Village Board of Trustees Regular Meeting May 3, 2022 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held at the William J. Vescio Community Center on the 3rd of May, 2022 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Rhea Mallett, Trustee Edward E. Midgley, Trustee Also Present Christine Dennett, Village Clerk Josh Subin, Village Attorney David Turiano, Acting Village Manager/Village Engineer Absent Josh Ringel, Village Manager Pledge of Allegiance Remembrance of Chairman Edward Nolan and Village Employee Nestor Lassic The Village lost two fixtures in the Village over the last week both of which gave their time and dedication to the betterment of the Village. Edward Nolan, Chairman of the Planning Board, since 2008, longtime resident of the Village passed away suddenly. He’ll be missed greatly. Nestor Lassic, 31 plus year employee of the Village, passed away while at work. He was part of the DPW crew who work so hard for the Village and often go unnoticed. The Board remembered and recognized them for their service to the community and held a moment of silence in their honor. Public Hearing to Amend Chapter 164, Public Assemblies 1 Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to open the public hearing. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to adjourn the public hearing to May 17, 2022. Letters of interest are due by noon on May 13th. • The press event on April 29th regarding Route 9A was a big success. Thanks to the BOT, staff, first responders and residents for their support. The Board gave a special thank you to Mayor Vescio for all his hard work in getting this initiative to move forward. • May 7th there will be a cleanup event at Pocantico Lake. Acting Village Manager/Village Engineer’s Report • Due diligence work is completed for 1050 Pleasantville Road. • Grant monies are being sought for electric car charging stations. • The dog park and trail permits are being worked on with the DEC. • Village Engineer Turiano gave his annual Stormwater Management Report detailing the six minimum control measures. Committee Reports Library Board: 2  • A screening of Wasted: The Story of Food Waste on April 29th was well attended. Thanks to Trustee Mallett for participating at the event. • The Library offers many programs to all age groups. Visit their website for information. • The Human Library was held April 30th and the Briarcliff Library was the first Library to participate in Westchester County. Recreation Advisory Committee: • Dana Durso will be joining the Village Staff on April 25th. • Spring programs are online. • Registration for Camp has begun. • The numerous Village trails are detailed on the Hiking Project App. Beautification Committee: • No report. Public Comments There were no public comments. Consider the Referral of Yeshivath Viznitz Special Use Permit Application to Planning Board Acting Village Manager Turiano stated the Board deemed the application complete. LEAD AGENCY DETERMINATION Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously approve the following resolution: BE IT RESOLVED that the Village of Briarcliff Manor Board of Trustees issues this Notice of Intent for the purpose of determining lead agency pursuant to the requirements of the State Environmental Quality Review Act (SEQRA) and Part 617 (6NYRR Part 617), the Statewide implementing regulations pertaining to SEQRA. If no written objections are received the Village of Briarcliff Manor Board of Trustees will assume lead agency 30 days after the date of this notice. This notice has been prepared pursuant to Article 8 of the Environmental Conservation Law. Project Title: Yeshivath Viznitz Project Location: 235 Elm Road, Village of Briarcliff Manor, Westchester County, New York 3 SEQRA Type: Unlisted Action Project Description: Yeshivath Viznitz Dkhal Torath Chaim (the “Applicant”) is seeking a special permit from the Village of Briarcliff Manor Board of Trustees pursuant to Village Code Chapter 220-6.J(1) places of worship, including parish houses and religious school buildings to facilitate the reuse of and renovations to existing structures located at 235 Elm Road (SBL: 98.19-2-11), Briarcliff Manor. The Applicant is proposing to renovate certain existing buildings (i.e. Dining Hall Building, Tead House, Valley Dorm, and the Dow Hall Southern Wing) for use as a private religious education institution for approximately 250 male students between the ages of 17 and 20. The Applicant anticipates that this occupancy will grow by approximately 3% per year for the first 10 years of operation. This growth rate results in the expected occupancy of up to 350 students and the use of the New Dorm building by the end of the first 10 ten years of operation. In addition, certain site improvements are proposed (i.e. repairing and re-striping existing parking lots, removing and installing new signage, identifying ADA parking and installing gates to control site access). The Applicant will also require Site Plan Approval from the Planning Board. BE IT FURTHER RESOLVED that Special Counsel Barshov is directed to prepare a memorandum to the Planning Board from the Board of Trustees summarizing the thoughts of the Board of Trustees. Memorandum of Agreement – CSEA Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously approve the following resolution: BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute a Memorandum of Agreement with the CSEA in substantially the same form as attached hereto. Acceptance of Donation – Friends of the Library Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously approve the following resolution: BE IT RESOLVED, that the Board of Trustees hereby accepts a donation in the amount of $2,947.51 from the Friends of Briarcliff Manor Public Library. Schedule a Public Hearing to Create a New Chapter 94, Building Numbering Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously approve the following resolution: BE IT RESOLVED that a public hearing to hear and consider the creation of a new Chapter 94, Building Numbering is hereby scheduled for Tuesday, May 17, 2022 at 7:30pm at the William J. Vescio Community Center. Adjournment The Board thanked David Turiano for stepping in while the Village Manager was on vacation.
