APRIL 20, 2023 TOWN COUNCIL REGULAR MEETING Thursday, April 20, 2023 at 7:00 PM Council Chambers – Bristol Municipal Complex and Via Zoom MINUTES Town Council President Jeff Beachy called the meeting to order at 7:00pm PLEDGE OF ALLEGIANCE - led by Cathy Burke. No planning and development items this evening. REPORTS TOWN MANAGER Review JPR recommendation from bids opened and award project. Ryan Anderson from JPR gave a bid recommendation based on the bids that were opened during the work session on Tuesday, April 18, 2023. Two bids were presented, one from C & E Excavating ($851,801.00) and the second from Niblock ($459,743.00). JPR is recommending Council award the Earthway Rail Park – Phase IV project to Niblock. Motion to accept the JPR recommendation for the Niblock bid was made by Cathy Burke, Seconded by Andrew Medford. Voting Yea: Doug DeSmith, Andrew Medford, Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries. This bid covers Stonemont South and North but there will be an additional amount of approximately $700K more for crossing arms and controls, along with installation. Council has publicly acknowledged receipt of the DLGF TIF Management report. The Clerk-Treasurer has no report this evening. Town Marshal Marshal Albin reviewed the police department operations report, call report and commented on the code enforcement dashboard report. 2023 Byrne JAG grant award This is federally funded through a grant process. Marshal Albin recognized Ashley Abbott, the police departments administrative assistant for her work on the grant. They were awarded $117,786.80 to be used towards the purchase of in-car radios and handheld portable radios. FIRE CHIEF Sadly a record March for calls Fire Chief Nik Kantz shared while reviewing his monthly operational report. Staffing- the department is still short one firefighter/EMT, but are currently filling that position with part-time staff. Public Safety Reminder: with the weather getting better, residents may start burning more. Please make sure that your are only burning organic materials. You can NOT burn trash, tires or plastic. Also, please make sure not to burn on a windy day and that you are  burning inside of a barrel or container. If you have questions on what you are allowed to burn or other burning related questions, please contact your local fire department personnel. PARK BOARD Dean Rentfrow shared the park board report this month. Hermance Park is still being remodeled. The floor is done, the bathrooms have to be completed. Congdon Park - new light has been installed to provide some night lighting for the kayak launch Cummins Park- concrete pads have been installed for the new benches The water has been turned on in all the parks. TOWN ATTORNEY Resolution to allow use of Just Compensation to acquire right of way easements for water and wastewater infrastructure improvements presented by legal counsel Alex Bowman. Resolution No 4-20-2023-11 approving the method for the determination of just compensation easement/value of property for acquisition JPR to negotiate with landowner Motion to adopt Resolution No. 4-20-2023-11 made by Cathy Burke, Seconded by Doug DeSmith. Voting Yea: Doug DeSmith, Andrew Medford, Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries. Resolution is adopted. First reading Ordinance 5-4-2023-8 Construction standards to include cross connection and backflow prevention Motion to approve the first reading of Ordinance 5-4-2023-9 was made by Andrew Medford, Seconded by Gregg Tuholski. Voting Yea: Doug DeSmith, Andrew Medford, Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries. Amend construction standards to address cross connections and backflow prevention devices. Resolution No. 4-20-2023-12 amending the construction and development standards Motion to approve Resolution No. 4-20-2023-12 was made by Cathy Burke, Seconded by Andrew Medford. Voting Yea: Doug DeSmith, Andrew Medford, Cathy Burke, Gregg Tuholski, Jeff Beachy. Resolution carries. NEW BUSINESS - no new business this evening. UNFINISHED BUSINESS List of unfinished business items: INDOT utility box wrap and the sale of surplus equipment (2002 F-350 dump truck with snowplow and salt box insert) a) INDOT box to be wrapped this summer. b) Surplus sale scheduled with Bartel & Company.
