A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor,
New York was held at the William J. Vescio Community Center on the 17th of
May, 2022 commencing at 7:30 p.m.

Upon motion by Trustee Mallett, seconded by Trustee Hunt, the Board voted
unanimously to open the public hearing.

Deputy Mayor Chatzky gave a brief summary of the proposed changes.
Mrs. Rachel Leihbacher of 36 Maple Road stated she was a member of the
BMFD and was totally in support of this legislation and further stated clearly
numbered houses were so vital when an emergency occurs.
Upon motion by Trustee Mallett, seconded by Trustee Midgley, the Board voted
unanimously to adjourn the public hearing to June 7, 2022.
Board of Trustees Announcements
• The Briarcliff Manor Fire Department offered tips on home safety.
• Daily parking is now an option at the Scarborough Train Station through
the Pango app.
• A call for volunteers for various Boards and Committees. Letters of
interest should be submitted as soon as possible.
Village Manager’s Report
• Hydrant flushing continues.
• Taxes are due by July 1st.
• The Board wished Josh Ringel a speedy recovery.

Village Engineer’s Report
• There are grant opportunities for various Alternative Energy Initiatives.
• The dog park and trail permits are being worked on with the DEC. The
Board requested the trail be acted on by the next meeting.
• A water main will be replaced on Sleepy Hollow Road and Long Hill Road.
Committee Reports
Recreation Advisory Committee:
• Registration for Camp is still open.
• The tennis courts are open and permits are on sale.
• Pool permits are available.
Library Board:
• Afternoon Tea will be in the on Tuesday, May 24th.
• The Library offers many programs to all age groups. Visit their website for
information.
• There is a Mixed Media exhibit through May 30th.
Beautification Committee:
• The plantings are blooming and hanging baskets and planters are being
worked on.

There were no public comments.
Acceptance of Gift/Donation Policy
Upon motion by Trustee Hunt, seconded by Trustee Mallett, the Board voted
unanimously to approve the following resolution:
BE IT RESOLVED that the Village Board of Trustees hereby adopt the following
Acceptance of Gift/Donation Policy for the Village of Briarcliff Manor subject to
non-material changes:
Purpose
To establish a policy to facilitate the acceptance of beneficial gifts to the Village
of Briarcliff Manor from individuals, groups, or organizations.
Policy

The Village Manager is hereby authorized to accept any gift a) valued at $750 or
less and not likely to create any additional financial expense to the Village; or b)
as part of a fundraising program previously approved by a resolution of the Board
of Trustees.
All other donations of gifts to the Village shall be subject to the approval of a
majority of members of the Board of Trustees.
The Village Manager shall report any offer of a gift to the Board of Trustees in a
timely manner, so that the donor can be publicly thanked, or privately
acknowledged, by the Board of Trustees, as may be appropriate.

Authorize Village Manager to Execute Agreement - Community Housing
Innovations – Administration of Affordable Income Housing Program
Upon motion by Deputy Mayor Chatzky, seconded by Trustee Mallett, the Board
voted unanimously to approve the following resolution:
BE IT RESOLVED that the Village Manager is hereby authorized and directed to
execute an Agreement with Community Housing Innovations for the
Administration of Affordable Income Housing Program.
Budget Amendment – Unclaimed Bail Money
Upon motion by Trustee Midgley, seconded by Trustee Mallett, the Board voted
unanimously to approve the following resolution:
BE IT RESOLVED that the budget for Fiscal Year 2021-2022 is hereby amended as
follows:

resumes of potential candidates to the Recreation Advisory Committee Chair for
review.
Hotel Occupancy Tax
Upon motion by Deputy Mayor Chatzky, seconded by Trustee Mallett, the Board
voted unanimously voted to approve the following resolution:
BE IT RESOLVED the Village Manager is hereby authorized and directed to work
with the our NYS Legislator and Elected Officials to request an act that amends
the tax law authorizing the Village of Briarcliff Manor to impose Hotel Occupancy
Tax.

unanimously to approve the minutes of April 19, 2022, April 25, 2022 and May 3,

The Board reminded residents the School election was today and the polls
closed at 9pm.
Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board
voted unanimously to adjourn the Regular Meeting at 8:22pm.

