Village Board of Trustees Regular Meeting April 16, 2024 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held at the William J. Vescio Community Center on the 16th of April, 2024 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Rhea Mallett, Trustee Malcolm Netburn, Trustee Also Present Josh Ringel, Village Manager Christine Dennett, Village Clerk Josh Subin, Village Attorney Kathryn Nivins, Village Treasurer Pledge of Allegiance Continued Public Hearings: Amend Chapter 124, Filming and Photography Deputy Mayor Chatzky explained the proposed changes. There were no public comments. Upon motion by Trustee Mallett, seconded by Deputy Mayor Chatzky, the Board voted unanimously to close the public hearing. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Mallett, the Board voted unanimously to approve the following resolution: SEQR NEGATIVE DECLARATION AMENDEMNTS TO VILLAGE CODE CHAPTER 124 WHEREAS, the Board of Trustees of the Village of Briarcliff Manor, Westchester County, New York, is proposing to amend Village Code Chapter 124. Filming and Photography to expand requirements related to the issuance of Type III permits and expanded submission requirements for permit applications (the “Proposed Action”); and WHEREAS, pursuant to 6 NYCRR Part 617 (“SEQR”) the Project is classified as an Unlisted Action; and WHEREAS, the Board of Trustees of the Village of Briarcliff Manor have conducted an Uncoordinated Review of the Proposed Action under SEQR and is the Lead Agency for the SEQR review of this Unlisted Action; and WHEREAS, the Board of Trustees of the Village of Briarcliff Manor reviewed a Short Environmental Assessment Form (Short EAF) Parts 1, 2 and 3 dated March 18, 2024. NOW THEREFORE BE IT RESOLVED, that pursuant to 6 NYCRR Part 617, State Environmental Quality Review, the Board of Trustees of the Village of Briarcliff Manor hereby confirms its Lead Agency designation for the SEQR Review of the Proposed Action. BE IT FURTHER RESOLVED, that pursuant to Part 617 of the implementing regulations pertaining to Article 8 (State Environmental Quality Review Act) of the Environmental Conservation Law, the Lead Agency has determined that the Proposed Action will not have a significant adverse effect on the environment for the reasons enumerated in the attached Negative Declaration Form (Short EAF Part 3). BE IT FINALLY RESOLVED that this SEQR Negative Declaration resolution shall have an effective date of April 16, 2024. LOCAL LAW ADOPTION BE IT RESOLVED that the proposed local law to amend Chapter 124, Filming and Photography is hereby adopted. Amend Chapter 90, Article V, Vacant Building Registry Deputy Mayor Chatzky explained the proposed changes. There were no public comments. Upon motion by Trustee Mallett, seconded by Trustee Netburn, the Board voted unanimously to adjourn the public hearing to May 7, 2024 at 7:30pm. Property Tax Levy in Excess of the Limit Established in General Municipal Law §3-c Village Manager Ringel explained the proposed local law. There were no public comments. Upon motion by Trustee Netburn, seconded by Deputy Mayor Chatzky, the Board voted unanimously to close the public hearing. Upon motion by Trustee Mallett, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the proposed local law authorizing a property tax levy in excess of the limit established in General Municipal Law §3-c is hereby adopted. Roll Call: Trustee Hunt Aye Trustee Mallett Aye Trustee Netburn Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Fiscal Year 2024-2025 Tentative Budget Village Manager Ringel along with Village Treasurer Nivins reviewed the Tentative Budget and any amendments made to the previous presentation. The Board thanked them for their time and thought put into the budget preparation. There were no public comments. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Mallett, the Board voted unanimously to close the public hearing. Board of Trustees Announcements  Upcoming dates: o Earth Day April 21st. o Summer Program and Pool Permits sales open on April 29th. o Fire Department Open House April 28th.  Thank you to Jenny Sendek for submitting and receiving a grant from NYSERDA in the amount of $5,000 on behalf of the Village.  Happy Birthday to Vinny D’Addona who is retiring from the Village after 36 years. Thank you for you service.  Seasonal positions are available.  A call for volunteers for Village Boards and Committees. Please submit letter of interest and resumes to BOT@briarcliffmanor.gov. Village Manager’s Report  The opening scene of the Fallout on Netflix takes place in Briarcliff Manor. Public Comments Mr. Karthik Nagaraja of 145 Schrade Road stated there were a number of sustainable ways to conserve water including rainwater harvesting. Eagle Scout Project Presentation Ryan Carpenito of Boy Scout Troop 12 reviewed his proposed project that had four components including an equipment drive, caged on-deck circle, storage shed and whiffle ball fundraiser. He stated he put the plan together with his grandfather who is an Engineer. The Board had general discussion regarding the project logistics and thanked Mr. Carpenito for his impressive scope of work. The Board directed the Village Manager and Village Counsel to effectuate documents necessary to get the project completed and asked the Building Inspector to review the plans. Mr. Matt Millstein of 17 Quinn Road stated he represented the Little League and they were in favor of the plan and would assist Mr. Carpenito as needed. He noted the Little League donated $50,000 worth of assets to the Village this year. Award of Bid – Fence Project Upon motion by Trustee Netburn, seconded by Trustee Mallett, the Board voted unanimously to approve the following resolution: WHEREAS the Village received 7 (seven) complete bids for the Village of Briarcliff Manor Fence Project (VM-2324-6B); and NOW, THEREFORE, BE IT RESOLVED that the bid for Village of Briarcliff Manor Fence Project (VM-2324-6B) is hereby awarded to WBE Fence Company per their bid price of $14,190; and BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and directed to execute a contract with WBE Fence Company for said project. Upon motion by Trustee Hunt, seconded by Trustee Mallett, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Emily Newfield to the Briarcliff Manor Hook and Ladder Company BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Jake Shemtob to the Briarcliff Manor Fire Company. Amend Master Fee Schedule – Filming Daily Rate Upon motion by Deputy Mayor Chatzky, seconded by Trustee Mallett, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Master Fee Schedule is hereby amended as follows: Film Permit Per Day or Any Portion Thereof Type 1 500 Type 2 2000 Type 3 3500 Roll Call: Trustee Hunt Aye Trustee Mallett Aye Trustee Netburn Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Minutes Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the minutes of the April 2, 2024 regular meeting and the April 2, 2024 Organizational Meeting as amended.
