Village Board of Trustees Regular Meeting August 5, 2025 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held at the William J. Vescio Community Center on the 5th of August, 2025 commencing at 7:30 p.m. Present Peter S. Chatzky, Acting Mayor Kevin Hunt, Trustee Rhea Mallett, Trustee via Zoom Malcolm Netburn, Trustee Also Present Josh Ringel, Village Manager Christine Dennett, Village Clerk/Assistant Village Manager Kathryn Nivins, Village Treasurer Josh Subin, Village Attorney Absent Steven A. Vescio, Mayor Pledge of Allegiance Continued Public Hearing to Amend Chapter 45, Planning Board Acting Mayor Chatzky explained the proposed legislation. There were no public comments. Upon motion by Trustee Netburn, seconded by Hunt, the Board voted unanimously to close the public hearing. Upon motion by Trustee Hunt, seconded by Trustee Netburn, the Board voted unanimously to approve the following resolution: SEQR NEGATIVE DECLARATION AMENDMENTS TO VILLAGE CODE CHAPTER 45 WHEREAS, the Board of Trustees of the Village of Briarcliff Manor, Westchester County, New York, is proposing to amend Village Code Chapter 45 Planning Board to clarify the selection criteria for board members, clarify board member removal criteria and procedures, and to list actions falling under the board's review purview (the “Proposed Action”); and 1  WHEREAS, pursuant to 6 NYCRR Part 617 (“SEQR”) the Project is classified as an Unlisted Action; and WHEREAS, the Board of Trustees of the Village of Briarcliff Manor have conducted an Uncoordinated Review of the Proposed Action under SEQR and is the Lead Agency for the SEQR review of this Unlisted Action; and WHEREAS, the Board of Trustees referred the proposed Code amendments to the Planning Board and by letter dated June 24, 2025, the Planning Board provided a general letter of support on the proposed amendments; and WHEREAS, the Board of Trustees of the Village of Briarcliff Manor reviewed a Short Environmental Assessment Form (Short EAF) Parts 1, 2 and 3 dated August 5, 2025. NOW THEREFORE BE IT RESOLVED, that pursuant to 6 NYCRR Part 617, State Environmental Quality Review, the Board of Trustees of the Village of Briarcliff Manor hereby confirms its Lead Agency designation for the SEQR Review of the Proposed Action. BE IT FURTHER RESOLVED, that pursuant to Part 617 of the implementing regulations pertaining to Article 8 (State Environmental Quality Review Act) of the Environmental Conservation Law, the Lead Agency has determined that the Proposed Action will not have a significant adverse effect on the environment for the reasons enumerated in the attached Negative Declaration Form (Short EAF Part 3). BE IT FINALLY RESOLVED that this SEQR Negative Declaration resolution shall have an effective date of August 5, 2025. LOCAL LAW ADOPTION BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby adopts Local Law No. 4 of 2025, entitled “A Local Law to Amend Chapter 45, Planning Board, of the Code of the Village of Briarcliff Manor.” Continued Public Hearing to Amend Chapter 220-2, Definitions and 220-10, Affordable Housing Acting Mayor Chatzky explained the proposed legislation. 2 Mr. Adam Wekstein, Attorney representing 1230 Pleasantville Road LLC, stated he submitted a letter and his client had an application pending prior to the proposed amendments. He requested they be grandfathered in regarding Chapter 220-10, C, 3 stating pending Planning Board applications should be exempt. Upon motion by Trustee Netburn, seconded by Trustee Hunt, the Board voted unanimously to adjourn the public hearing to August 19, 2025. Board of Trustees Announcements  Camp ended for the season. Great job by the Recreation Department.  Please visit the website for information on all programs currently available.  The pool remains open until Labor Day.  The next Briarcliff Bash will be on August 10th at Scarborough Park.  A press conference with Senator Harckham for the CREST grant program was held today. Thanks to him for being a great partner to the Village. Village Manager’s Report  Earthquake safety tips went out in light of the recent events.  The Comprehensive Plan Visioning Statement is out for public input.  Great camp season. Special thanks to Karen and Allie.  Night work by Con Edison on Pleasantville Road next week.  Please wear high visibility clothing when walking or jogging at dawn, dusk or at night. Step off the road when cars approach and walk opposite of traffic. Committee Report  No report. Public Comments Mr. Bobby Nolan of AAA Towing stated his life was saved by the heroic actions of members of the Chappaqua Fire Department and New Castle Public Works Department when he was responding to an accident. He thanked the Board for recognizing their efforts along with the Gullotta House and also thanked the Police Department, commending them for their good work. Adoption of Computer System Security Breach Notification Policy Mr. Charles Blowe of Colby Lane asked if the proposed policy was for compliance or because there had been a data breach. Village Manager Ringel stated it was to comply with State law. Acting Mayor Chatzky stated the Village Manager did a great job of staying ahead of State requirements. 