immediate, determined action. FURTHER RESOLVED that the Mayor and Board of Trustees fully support NYS Senate Bill S2988 Co-Sponsored by Senators Peter Harckham and Elijah Reichlin- Melnick and Assembly Bill A11126 Sponsored by Assemblywoman Sandra Galef authorizing the NYS department of transportation to conduct a study pertaining to proposed improvements of State Route 9A in the towns of Ossining and Mount Pleasant. FURTHER RESOLVED that the Mayor and Board of Trustees urges the local representatives to do everything within their power and abilities to further the Bills to be approved on behalf of their constituents. Midgley, Trustee Sabine Werner, Trustee Also Present Josh Ringel, Village Manager Christine Dennett, Village Clerk Josh Subin, Acting Village Attorney David Turiano, Village Engineer Pledge of Allegiance Continued Public Hearing: Amend Chapter 178, Solar and Alternative Energy Deputy Mayor Chatzky gave a brief synopsis of the proposed law. There were no public comments. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Werner, the Board voted unanimously to close the public hearing. Visit their website for more details and information on all their programs. • The Fire Department offered tips on using wood burning stoves and fireplaces safely and encouraged residents to volunteer and join the BMFD. Village Manager’s Report by Village Manager Ringel • There will be a Police Outreach Report at the next meeting. • Residents are reminded to clear their sidewalks after a storm. • COVID tests are being distributed by visiting covidtests.gov. • Henry Jamin, the Superintendent of Recreation has announced his retirement after decades of service to the Village. The person hired will have very big shoes to fill. Village Engineer’s Report • Icy spots on sidewalks also need to be addressed by residents. • The application received for a BESS at the Chilmark Shopping Center will also need to have their Special Permit and Site Plan amended for the parking count. • The ADA project is slowly wrapping up. Specialty items are delayed. • The server room at Village Hall is being relocated. • Mobility Enhancement Project updates will be sent to the Board tomorrow. • There is a grant program for Hazard Mitigation with a deadline of April 1, 2022. Committee Reports Library Board: • No report. Recreation Advisory Committee: • The ice rink will hopefully open later this week. Permits are on sale. • The Winter Photo Challenge is through February 9th. • Henry’s retirement is a huge loss to the community. • Share the Road signs are being requested. • A lacrosse practice wall is being discussed at Law Park. • The next meeting is scheduled for Thursday February 10th at 7PM via zoom. Beautification Committee: 3  • No report. Public Comments Ola Nosseir of 15 Spruce Road stated the barrier in the center of Route 9a is unsafe and in need of replacement. Ratification of Memorandum of Agreement with Policemen’s Benevolent Association (PBA) from June 1, 2021 through May 31, 2026 The Board thanked Village Manager Ringel, the PBA and Richard Zuckerman for all their hard work settling the contract. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Werner, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board hereby ratifies and approves the 2021-2026 Memorandum of Agreement with the Village of Briarcliff Manor Policemen’s Benevolent Association, Inc. BE IT FURTHER RESOLVED, that the Village Manager is hereby authorized and directed to execute a Memorandum of Agreement with the Village of Briarcliff Manor Policemen’s Benevolent Association, Inc. Authorize Village Manager to Execute Agreements with SHI-III Briarcliff REIT, LLC – “The Club” The Board thanked Village Attorneys Dan Pozin and Josh Subin and the Club and stated the Club has been good neighbors. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: Whereas, the Second Modification of the Third Amended and Restated Special Permit and Tree Removal Permit for Briarcliff Manor Investors LLC and Integrated Development Group LLC (now SHI-III BRIARCLIFF REIT, LLC,) was adopted on November 24, 2014 (the “Resolution”); and Whereas, in accordance with its approvals for development of the Property, the owner thereof, SHI-III BRIARCLIFF REIT, LLC, installed a stealth monopole on the Property; and 1 Whereas, in consideration of the various conditions, obligations and agreements set forth in the above said Resolution, the Village is willing to proceed as set forth herein; and Now Therefore, Be It Resolved by the Village of Briarcliff Manor Board of Trustees that the Village Manager is hereby authorized to execute the following documents and related recording forms as needed, subject to immaterial changes in the reasonable discretion of the Village Manager and Village Counsel: 1.