Chapter 164. Public Assemblies, Celebrations, Parades
§ 164-1 Intent of regulations.
The Village allows for temporary, short-term use of Village property, or closures of public streets and
sidewalks, to promote celebrations, processionals, block parties, and other events that may contribute
to the enjoyment of Village life. However, the Village recognizes the need for orderly administration
when such activities, left uncontrolled, might have a deleterious effect on the health, safety, and
general welfare of the community and the peaceful enjoyment of the village for its residents.
§ 164-2 Permit required.
A. A permit ("Permit" or "permit") is required for any parade, processional, assembly, celebration,
festival, farmer’s market, street fair, party, or similar activity or event held on public property,
that may
(1) include more than twenty (20) people or ten (10) vehicles; or
(2) involve the exclusive use of a public street or sidewalk, village property, or parkland; or
(3) impede pedestrian passage or otherwise interfere with the regular operations of a public
sidewalk or pathway; or
(4) require motorists to detour from a regularly open route, impede traffic, or otherwise limit
access to a public roadway; or
(5) occur outdoors, and include live or recorded music, or any other sound amplification
equipment; or
(6) potentially create a hazardous condition for other vehicles, pedestrians, passers-by, or
other residents of the village; or
(7) create a disturbance to the community by creating additional traffic, noise, trash, or visual
disturbance for others.
B. No permit shall be required for a procession of cars as part of a funeral.
C. No permit shall be required for any exercise of Constitutionally-protected free speech or exercise
of religion, but nothing herein shall prevent the Village, under lawful police power, from taking actions
to keep the peace, minimize disturbance, and protect the health, safety, and general welfare of the
community, the public, and all public and personal property.
D. Any permit issued under this Chapter may be in addition to, and not in place of, any other permit
required as per Chapter 124 Filming and Photography, Chapter 153 Parks and Recreation, or any
other Chapter that may regulate or require permits or previous written authorization under this Village
Code.
E. Events held or sponsored by the Parks and Recreation Department of the Village of Briarcliff Manor
are exempt from the regulations of this chapter.

§ 164-3 Permit applications; conditions.
A. All permit applications shall be submitted to the Village Clerk in person, by electronic mail, by
overnight delivery service, or by United States mail, on a form provided by the Village which shall
include:
(1) The name, address, phone, and email address of the Village resident sponsoring such
application.
(2) A map showing the highlighted streets, sidewalks, park areas, or other public property to
be impacted, and a written description of starting and end points as appropriate.
(3) The date, time, duration of the desired event.
(4) A description, in detail sufficient for the Village Clerk and Village Manager, of the purpose
of the event, the projected attendance, any special conditions and planned mitigation
thereof, including any conditions that may generate unusual trash, odor, light, or noise;;
any cooking, grilling, or serving of food; any use of fire or open flame; any consumption
of alcoholic beverages; any live music or amplified sound; or any other potential impacts
to neighbors, passers-by, or the community.
(5) Names and cell phone numbers for at least two adult residents who will be on-site at the
event.
(6) A signed hold-harmless and indemnification agreement together with a certificate of
insurance naming the Village of Briarcliff Manor as an additional insured and relieving the Commented [PSC1]: I removed reference to insurance
Village from any potential liability by virtue of the applicant's activities. here.
(7) Full payment of a fee, as established by resolution of the Board of Trustees, published in
the Master Fee schedule, as may be amended from time to time.
B. All permit applications must be received by the Village Clerk no later than seven (7) calendar days
before the scheduled event.
C. The Village ClerkManager, while reviewing a permit application, may seek, or require, the advice
of other Village Departments including but not limited to the Village Manager, Police Department,
Fire Department, Ambulance Department, Public Works, Building Department.
D. The Village may require the applicant, at the applicant’s sole cost, to notify and provide property
owners most impacted by the proposed street or sidewalk closing, as determined solely by the
Village, with advanced notice of such closing, and any permit granted may be subject to receipt of
proof of such notifications in a format acceptable to the Village ClerkManager.
E. The Village may attach additional reasonable conditions and safeguards to any permit to ensure
the orderly conduct of the activity and the minimization of impacts of such use, including specifying
the duration and hours of operation of such activity, to protect the health, safety, and welfare of
Village residents and to safeguard public or personal property.
F. The Village may further require as a condition of any permit that the applicant first meets with, or
utilizes the services of, the Village of Briarcliff Manor Police Department, Fire Department and/or
Ambulance Department at rates published in the Master Fee schedule, for each four-hour period or
part thereof. The Applicant shall provide to such Village personnel proper restroom facilities and

water. Proper meals and other such support for services shall be provided to any such Village
personnel so present in excess of four consecutive hours.
G. The Village resident sponsoring the event shall acknowledge they understand their obligations
under Chapter 165 Protection of Public Property, ensure that public property remains litter-free and Commented [PSC2]: Acknowledgment of Chapter 165
undamaged, and agrees to reimburse the Village for any reasonable costs to restore to its original should be enforced by confirmation on a permit application.

