Village Board of Trustees Regular Meeting October 25, 2022 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held at the William J. Vescio Community Center on the 25th of October, 2022 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Rhea Mallett, Trustee Edward E. Midgley, Trustee Also Present Josh Ringel, Village Manager Josh Subin, Village Attorney Absent Christine Dennett, Village Clerk David Turiano, Village Engineer Pledge of Allegiance Continued Public Hearing to Amend Chapter 126, Fireworks Deputy Mayor Chatzky gave a synopsis of the proposed changes. There were no public comments. Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to close the public hearing. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Mallett, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the proposed local law to amend Chapter 126, Fireworks, is hereby adopted. Roll Call: Trustee Mallett Aye Trustee Midgley Aye 1 Trustee Hunt Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Board of Trustees Announcements • The Fire Department offered babysitter safety tips and encouraged residents to volunteer and join the Department. • A press conference was held with the County Executive and the Mayor highlighting all the things being done in Briarcliff Manor and the County Executive had really kind words regarding the Village’s leadership and the community overall. • The Board acknowledged the resignation of Robin Rizzo as Deputy Treasurer and thanked her for her major contributions in many roles to the Village over the last 20 plus years. • A letter was received from the DOT regarding fixing the guiderails on Route 9A and accelerating the corridor study to begin later this year. Village Manager • Robin Rizzo was very helpful to the Village Manager when he first stepped into his role. • The shredder event was extremely successful. • The Senior Bus is back in service. • The HVAC issues at the Library will soon be fully resolved. • An RFP for an ATM at Village Hall has been sent out. • A joint community outreach meeting with the Village Manager and Police Department is scheduled for November 4th at 5:15pm in Jackson Road Park. Village Engineer’s Report • The grant for Electric Vehicle Charging Stations is being submitted to the DEC. • The N. State Road Transite Pipe Bid is being finalized. • The Cross Access Easement is at 60% design drawings. • Taco Bell filed for their demo permit. • There are 5 pending Special Use Permits in various phases. The Village is waiting on information from the applicants. Committee Reports Library Board: • Visit their website for program information. • A Teen Manga Advisory Committee is being formed. • A local author will be giving a talk on November 19th. Recreation Advisory Committee: 2  • Many youth and adult programs are available. • Portraits in the Park. • Save the date for: o Ragamuffin Parade 10/29 o Rotary Fundraiser with the Harlem Magic 11/4 o Holiday Bonfire and Sing-a-long on 12/10 Other Committee Reports: • HAC’s next meeting is on October 27th at 7:30pm in Village Hall. Public Comments There were no public comments. Resolution to Support Climate Smart Communities Trustee Mallett and Deputy Mayor Chatzky explained the benefits to the program and stated a resident sent an email to the Board commending them for being forward thinking. Upon motion by Trustee Mallett, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: WHEREAS, the Village of Briarcliff Manor recognizes many communities within New York State are taking steps to promote environmentally sensitive initiatives; and WHEREAS, climate-smart programs could protect our infrastructure, economy and livelihoods; our farms, orchards, and ecological communities, including native fish and wildlife populations; curtail invasive species and exotic diseases; preserve clean drinking water supplies and recreational opportunities; and reduce health threats to our citizens; and WHEREAS, we believe the careful consideration of our environment when implementing legislation and government policies provides us with an unprecedented opportunity to save money, and to build livable, energy- independent and secure communities, vibrant innovation economies, healthy and safe schools, and resilient infrastructures; and WHEREAS, this Board of Trustees believes environmentally smart initiatives could be effected through sensible investments and policy changes that would reduce long-term costs to our local community, 3 IT IS HEREBY RESOLVED that the Village of Briarcliff Manor adopts the New York State Climate Smart Communities pledge, which comprises the following ten elements: 1) Build a climate-smart community. 2) Inventory emissions, set goals, and plan for climate action. 3) Decrease energy use. 4) Shift to clean, renewable energy. 5) Use climate-smart materials management. 6) Implement climate-smart land use. 7) Enhance community resilience to climate change. 8) Support a green innovation economy. 9) Inform and inspire the public. 10) Engage in an evolving process of climate action. Authorize Village Manager To Execute The Master Federal-Aid Local Project Agreement For Pin 8762.91, Village Of Briarcliff Manor Mobility Enhancement – Central Business District Village Of Briarcliff Manor, Westchester County Upon motion by Trustee Mallett, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution as amended: Authorizing the implementation, and funding in the first instance 100% of the federal-aid eligible costs, of a transportation federal-aid project, and appropriating funds therefore. WHEREAS, a Project for the Village of Briarcliff Manor Mobility Enhancements - Central Business District, Village of Briarcliff Manor, Westchester County, NY, PIN 8762.91 (the “Project") is eligible for funding under Title 23 U.S. Code, as amended, that calls for the apportionment of the costs such program to be borne at the ratio of 80% Federal funds and 20% non-federal funds; and WHEREAS, the Village of Briarcliff Manor desires to advance the Project by making a commitment of 100% of the non-federal share of the costs of the Right-of-Way (ROW) Incidental work. NOW, THEREFORE, the Briarcliff Manor Village Trustees, duly convened does hereby RESOLVE, that the Briarcliff Manor Village Trustees hereby approve the above subject project; and it is hereby further RESOLVED, that the Briarcliff Manor Village Trustees hereby authorizes the Village of Briarcliff Manor to pay in the first instance 100% of the federal and 4 non-federal share of the cost of the Right-of-Way (ROW) Incidental work for the Project or portions thereof; and it is further RESOLVED, that the sum of $5,000.00 is hereby appropriated from H1440.401.17218 and made available to cover the cost of participation in the above phase of the Project; and it is further RESOLVED, that in the event the full federal and non-federal share costs of the project exceeds the amount appropriated above, the Briarcliff Manor Village Trustees shall convene as soon as possible to appropriate said excess amount immediately upon the notification by the Village Manager thereof, and it is further RESOLVED, that the Village Manager of the Village of Briarcliff Manor be and is hereby authorized to execute all necessary Agreements, certifications or reimbursement requests for Federal Aid and/or applicable Marchiselli Aid on behalf of the Village of Briarcliff Manor with the New York State Department of Transportation in connection with the advancement or approval of the Project and providing for the administration of the Project and the municipality's first instance funding of project costs and permanent funding of the local share of federal-aid and state-aid eligible Project costs and all Project costs within appropriations therefore that are not so eligible, and it is further RESOLVED, that in addition to the Village Manager, the following municipal titles: Mayor, Village Engineer and Village Treasurer, are also hereby authorized to execute any necessary Agreements or certifications on behalf of the Municipality/Sponsor, with NYSDOT in connection with the advancement or approval of the project identified in the State/Local Agreement; RESOLVED, that a certified copy of this resolution be filed with the New York State Commissioner of Transportation by attaching it to any necessary Agreement in connection with the Project, and it is further RESOLVED, this Resolution shall take effect immediately. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Board of Trustees does hereby authorize the following budget transfers for FY 2021-2022: Inc: A0101.2680.IDA Insurance Recov-Prop.Dmg. IDA $74,557.46 A1989.425.IDA Insurance Recovery Expense IDA $74,557,46 6 Roll Call: Trustee Mallett Aye Trustee Midgley Aye Trustee Hunt Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Election Resolution for Annual Village Election 2023 Upon motion by Trustee Mallett, seconded by Trustee Hunt, the Board voted to approve the following resolution: BE IT RESOLVED that the annual Village Election will be held in the Village of Briarcliff Manor on Tuesday, March 21, 2023 between the hours of 6:00am and 9:00pm during which the polls will be open.
