Preceded by RDC meeting. PLEDGE OF ALLEGIANCE was led by Alex Bowman ROLL CALL: Council members present: Doug DeSmith, Andrew Medford, Cathy Burke, Gregg Tuholski and Jeff Beachy. Other members present: Town Manager Mike Yoder, Clerk-Treasurer Cathy Antonelli, Fire Chief Nik Kantz, Legal Counsel Alex Bowman and Town Marshal Mike Albin. APPROVAL OF AGENDA: Ken Jones Sr is postponing his visit and so removed from the agenda Town Attorney section - add Ordinance No 11/2/2023-26 APPROVAL OF INVOICES:  Motion to pay the invoices made by Doug DeSmith/Seconded by Andrew Medford. APPROVAL OF MINUTES:  Motion to approve the minutes from the previous meeting made by Cathy Burke;Seconded by Andrew Medford. PRIVILEGE OF THE FLOOR (AKA Public Comment) Denny Swartz of the Bristol Fire Dept asked if the Town could appeal to INDOT to raise the speed limit from 45 to 50 mph. It was explained that the limits were lowered when Stonemont Court was created, due to the engineering study and INDOT. REPORTS: TOWN MANAGER: Mike Yoder 2nd business sign quote for Commerce Drive $45,735.20 was presented. Discussion about design, if businesses would be asked to share the costs, naming ideas for various industrial parks to differentiate geographic locations, price on insert. Council agrees for Town Manager Mike Yoder to move forward with the discussed ideas and gather additional information. CLERK-TREASURER: Cathy Antonelli Adoption of Ordinance No. 10/19/2023-23 $80,000 additional appropriation (General Fund 1101-001- 316 Contractual Services) Notices for the public hearing had been sent out. Council President opens a public hearing to take public comment at 8:03pm. Hearing no comment, public hearing was closed. Jeff Beachy motions to adopt Ordinance No. 10/19/2023-23 Seconded by Cathy Burke. Voting Yea: Doug DeSmith, Andrew Medford, Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries. TOWN MARSHAL: Mike Albin Review of Operations report The department has accepted the resignation of Officer Cody Simon. His last day of employment with us will be 10.24.2023. He has accepted a position with the DeKalb County Sheriff’s office. This will leave the department four officers short and are actively looking to recruit. FIRE CHIEF: Nik Kantz Review of Operations report Ladder to be tested on October 31. Training facility has been painted. Thanks to the Council for the new facility. Toys for Tots collection has begun for Christmas. Fishing tournament fundraiser last Saturday, partnered with the TackleShack from Middlebury, raised $1400! Anyone may drop off a new unwrapped toy for the collection, or monetary donations to the BFD or Harding’s throughout the month of November. Chief thanked Town Manager Mike Yoder for bringing the Township and the Council together for discussion about the fire territory. Marshal Albin thanked Chief Kantz for the interdepartmental partnership. The Patchwork Quilt donated a quilt for the FD to raffle off and a bear donation as well. PARK BOARD: Park Board member Dean Rentfrow sitting in for Linda Powell this evening - Parks coordinator Kristen Ploegher working on grant for kayak launch and it is to be reviewed. It is to be ADA compliant. - New door system access on door at Hermance Park. The PDQ system is no longer working. - Ordered new park signs to remind people to clean up after their animals. - Considering an outdoor message board for Cummins and Congdon parks, as well as some banner flags/event flags, such as the long ones that can be found at Mancino’s. - Concrete work around splash pad, vandalized, working to try and grind some of the comments - Kristen working on the spook fest, civic theater helping - lamppole decorating contest (23 businesses signed up) Halloween and fall themes, cash prizes. - November working with Hardings and the HUB to help raise funds - Parks website hopefully to be up and running - St. Joseph St property – the house has been removed and leveled off, - the Community Garden has donated approximately 400lbs of food to the food pantry - the splash pad has been shut down for the season TOWN ATTORNEY: Alex Bowman Resolution No. 10/19/2023-24 approving the purchase of real property (RDC approved S. Main St property) and to adopt to include the purchase price of $150K as amended  Motion to adopt Resolution No. 10/19/2023-24 to adopt and include the purchase price of $150K and correct the address from 110 W Vistula to 110 E Vistula St made by Cathy Burke;Seconded by Andrew Medford. Ordinance No. 11/2/2023-26 HTIW petition for super voluntary annexation. Attorney Bowman gave an overview of the annexation petition (54567 SR 15 approximately 20 acres) . A public hearing notice was published as required by statute. A public hearing was opened at 8:25pm to take comment on the proposed Ordinance. Comments were taken from Denny Swartz (regarding industrial or residential) and Kathleen Beachy (explanation of M-2, which is for heavy manufacturing) Public meeting was then closed.  Motion to advance to second reading of Ordinance No. 11/2/2023-26 mad by Andrew Medford;Seconded by Dough DeSmith.