H. Any applicant who purchases insurance to limit the potential financial liability as a result of
damages caused during the event shall be advised to add the Village of Briarcliff Manor as a named

want to proceed without insurance, so be it!
IH. The Village may require the applicant to post reasonable bond or cash security to assure
adherence to any permit conditions.
§ 164-4 Fees.
Each applicant shall pay a permit fee to the Village for any event regulated herein, or any other use
of public property, as set forth in the Master Fee Schedule adopted by resolution of the Village Board
of Trustees as such fee may be amended from time to time.
§ 164-5 Denial and Revocation of permit.
A. In the event the applicant has not complied with the requirements or conditions of a permit as set
forth herein, including the timely receipt of such permit application, the Village Clerk Manager may
deny the permit request, or revoke a permit previously granted.
B. The Village Clerk, Village Manager, the Building Inspector, the Chief of Police, the Chief of the
Fire Department, or their lawful appointee designee, may revoke a permit and terminate any event in
progress if:
(1) The event granted under the permit violates any law or ordinance;
(2) The size of attendance, number of vehicles, or disturbance therefrom, exceeds the
parameters of the approved permit;
(3) The event becomes disorderly, disruptive, or unruly, or otherwise threatens the public
health, safety, or welfare of the Village of Briarcliff Manor, its residents, or public or
personal property;
(4) Any information provided on the application for a permit is false, or significant
information regarding the nature of the event was omitted from the application for a
permit.
C. In the event that a permit in denied, or subsequently revoked under the regulations herein, the
applicant may appeal this determination to the Village Board of Trustees. After review of said appeal,
the Village Board of Trustees may affirm or reverse such action, or modify the conditions for
approval, based upon a finding that the determination of denial or revocation was arbitrary,
capricious or not supported by substantial evidence.

§ 164-6 Enforcement.
This chapter shall be enforced by the Village Manager, the Building Inspector, or their respective
designees, and any member of the Village of Briarcliff Manor Police Department.
§ 164-7 Penalties for offenses.
A. Any person, persons, corporation, company, group or other entity of any kind who or which fails to
obtain the permit required herein or otherwise violates any provision of this chapter shall be guilty of
an offense that shall be punishable, in the sole discretion of the court, by a fine of not more than
$1,000 per offense related to a sidewalk, and a fine of not more than $2,500 per offense for a street
or other public property, and shall pay to the Village any permit fees that would have been required
had an application for a permit been duly filed.
B. The imposition of such fine shall not be the Village's exclusive remedy in the event of a violation
of this chapter. The Village may pursue any and all other legal remedies available to it in connection
with any violation of this chapter, including but not limited to those contained within Chapter 165
Protection of Public Property.
§ 164-8 Previous violations.
Notwithstanding any of the foregoing, an applicant who has been previously convicted of or plead
guilty to a violation of this chapter shall not be granted a permit hereunder for a period of 18 months
from the date of such conviction.
§ 164-9 Severability.
The invalidity of any word, section, clause, paragraph, sentence, part or provision of this local law
shall not affect the validity of any part of this local law which can be given effect without such valid
part or parts.
§ 164-10 Effective Date.
This local law shall take effect immediately upon filing in the Office of the Secretary of State of New
York in accordance with the provisions of the Municipal Home Rule Law.

