Village Board of Trustees Regular Meeting October 15, 2024 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held at the William J. Vescio Community Center on the 15th of October, 2024 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Rhea Mallett, Trustee Malcolm Netburn, Trustee Also Present Josh Ringel, Village Manager Josh Subin, Village Attorney Christine Dennett, Village Clerk/Assistant Village Manager Brian Harkins, Recreation Advisory Committee Pledge of Allegiance Continued Public Hearing to Discuss a Local Law to Impose a Temporary Moratorium on Battery Energy Storage Systems Deputy Mayor Chatzky gave a brief synopsis of the proposed changes. There were no public comments. Upon motion by Trustee Netburn, seconded by Trustee Mallett, the Board voted unanimously to close the public hearing. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Mallett, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the proposed local law imposing a temporary moratorium on the acceptance, processing and approval of applications on Battery Energy Storage Systems (BESS) is hereby adopted. Continued Public Hearing to Amend Chapter 161, Property Maintenance Deputy Mayor Chatzky gave a brief synopsis of the proposed changes. There were no public comments. Upon motion by Trustee Netburn, seconded by Trustee Hunt, the Board voted unanimously to close the public hearing. Upon motion by Trustee Netburn, seconded by Trustee Mallett, the Board voted unanimously to approve the following: SEQR NEGATIVE DECLARATION AMENDMENTS TO VILLAGE CODE CHAPTER 161 WHEREAS, the Board of Trustees of the Village of Briarcliff Manor, Westchester County, New York, is proposing amendments to Village Code Chapter 161 Property Maintenance related to the ongoing maintenance of property located within the Village (the “Proposed Action”); and WHEREAS, pursuant to 6 NYCRR Part 617 (“SEQR”) the Project is classified as an Unlisted Action; and WHEREAS, the Board of Trustees of the Village of Briarcliff Manor have conducted an Uncoordinated Review of the Proposed Action under SEQR and is the Lead Agency for the SEQR review of this Unlisted Action; and WHEREAS, the Board of Trustees of the Village of Briarcliff Manor reviewed a Short Environmental Assessment Form (Short EAF) Parts 1, 2 and 3 dated September 20, 2024. NOW THEREFORE BE IT RESOLVED, that pursuant to 6 NYCRR Part 617, State Environmental Quality Review, the Board of Trustees of the Village of Briarcliff Manor hereby confirms its Lead Agency designation for the SEQR Review of the Proposed Action. BE IT FURTHER RESOLVED, that pursuant to Part 617 of the implementing regulations pertaining to Article 8 (State Environmental Quality Review Act) of the Environmental Conservation Law, the Lead Agency has determined that the Proposed Action will not have a significant adverse effect on the environment for the reasons enumerated in the attached Negative Declaration Form (Short EAF Part 3). BE IT FINALLY RESOLVED that this SEQR Negative Declaration resolution shall have an effective date of October 15, 2024. LOCAL LAW ADOPTION BE IT RESOLVED that the proposed local law to amend Chapter 161, Property Maintenance is hereby adopted. Board of Trustees Announcements   Welcome to Allie Herskovitz! She’s the newest member to join the Recreation team.  Fall Recreation Program Registration has begun.  Upcoming dates: o Window Painting 10/19 o Paint Night 10/16 o Ragamuffin Parade 10/26 o Portraits in the Park 10/27 o End of Daylight Savings 11/3 o Harlem Magic Masters 11/8 o Briarcliff Bash 11/23  Resident and Longtime Zoning Board of Appeals Member, John O’Leary was inducted into the Westchester County Senior Hall of Fame. Congratulations to him! Village Manager’s Report  The Library is seeking to hire a Children’s Librarian.  The lacrosse wall design has been finalized.  The playground equipment swap and installation will begin soon.  Jackson Park playground equipment has been ordered.  The Lead Service Project has been completed. No lead was found but further steps will need to be completed.  The High School is hosting a Community Service Fair tomorrow. Committee Reports – Recreation Advisory Committee Mr. Brian Harkins of the Recreation Advisory Committee gave an overview of the programs the Committee helped with over the past few years and discussed their future goals. The Board thanked the Committee for their hard work and dedication to the Village. Public Comments There were no public comments. Renaming of Locust Road Over Metro North Train Tracks (Scarborough Park) Upon motion by Trustee Hunt, seconded by Trustee Mallett, the Board voted unanimously to approve the following: WHEREAS, the health, safety, and welfare of the residents of the Briarcliff Manor is of paramount importance; and WHEREAS, accurate road names are essential for efficient 911 emergency response services and public safety; and WHEREAS, it has been determined that there is significant confusion arising from the use of the name "Locust Road" due to its similarity with other road names within the Briarcliff Manor, which could potentially delay emergency response times; and WHEREAS, the Village of Briarcliff Manor has reviewed the matter and consulted with local emergency services, and determined that renaming the road will improve clarity and response times; and WHEREAS, it is in the best interest of public safety to rename Locust Road (over the Metro North Train Tracks adjacent to parcels 104.07-1-14 and 104.07-1-5) to "Sunset Place"; and NOW, THEREFORE, BE IT RESOLVED, by the Board of Trustees of the Village of Briarcliff Manor, that: 1. Renaming of Road: The road currently known as "Locust Road" is hereby officially renamed to "Sunset Place." 2. Effective Date: This name change shall take effect on October 15, 2024 and all official documents, maps, and road signage shall be updated accordingly. 3. Notification: The Town of Ossining Assessor, Westchester County Engineer and County Clerk’s Offices, 911 dispatch, Village emergency services, the Post Office, NYSDOT, Metro North and any other relevant parties, shall be notified immediately of the renaming to ensure the transition is seamless. 4. Signage: New road signs reflecting the name "Sunset Place" shall be installed. 5. Implementation: The Village Manager is hereby authorized and directed to take all necessary actions to implement this resolution. Roll Call: Trustee Hunt Aye Trustee Mallett Aye Trustee Netburn Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Authorize Village Manager to Execute a Memorandum of Agreement with the Briarcliff Congregational Church Upon motion by Deputy Mayor Chatzky, seconded by Trustee Netburn, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute a memorandum of agreement with the Briarcliff Congregational Church to continue the Village use of parking facilities at 25 South State Road for Village sponsored events; and BE IT FURTHER RESOLVED the memorandum of agreement will go into effect upon Board approval for a period of fifty (50) years; and BE IT FURTHER RESOLVED that the Village Manager is hereby authorized to negotiate such modifications and revisions to the contract as may be in the Village’s interest. Schedule Public Hearing to Amend Chapter 207, Vehicles and Traffic Deputy Mayor Chatzky gave a brief overview of the proposed changes. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Mallett, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that a Public Hearing is hereby scheduled for the November 12, 2024 Board of Trustees meeting at 7:30pm at the William J. Vescio Community Center located at 1 Library Road, Briarcliff Manor, New York to hear and discuss a proposed local law to amend Chapter 207, Vehicles and Traffic. Fire Department Memberships Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution as amended: BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of John Valazquez to the Briarcliff Manor Fire Department. BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Nicole D’Amico to the Briarcliff Manor Fire Department.