3 Upon motion by Trustee Hunt, seconded by Trustee Netburn, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby adopts Policy #303: Computer System Security Breach Notification Policy, dated August 5, 2025, consistent with New York State Technology Law § 208; and BE IT FURTHER RESOLVED, that the policy shall take effect immediately and be implemented by all relevant departments. Authorize Village Manager to Execute an Intermunicipal Agreement with Westchester County EV Charging Stations The Board thanked Westchester County for their contribution. Upon motion by Trustee Hunt, seconded by Trustee Netburn, the Board voted unanimously to approve the following resolution: WHEREAS, the County of Westchester has established a program to promote the installation of electric vehicle (EV) charging stations on municipally-owned property; and WHEREAS, the County has offered to reimburse the Village of Briarcliff Manor for a portion of the costs to design, purchase, and install EV charging stations at Village Hall and the Scarborough Train Station, as outlined in the proposed Intermunicipal Agreement (IMA); and WHEREAS, the Board of Trustees has reviewed the IMA and determined that participation in the County’s EV Charging Station Program is in the best interest of the Village; NOW, THEREFORE, BE IT RESOLVED that the Village Manager is hereby authorized to execute the Intermunicipal Agreement with the County of Westchester for the installation of EV charging stations, subject to review and approval by the Village Attorney and the Village’s insurance carrier. Authorize Village Manager to Execute an Intermunicipal Agreement with Westchester Prisoner Transportation Upon motion by Trustee Netburn, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: WHEREAS, pursuant to Sections 500-c and 500-d of the New York State Corrections Law, municipalities are responsible for transporting prisoners to and from the Westchester County Jail in Valhalla, New York; and 4 WHEREAS, the County of Westchester has proposed a Prisoner Transportation Agreement with the Village of Briarcliff Manor for the provision and reimbursement of such transportation services under a zone-based reimbursement structure; and WHEREAS, the Board of Trustees finds it in the best interest of the Village to enter into this agreement for the period of January 1, 2025 through December 31, 2026; NOW, THEREFORE, BE IT RESOLVED that the Village Manager is hereby authorized to execute the Prisoner Transportation Agreement with the County of Westchester, subject to review and approval by the Village Attorney and the Village’s insurance carrier. Upon motion by Trustee Hunt, seconded by Trustee Netburn, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Manuel Brea to the Briarcliff Manor Fire Department. Resolution Authorizing Associate Justice to Reside within Westchester County Upon motion by Trustee Netburn, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: WHEREAS, pursuant to New York State Village Law §3-300(2)(a), the Board of Trustees of a village may, by resolution, permit a person to hold certain appointive offices even if they reside outside of the village, provided they reside within the county in which the village is located; and WHEREAS, Howard Code currently serves as Associate Village Justice for the Village of Briarcliff Manor, and will soon reside outside of the Village but within the County of Westchester; and WHEREAS, the Board of Trustees finds that Howard Code has faithfully and competently discharged the duties of Associate Village Justice, and that it is in the best interest of the Village to permit his continued service; NOW, THEREFORE, BE IT RESOLVED, that pursuant to Village Law §3- 300(2)(a), the Board of Trustees of the Village of Briarcliff Manor hereby authorizes Howard Code to continue to serve as Associate Village Justice while residing outside the Village, provided he remains a resident of Westchester County, New York, for the remainder of his term to expire April 1, 2026; and BE IT FURTHER RESOLVED, that this resolution shall take effect immediately. Adjournment The Board wished a Happy Birthday to Jake Chatzky, David Mallett and Trustee Kevin Hunt. Charles Blowe sang a rousing rendition of Happy Birthday to Trustee Hunt. Upon motion by Trustee Netburn, seconded by Trustee Hunt, the Board voted unanimously to adjourn the Regular Meeting at 8:20pm.