LOCAL LAW NO. _____ ADOPTED
CHAPTER 94 BUILDING NUMBERING
BE IT ENACTED by the Board of Trustees of the Village of Briarcliff Manor, New York, as
follows:
Section 1. The Code of the Village of Briarcliff Manor is amended by adding a
new chapter, designated as “Chapter 94 Building Numbering,” to read as follows:
§94-1. Legislative intent.
A Village-wide uniform numbering system of all buildings and the prominent easily read display
of the individual property and street address numbers will assist emergency personnel in
responding efficiently and quickly to an emergency. It is, therefore, in the best interest of the
public health, safety and welfare of the Village of Briarcliff Manor to enact this chapter.
§94-2. Definitions.
As used in this chapter, the following term(s) shall have the meanings indicted:
BUILDING
The principal building or buildings on each lot and, unless otherwise determined by the
Building Inspector, shall not include any accessory building on a single-family residential
lot. For the purposes of this chapter, any separately partitioned unit of a multi-family
residence, multi-tenant commercial building, or other multi-unit structure with separate
entrances shall each be considered a Building.
CODE ENFORCEMENT OFFICER
The Briarcliff Manor Building Inspector, Assistant Building Inspector, their designees or
Chiefs of the Briarcliff Manor Fire Department, or other authorized Village employees.
IDENTIFYING NUMBER
A unique number designating a particular building located on the street of the lawfully
assigned property address.
STREET
Any street, road, parkway, or public right of way used by vehicular traffic.
§94-3. Duty of building owners, occupants, and tenants.
It shall be the duty of every owner, occupant, or tenant of any building in the Village of Briarcliff
Manor to cause to be displayed and maintained an Identifying Number representing the street
address of each building as per the contents of this chapter. Identifying Numbers shall be

constructed of durable material and shall be maintained in such condition as to be readily visible
as required by Section 94-6 herein.
§94-4. Determination of Building Inspector.
On any lot containing more than one building, the Building Inspector, or his designee, shall be
authorized to decide which buildings shall be uniquely numbered.
§94-5. Size and display of numbers.
A. Size.
(1)
On all lots containing single family homes in residential districts, the figures comprising the
Identifying Number are to be reflective and at least four inches in height with a minimum width
of 0.5 inches (12.7mm).
(2)
On all lots containing multi-family homes in residential districts, or any buildings in commercial
districts, or any building on any lot operating under a Special Permit, the figures comprising the
Identifying Number are to be reflective and at least six inches in height with a minimum width of
0.5 inches (12.7mm).
(3)
If the building upon which the number is to be displayed is not visible from the street, or is more
than fifty (50) feet from the edge of the right-of-way (whether improved or not) of the street or
road serving the building, the number shall be displayed on a mailbox, lamppost, sign, pole,
driveway marker or other non-building structure, of at least four feet in height and not exceeding
10 feet in height in a prominent and conspicuous place readily visible from the road or street and
in no event further back than five (5) feet from said road or street right-of-way. Where numbers
are affixed or placed on a driveway markersaid non-building structures, such marker must be no
more than five (5) feet from the driveway.
B. Font. The displayed numbers shall be block Arabic numerals.
C. Color. The color of said figures shall be in sharp contrast to the color of the background.
§94-6. Visibility from Roadway.
A. To the maximum extent practicable, identifying numbers shall be displayed in such a
manner as to be plainly legible and visible from the center of the street of address when facing
the building at all times between sunrise and sunset.
B. To the maximum extent practicable, the numbers shall be placed so that they are seen from
either direction while driving on the street or road.
C. The numbers shall not be placed on any door of a building, garage, or any other door.

D. The numbers shall not be obstructed by trees, shrubbery, porches or other extensions of the
building, shoveled or plowed snow, or any other obstruction.
E. Lighting. Wherever practicable, the numbers shall be reflective and placed near a light or
other source of downward illumination so that the numbers may be readily seen at night.
§94-7. Signage required on shared driveways.
On parcels where more than one building accesses the street from a single driveway or roadway,
an Identifying Number or directional signage for each building must be displayed and
maintained at each location where the driveway access diverges from the common access to the
street.
§94-8. Rear Identifying Numbers required
All multi-family homes, multi-tenant commercial buildings, and any building on a lot operating
under Special Permit, shall also display and maintain an Identifying Number upon, above, or to
the side of each exterior door facing the rear of such property.
§94-9. Display of other numbers prohibited.
The display of any number other than the Identifying Number authorized or assigned by the
Building Inspector is prohibited.
§94-10. Private roads and new Village roads.
A. New subdivisions. Prior to final approval by the Planning Board, in any subdivision which
has one or more private roads or proposed new Village roads, the developer or owner shall
propose a name of each such road. The name of all private roads and proposed new Village roads
shall be approved by the Village Board prior to Planning Board approval or as a condition of
final subdivision approval. The Planning Board and the owner shall notify the Superintendent of
the Department of Public Works, the Building Inspector, Fire Department, Ambulance
Department, and Briarcliff Manor Police Department, and Westchester County Department of
Emergency Services of the new road name and location.
B. Existing properties. Any existing private road or driveway which serves three or more
buildings, separate parcels and/or building lots shall be considered a private road. Such private
roads shall be named according to the policies approved by a resolution of the Board of Trustees.
C. Signage. The approved name of a private road and of a proposed new Village road shall be
posted by a street sign at each intersection of the road. All signs shall be similar in terms of
construction and character to those signs installed by the Village of Briarcliff Manor for public
roadways. The private road signs shall state the name of the private road, and shall include,
under the name, the words “Private Road” in smaller letters. For private roads existing and not
signed at the date of adoption of this chapter, the Superintendent of the Department of Public
Works shall purchase and install the signs. In all new subdivisions the signs shall be installed
prior to issuance of any building permits and construction of any structures, and the signs shall

