Village Board of Trustees Regular Meeting March 5, 2024 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held at the William J. Vescio Community Center on the 5th of March, 2024 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Rhea Mallett, Trustee Malcolm Netburn, Trustee via Zoom Also Present Josh Ringel, Village Manager Christine Dennett, Village Clerk Joshua Subin, Village Attorney Pledge of Allegiance Continued Public Hearing to Amend Chapter 195, Taxation, to add a new Article VIII, Volunteer Firefighters and Ambulance Worker Exemption Trustee Hunt recused himself. Deputy Mayor Chatzky gave a brief synopsis of the proposed changes. There were no public comments. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Mallett, the Board voted unanimously to close the public hearing. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Mallett, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the proposed local law to amend a proposed local law to add a new Chapter 195, Taxation, Article VIII, Volunteer Firefighters and Ambulance Worker Exemption is hereby adopted. Thanks to all the groups for partnering.  Seasonal staff positions are available.  A senior trip to the Barnes Museum is coming up.  Recreation program information is available on the website.  Upcoming dates: o Spring registration begins March 11th o Camp registration is March 20th. Be sure to check your credentials to ensure access.  o Egg Hunt March 23rd. o Trivia March 1st. o Earth Day April 21st.  The Fire Department encouraged residents to volunteer and join the department.  The next Climate Smart Task Force meeting will be on March 13th.  An Interim Library Director is being hired. Village Manager’s Report  Ossining is doing their annual assessment data collection.  Shade structure options are being looked into for Law Park.  A pool director is needed.  Library Director recruitment is underway.  The Cleaning Bid will be on the next agenda.  An addendum to the fence bid delayed the bid by a week.  The EV charging stations will be installed in late spring/summer.  The lead service line study is being planned.  Con Ed is planning tree trimming. Public Comments There were no public comments. Authorize Village Manager to Execute a Professional Scope of Service Agreement with R.K. Hite & Co. Inc. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Mallett, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute a Professional Services Agreement with R.K. Hite & Co. Inc. for Right of Way Services as it pertains to the Mobility Project, PIN 8762.91 per the terms provided therein. Workplace Discrimination and Harassment Policy Upon motion by Deputy Mayor Chatzky, seconded by Trustee Mallett, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that Board of Trustees does hereby adopt the Workplace Discrimination and Harassment Policy. SEQRA Resolution – Mobility Enhancements – Central Business District Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution as amended: WHEREAS, the Board of Trustees of the Village of Briarcliff Manor, Westchester County, New York, is proposing a downtown streetscape improvement project, which responds to residents’ preferences for a biking- and pedestrian friendly downtown. The sidewalks will be widened with new curbs and pedestrian ramps; accommodated by a road diet to narrow the street pavement and reconfigure parking. Decorative streetlights, bike parking, benches and street furniture, tree replacements, and landscaping with native plants are included. The Project will create a sidewalk zone for outdoor dining and merchandising, as well as relaxation pods of benches and street trees to encourage pedestrian activity in the downtown. Raised crosswalks and LED lights promote sustainability and slow vehicular traffic (the “Proposed Action”); and WHEREAS, the Proposed Action is located in the Central Business District generally within and adjacent to Pleasantville Road, Delton Lane and North State Road and within certain parking lots on adjoining properties, as shown on a plan entitled “Overall Plan Briarcliff Mobility Enhancements”; and WHEREAS, the site of the Proposed Action does not contain any species of animal, or associated habitats, listed by the State or Federal government as threatened or endangered, per the New York State Department of Environmental Conservation (NYSDEC) “EAF Mapper”; and WHEREAS, the Village consulted with the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) who conducted a review of the proposed action in accordance with the New York State Historic Preservation Act of 1980 and based on this review, OPRHP, by letter dated June 28, 2023, determined no properties, including archeological and/or historic resources, listed in or eligible for the New York State and National Registers of Historic Places will be impacted by the Proposed Action; and WHEREAS, the Proposed Action will be predominantly funded through a State grant made available through the Federal Highway Administration and administered by the New York State Department of Transportation (NYSDOT); and WHEREAS, pursuant to 6 NYCRR Part 617 (“SEQR”) the Project is classified as Unlisted; and WEHERAS, the Board of Trustees of the Village of Briarcliff Manor has conducted an Uncoordinated Review of the Proposed Action under SEQR and is the Lead Agency for the SEQR review of this Unlisted Action; and WHEREAS, the Board of Trustees of the Village of Briarcliff Manor reviewed a Short Environmental Assessment Form (Short EAF) Parts 1, 2 and 3 dated March 5, 2024.  NOW THEREFORE BE IT RESOLVED, that pursuant to 6 NYCRR Part 617, State Environmental Quality Review, the Board of Trustees of the Village of Briarcliff Manor hereby confirms its Lead Agency designation for the SEQR Review of the Proposed Action. BE IT FURTHER RESOLVED, that pursuant to Part 617 of the implementing regulations pertaining to Article 8 (State Environmental Quality Review Act) of the Environmental Conservation Law, the Lead Agency has determined that the Proposed Action will not have a significant adverse effect on the environment for the reasons enumerated in the attached Negative Declaration Form (Short EAF Part 3). BE IT FINALLY RESOLVED that this SEQR Negative Declaration resolution shall have an effective date of March 5, 2024. BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the under 18 membership of Caroline Pastore to the Briarcliff Manor Fire Company. Schedule Public Hearings: Amend Chapter 124, Filming and Photography Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that a Public Hearing is hereby scheduled for the March 26, 2024 Board of Trustees meeting at 7:30pm at the William J. Vescio Community Center located at 1 Library Road, Briarcliff Manor, New York to hear and discuss a proposed local law to amend Chapter 124, Filming and Photography. Amend Chapter 90, Article V, Vacant Building Registry Upon motion by Trustee Netburn, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that a Public Hearing is hereby scheduled for the March 26, 2024 Board of Trustees meeting at 7:30pm at the William J. Vescio Community Center located at 1 Library Road, Briarcliff Manor, New York to hear and discuss a proposed local law to amend Chapter 90, Article V, Vacant Building Registry. Minutes Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, with abstentions by Mayor Vescio and Trustee Mallett, the Board voted to approve the minutes of the February 20, 2024 regular meeting. Youth Librarian Amy Kaplan is leaving the Village after more than two decades of service. Thanks to her and well wishes. Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to adjourn the regular meeting into an Executive Session to discuss pending litigation at 8:25pm and would not reconvene the regular meeting thereafter.
