MINUTES
CALL MEETING TO ORDER
Council President Jeff Beachy called the regular Council Meeting to order on Thursday, October 3, 2024 at
7:00pm.

Motion to approve invoices made by Doug DeSmith, Seconded by Gregg Tuholski.

APPROVAL OF MINUTES
Motion to approve the meeting minutes from 8.15.2024 & 9.5.2024 made by Doug DeSmith,
Seconded by Gregg Tuholski. Voting Yea: Doug DeSmith, Cathy Burke, Gregg Tuholski, Jeff Beachy.
Motion carries.
REPORTS
TOWN MANAGER Mike Yoder
Comprehensive financial plan update –
Mike introduced Amber Nielson of Baker Tilly, who joined via zoom, to review the five-year plan and the
3-Year Growth Levy Appeal petition and process. (2025 possible $246K)
Motion to approve the 3-year levy appeal petition made by Gregg Tuholski, Seconded by Doug
DeSmith. Voting Yea: Doug DeSmith, Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries.
Jeremy Hardy from Commonwealth Engineers gave an update on the wastewater treatment plant project.
SRF application #10 $21,000 Baker Tilly services
Motion to approve SRF disbursement application #10 to Baker Tilly in the amount of $21,000 made
by Cathy Burke, Seconded by Doug DeSmith. Voting Yea: Doug DeSmith, Cathy Burke, Gregg Tuholski,
Jeff Beachy. Motion carries.
SRF application #11 $12,245.92 Commonwealth Engineering
Motion to approve SRF disbursement application #11 to Commonwealth Engineering in the amount
of $12,245.92 made by Jeff Beachy, noted that SRF only deals in whole numbers so Jeff amended his
motion to approve $12,246, Seconded by Gregg Tuholski. Voting Yea: Doug DeSmith, Cathy Burke,
Gregg Tuholski, Jeff Beachy. Motion carries.
Change Order #1 net reduction of $277,020 for wastewater treatment plant project.
Motion to approve Change Order #1 $277,020 made by Cathy Burke , Seconded by Doug
DeSmith. Voting Yea: Doug DeSmith, Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries.
Contract discussion for new streetlights for the downtown area between stoplights quoted at $733,371 -
annual maintenance fees $7,620, 36 streetlights, 6 LED banners, wifi, and other options. This would be funded
from the General Obligation bond and about 65% from TIF funds. Council approves for Mike to continue to
check into this further. (
Motion to proceed with the lights made by Doug DeSmith, Seconded by Jeff Beachy. Legal Counsel
Alex Bowman notes a point of order on the motion that the request is to continue discussion on
lights to reach a final price. Discussion: Council member Gregg Tuholski asked if we could put ‘dumb’
lights in between some of the streetlights and save some money. Voting Yea: Doug DeSmith, Cathy
Burke, Gregg Tuholski, Jeff Beachy. Motion carries.
Mike is in the process of getting quotes from JPR and another engineer for developing zoning standards
overlay. Ken Jones asked if we want to consider a 20-yr annexation plan in addition to the zoning standards.
Council feels this may be a good idea since it hasn’t been done in the past and with our current growth, it
would be good preparation for what may be in the future.
Pay application #1 Contract A for NIBLOCK $117500 ($111,000 – Niblock with balance for retainage)
Motion to approve Niblock pay application no. 1 Contract A $117,500 made by Cathy Burke,
Seconded by Doug DeSmith. Voting Yea: Doug DeSmith, Cathy Burke, Gregg Tuholski, Jeff Beachy.
Motion carries.

Second reading and adoption of the 2025 budget $8,780,741 Ordinance 10-3-2024-3
Motion to approve the adoption of the 2025 budget $8,780,741 made by Cathy Burke, Seconded by
Doug DeSmith. Voting Yea: Doug DeSmith, Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries.
TOWN ATTORNEY Alex Bowman
Consider Resolution 10-3-2024- 9 A Resolution of the Town Council of the Town of Bristol, Indiana Approving
an Amending Declaratory Resolution of the Bristol Redevelopment Commission and Order of the Elkhart
County Plan Commission
Alex gave an overview of the Resolution and process, noting that the RDC has approved this and the
planning commission has stamped their approval as well.
Motion to adopt Resolution 10/3/2024-9 made by Gregg Tuholski, Seconded by Doug DeSmith.
Voting Yea: Doug DeSmith, Cathy Burke, Gregg Tuholski, Jeff Beachy. Motion carries.
PRIVILEGE OF THE FLOOR (Public Comments to Council)
- Maxine Foster, 105 County Road 104 – what is to happen with the property where the fire was?
Jeff Beachy addressed this and explained that a postcard is being mailed out to all Town residents to
ask for their ideas and recommendations of what they would like to see there. (restaurant, green space, etc)
The goal is to put out an RFP (Request for Proposal) for any businesses to respond to what they would like to
build there.
- Lester Otto, 18686 County Road 23 – now that Valmont has purchased the property across from my
house, can they clean it up? grass is growing, it’s getting weedy and concerns for property value.
Town Manager Mike Yoder said that this property is in the County, but he would make a call. Mike
also asked Lester if he was still feeling vibrations. Lester said yes.