be paid for and installed by the owner or developer.
§94-11. Noncompliance; notice; remedy; costs.
A. Noncompliance deemed a violation. The failure of any person, corporation, partnership or
other entity owning a building within the Village of Briarcliff Manor to comply with the
requirements of this chapter within 30 days after initial notice from a Code Enforcement Officer,
shall be deemed a violation of this chapter.
B. Non-maintenance deemed a violation. The failure of any person, corporation, partnership or
other entity owning a building within the Village of Briarcliff Manor to maintain the numbers in
accordance with the requirements of this chapter shall be deemed a violation of this chapter.
C. Service of notice. A notice of violation may be given by personal service or by certified
mailing to the last known address of the owner as shown on the most recent assessment roll on
file in the Assessor’s office of the Village of Briarcliff Manor.
D. Numbering of building and property by Village. In the event of the failure, neglect or refusal
of any owner and/or occupant/tenant, after notice, to comply with the requirements of this
chapter, the Building Inspector, or his designee, may cause said building and property to be
numbered in accordance with the requirements of this chapter to the extent practicable.
E. Report; assessment of costs. The Building Inspector shall report the cost of said numbering
to the Village Board, and the Village Board shall order said cost to be levied and assessed as a
lien against the property of the owner and collected in the same manner as other Village taxes.
The remedy provided in these subsections D and E shall be in addition to, and not in lieu of, the
penalties provided in section 94-12 hereunder.
§94-12. Penalties for offenses.
Any person, corporation, partnership or other entity violating any of the provisions of this chapter
shall, upon conviction, be guilty of a violation punishable by a fine not to exceed $250. Each

§94-13. Enforcement official.
This chapter shall be enforced a by any Code Enforcement Official, Officer as defined in Chapter
104 or as defined herein., or any other officer or employee designated by resolution of the
Village Board of Trusteesduly authorized representee.
§94-14. Conflict with NYS Law.
If any provision of this chapter conflicts with the Property Maintenance Code of New York
State, the more restrictive provision shall prevail.

BE IT RESOLVED that the Village Board of Trustees hereby adopt the following
Acceptance of Gift/Donation Policy for the Village of Briarcliff Manor subject to
non-material changes:
Purpose
To establish a policy to facilitate the acceptance of beneficial gifts to the Village
of Briarcliff Manor from individuals, groups, or organizations.
Policy
The Village Manager is hereby authorized to accept any gift a) valued at $750 or
less and not likely to create any additional financial expense to the Village; or b)
as part of a fundraising program previously approved by a resolution of the Board
of Trustees.
All other donations of gifts to the Village shall be subject to the approval of a
majority of members of the Board of Trustees.
The Village Manager shall report any offer of a gift to the Board of Trustees in a
timely manner, so that the donor can be publicly thanked, or privately
acknowledged, by the Board of Trustees, as may be appropriate.

Agreement between Village of Briarcliff Manor and Community Housing Innovations
Regarding the Administration of the Affordable Income Housing Program
The Village Code of the Village of Briarcliff Manor (Village) includes an affordable income housing
provision designed to promote the development of housing for certain households, including
Village municipal employees and fire department employees. The Village Code imposes in
connection with the sale of affordable-income dwellings, maximum sales prices, minimum and
maximum occupancy requirements, financial eligibility standards, review procedures and
restrictions on resale prices, and authorizes additional safeguards including deed restrictions.
Two housing developments are currently subject to the affordable-income housing provision of
the Code; one is completed and occupied; the other is under construction. To date, Village staff
has qualified households and are monitoring long-term requirements, including re-sales.
The Village wishes to retain a consultant to administer its Affordable Income Housing Program,
Community Housing Innovations, Inc. (CHI), a not-for-profit organization, wishes to provide such
services. Over 1500 households participate in CHI’s Home Ownership Counseling & Education
Program each year. CHI is a HUD-Certified housing counseling agency. In addition, CHI has certified
counselors that provide counseling and education to homebuyers to support them as they navigate
the lengthy and at times challenging process of purchasing a home.
Community Housing Innovations proposes to provide the following specific services:
I. Secure Lender(s) Agreement to Provide Mortgage Financing for Deed Restricted Developments
It is the desire of the Village to restrict the sale of these units to the requirements of the
Affordable Income Housing Program. It does not wish to subordinate its deed restriction to that
of a lender's mortgage. CHI will work with one or more lenders and the secondary market, such
as Fannie Mae, to secure their agreement to make mortgage loans subject to the Village's deed
restriction. CHI will also assist these households to qualify for and secure mortgage loans with
reasonable terms and rates. CHI will work closely with the Village and developers in securing
these approvals.
II. Qualify Households
CHI will qualify prospective purchasers and renters of the affordable-income units. This will include
but will not be limited to determining their priority classification and reviewing income
documentation such as W-2s, tax returns, paystubs and bank statements.
In addition, CHI will administer the selection of the purchasers or renters whether it be a lottery, first
come-first served or other method. Complete records will be maintained by CHI.

CHI will notify households that do not qualify in writing. The household will be given an opportunity to
respond within a 30-day timeframe. Qualified households will also be given written notice.
III. Monitoring
CHI will monitor each affordable-income unit over time. Monitoring responsibilities will include but
will not be limited to the following:
Preparing and mailing affidavits on an annual basis to occupants of the affordable income
units to affirm that they continue to be residents of the units
Informing occupants of the affordable income units on an annual basis of the maximum sale
prices or rental prices that they can secure
Managing the re-sale process, i.e., informing the occupant as to the re-sale procedures and
qualifying subsequent purchasers or renters; and
Responding to questions that occupants of the Affordable-income units may have.
CHI will provide annual reports to the Village and as requested. The report will set forth the occupants
of the affordable-income units, their incomes, and any other information requested; it will include a
status report on housing in development. CHI will work closely with the Village on all aspects of the
Affordable Income Housing Program and others as requested by the Village. CHI will participate in
meetings as requested.
Budget
CHI will provide the above services on the following basis:
I. Secure Mortgage Financing for Deed Restricted Projects
Services in arranging to have financing available for deed-restricted units in a project will be provided as
needed on an hourly basis at rates in effect at the time of the service. The rate for May 1, 2022 to April
30, 2027 is $208/hour. Invoices will be submitted on a monthly basis.
II. Qualifying Households
Services will be billed on an hourly basis at rates in effect at the time of the service. The rate for May 1,
2022 to April 30, 2027 is $114/hour. The fee will be capped at $1,500 per unit.

III. Monitoring
This service will be provided on an as needed basis at an average hourly rate of $110/hr.
The hourly rates include salary and overhead, including but not limited to secretarial, telephone,
postage, reproduction and other expenses.
The agreement begins as May 1, 2022 and will continue until termination by either party with 30-day
notice.

• The dog park and trail permits are being worked on with the DEC.

• Dana Durso will be joining the Village Staff on April 25th.

duly adopted and filed with the Village Clerk; and
WHEREAS, it has been thereby determined that the sum of $20,340,806.02 will
be necessary to meet the obligations of the Village; and

WHEREAS, there has been duly credited as against said sum estimated
revenues and appropriated fund balance aggregating $7,322,424.11 leaving
$13,018,381.91 to be raised by the levying of taxes; and
WHEREAS, it appears from the Assessment Roll of the year 2021 for taxes for
the fiscal year June 1, 2022 that the total assessed valuation of real property in
the Village is $2,140,657,685 with $1,951,389,437 in the Town of Ossining
portion of the Village and $189,268,248 in the Town of Mt. Pleasant* portion of
the Village and said Assessment Rolls having been duly confirmed;
WHEREAS, the total transfers into the Library Fund from the General Fund is
$655,000.
NOW THEREFORE BE IT RESOLVED, that the tax rate for the Village of

hereby is fixed at the rate of $6.0815 on each $1,000 of assessed valuation for

upon the taxable property in the Village of Briarcliff Manor and that the Treasurer
be and she hereby is authorized and directed to extend and carry out upon the
roll the amount to be collected from each of the persons named thereon, and the
respective amounts of said tax roll against each such parcel of taxable property
set forth thereon be and the same hereby are levied upon each parcel of taxable

The Board thanked the Fire Department and all volunteers for their service to the
Village.
Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board
voted unanimously to approve the following resolution:
In the matter of approving the 2021 certified points
WHEREAS, the Village is the sponsor of a Length of Service Award Program
(LOSAP) on behalf of the Briarcliff Manor Fire Department in accordance with
Article 11-A of the New York State General Municipal Law (GML); and
WHEREAS, as required by GML § 219-a(2)(c), the Briarcliff Manor Fire
Department has submitted the attached list, certified under oath, of active
members of the Fire Department, indicating those volunteers who earned
at least fifty points during 2021 to qualify for service credit; and
WHEREAS, the certification made by the Fire Department includes a
statement that the points recorded on the attached list have been tabulated in
accordance with the Point System adopted by the Village to be in effect during
calendar year 2021, and to the best of the knowledge of the Fire Department,
is a true and accurate reflection of the activities performed by the active
members; and
WHEREAS, GML § 219-a(2)(d) requires the Board of Trustees (Board) to
review and approve the attached list, then return it to the Fire Department
to be posted for thirty days; and
WHEREAS, the Board has completed its review of the attached list;
NOW, THEREFORE BE IT RESOLVED, that the Board of Trustees approves
the attached list of volunteer firefighters of the Briarcliff Manor Fire
Department and the points earned by these firefighters during calendar year

Upon motion by Deputy Mayor Chatzky, seconded by Trustee Midgley, the Board
voted unanimously to approve the following resolution:
WHEREAS, Copley Court Condominium (1-67 Copley Court) instituted tax
certiorari proceedings pursuant to Article 7 of the Real Property Tax Law of the
State of New York; and
WHEREAS, the tax certiorari filings were for Town of Ossining assessment years
2016 through 2021; and
WHEREAS, the tax certiorari filings relate to Village of Briarcliff Manor fiscal
years 2017-2018 through 2021-2022; and assessment year 2021 is not yet active
for VBM bills
WHEREAS, a Consent Order of the Supreme Court of the State of New York,
County of Westchester, was entered on 3/4/22;
WHEREAS, the Consent Order was received after the finalization of the approval

Asbestos Cement Pipe Replacement Project Grant Application
Trustee Mallett suggested residents send letters of support as well.
Upon motion by Trustee Hunt, seconded by Trustee Mallett, the Board voted
unanimously to approve the following resolution:
WHEREAS the Village of Briarcliff Manor is requesting Community Project
Funding for construction and construction management of the Drinking Water
Asbestos Cement Pipe Replacement project; and
WHEREAS the Village strongly supports this project; and
WHEREAS project design has been completed with local funds and approved by
the Westchester County Department of Health; and
WHEREAS preliminary cost estimates total $950,000; and
WHEREAS Environmental Protection Agency State and Tribal Assistance Grants
require a minimum local match of 20% of project cost.
NOW THEREFORE BE IT RESOLVED that the Board of Trustees of the Village
of Briarcliff Manor hereby approves the project and, upon approval of the request
for Community Project Funding, commits to provide $190,000 in local funds for
the required match.

WHEREAS the Village received 1 (one) bids for Television Production Equipment
Project (VM-2122-1); and
NOW, THEREFORE, BE IT RESOLVED that the bid for Television Production
Equipment Project (VM-2122-1) is hereby awarded to Com Tech, Inc. per their
bid price of $22,325 and charged to H1230-201-15PEG.
BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and

assessed valuation for properties in the Village of Briarcliff Manor located in the Town of
Mt. Pleasant.
FURTHER RESOLVED, that the sum of $13,018,382 the same being taxes for the fiscal
year commencing June 1, 2022 be, and the same hereby is, levied upon the taxable
property in the Village of Briarcliff Manor and that the Treasurer be and she hereby is
authorized and directed to extend and carry out upon the roll the amount to be collected
from each of the persons named thereon, and the respective amounts of said tax roll
against each such parcel of taxable property set forth thereon be and the same hereby
are levied upon each parcel of taxable property respectively which said levy includes
items shown on the budget for the fiscal year commencing June 1, 2022 theretofore
adopted.
BE IT FURTHER RESOLVED, that the Board of Trustees does hereby authorize and
direct the Village Treasurer to place the delinquent water arrears on the tax roll for fiscal
year 2022-2023.

The Village lost two fixtures in the Village over the last week both of which gave
their time and dedication to the betterment of the Village.
Edward Nolan, Chairman of the Planning Board, since 2008, longtime resident of
the Village passed away suddenly. He’ll be missed greatly.
Nestor Lassic, 31 plus year employee of the Village, passed away while at work.
He was part of the DPW crew who work so hard for the Village and often go
unnoticed.
The Board remembered and recognized them for their service to the community
and held a moment of silence in their honor.

Board of Trustees Announcements
• The Briarcliff Manor Fire Department offered tips on Grilling Safety.
• A call for volunteers for various Boards and Committees. Letters of
interest are due by noon on May 13th.
• The press event on April 29th regarding Route 9A was a big success.
Thanks to the BOT, staff, first responders and residents for their support.
The Board gave a special thank you to Mayor Vescio for all his hard work
in getting this initiative to move forward.
• May 7th there will be a cleanup event at Pocantico Lake.
Acting Village Manager/Village Engineer’s Report
• Due diligence work is completed for 1050 Pleasantville Road.
• Grant monies are being sought for electric car charging stations.
• The dog park and trail permits are being worked on with the DEC.
• Village Engineer Turiano gave his annual Stormwater Management
Report detailing the six minimum control measures.
Committee Reports
Library Board:

• A screening of Wasted: The Story of Food Waste on April 29th was well
attended. Thanks to Trustee Mallett for participating at the event.
• The Library offers many programs to all age groups. Visit their website for
information.
• The Human Library was held April 30th and the Briarcliff Library was the
first Library to participate in Westchester County.
Recreation Advisory Committee:
• Dana Durso will be joining the Village Staff on April 25th.
• Spring programs are online.
• Registration for Camp has begun.
• The numerous Village trails are detailed on the Hiking Project App.
Beautification Committee:
• No report.

Acting Village Manager Turiano stated the Board deemed the application
complete.
LEAD AGENCY DETERMINATION
Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board
voted unanimously approve the following resolution:
BE IT RESOLVED that the Village of Briarcliff Manor Board of Trustees issues
this Notice of Intent for the purpose of determining lead agency pursuant to the
requirements of the State Environmental Quality Review Act (SEQRA) and Part
617 (6NYRR Part 617), the Statewide implementing regulations pertaining to
SEQRA. If no written objections are received the Village of Briarcliff Manor Board
of Trustees will assume lead agency 30 days after the date of this notice. This
notice has been prepared pursuant to Article 8 of the Environmental
Conservation Law.

Project Description: Yeshivath Viznitz Dkhal Torath Chaim (the “Applicant”) is
seeking a special permit from the Village of Briarcliff Manor Board of Trustees
pursuant to Village Code Chapter 220-6.J(1) places of worship, including parish
houses and religious school buildings to facilitate the reuse of and renovations to
existing structures located at 235 Elm Road (SBL: 98.19-2-11), Briarcliff Manor.
The Applicant is proposing to renovate certain existing buildings (i.e. Dining Hall
Building, Tead House, Valley Dorm, and the Dow Hall Southern Wing) for use as
a private religious education institution for approximately 250 male students
between the ages of 17 and 20. The Applicant anticipates that this occupancy will
grow by approximately 3% per year for the first 10 years of operation. This
growth rate results in the expected occupancy of up to 350 students and the use
of the New Dorm building by the end of the first 10 ten years of operation. In
addition, certain site improvements are proposed (i.e. repairing and re-striping
existing parking lots, removing and installing new signage, identifying ADA
parking and installing gates to control site access). The Applicant will also require
Site Plan Approval from the Planning Board.
