TOWN COUNCIL WORK SESSION Tuesday, April 16, 2024 at 7:00 PM Bristol Town Hall Council Chamber MINUTES CALL MEETING TO ORDER: Tuesday, April 16, 2024 the work session was called to order at 7:00pm by the Bristol Town Council President Jeff Beachy. PLEDGE OF ALLEGIANCE was led by Marshal Albin ROLL CALL: Council members present: Doug DeSmith, Dean Rentfrow, Cathy Burke, Gregg Tuholski, Jeff Beachy Others in attendance: Town Manager Mike Yoder, Clerk-Treasurer Cathy Antonelli, Legal Counsel Alex Bowman, Town Marshal Mike Albin, Fire Chief Nik Kantz APPROVAL OF AGENDA: Legal Counsel Alex Bowman noted the agenda items 7a and b show a public hearing shall be called, but he wanted Council to be aware that the statute does not require public hearings for these items. REPORTS - TOWN MANAGER Mike Yoder Accept new roadway and utility extension of Stonemont Ct and Rail Park Drive into the town inventory, adding a little over one mile to the Town’s inventory  Motion to approve the mileage addition to the Town’s inventory made by Greg Tuholski, Seconded by Dean Rentfrow. Voting Yea: Cathy Burke, Doug DeSmith, Greg Tuholski, Jeff Beachy, Dean Rentfrow. Motion carries. CLERK-TREASURER no items this evening. TOWN ATTORNEY Alex Bowman Ordinance No. 4/16/2024- 7 Amendment to Bristol Sewage works bond Legal Counsel Alex Bowman gave a brief overview of the second reading and recommended adoption of Ordinance No. 4/16/2024-7 Amending Ordinance No. 10-20-22B Titled an Ordinance of the Town of Bristol Authorizing the Issuance of Sewage Works Revenue Bonds for the Purpose of Providing Funds to Pay the Cost of Certain Additions, Extensions and Improvements to the Municipal Sewage Works of Said Town, Providing for the Safeguarding of the Interest of the Owners of Said Bonds, Other Matters Connected Therewith, Including the Issuance of notes in Anticipation of Bonds, and Repealing Ordinance Inconsistent Herewith. Alex noted again that a public hearing is not required by statute, but Council may open a hearing to hear public comments. Jeff Beachy opened a public meeting at 7:05p to take public comment on Ordinance No. 4/16/2024- 7. Hearing no comment, the public meeting was closed at 7:06p.  Motion to approve Ordinance No. 4/16/2024-7 on second reading made by Greg Tuholski, Seconded by Cathy Burke. Voting Yea: Cathy Burke, Doug DeSmith, Greg Tuholski, Jeff Beachy, Dean Rentfrow. Motion carries. Ordinance No. 4/16/2024- 8 Amendment to Bristol waterworks bond Legal counsel Alex Bowman gave a brief overview of the second reading and recommended adoption of Ordinance No. 4/16/2024-8 Amending Ordinance No. 10/20/22A Titled an Ordinance of the Town of Bristol Authorizing the Issuance of Waterworks Revenue Bonds for the Purpose of Providing Funds to Pay the Cost of Certain Additions, Extensions and Improvements to the Municipal Waterworks of Said Town, Providing for the Safeguarding of the Interests of the Owners of Said Bonds, Other Matters Connected Therewith, Including the Issuance of Notes in Anticipation of Bonds, and Repealing Ordinances Inconsistent Herewith. Alex noted again that a public hearing is not required by statute, but Council may open a hearing to hear public comments. Jeff Beachy opened a public meeting at 7:08p to take comment on Ordinance No. 4/16/2024-8. Hearing no comment, the public meeting was closed at 7:08p.  Motion to adopt Ordinance No. 4/16/2024-8 on second reading made by Doug DeSmith, Seconded by Greg Tuholski. Voting Yea: Cathy Burke, Doug DeSmith, Greg Tuholski, Jeff Beachy, Dean Rentfrow. Motion carries. Ordinance No. 4/16/2024-9 Water and Sewer Rates Legal Counsel Alex Bowman gave a brief overview of the second reading and recommended adoption of Ordinance No. 4/16/2024-9 Amending Chapters 51 and 52 of the Town of Bristol, Indiana Code of Ordinances Relating to Increases in Water and Sewer Utility Rates. Alex noted that a public hearing is necessary for this item and if approved, there will be a short (5 day) remonstrance period. Jeff Beachy opened a public hearing at 7:12p to hear public comment regarding the updated water and sewer rates. Hearing no comments, the publc hearing was closed at 7:12p. Motion to approve Ordinance No. 4/16/2024-9 on second reading made by Cathy Burke, Seconded by Doug DeSmith. Voting Yea: Cathy Burke, Doug DeSmith, Greg Tuholski, Jeff Beachy, Dean Rentfrow. Motion carries. NO QUESTIONS ABOUT THE UPCOMING COUNCIL MEETING AGENDA ITEMS OTHER COMMENTS OR QUESTIONS Town Manager Mike Yoder shared that the County recently passed an Ordinance for off-road vehicles and asked Council if they would consider a similar off-road vehicle ordinance. Resident Grant Privett approached the Council last year regarding the Council's interest. Marshal Albin spoke to the County ordinance for ORV(off road vehicle) He asked Council to consider the public safety when making a decision and noted that the operator does have to operate under the state law. Discussion followed. Council is in favor of moving forward with work on an Ordinance. Mike Yoder, Marshal Albin and Alex Bowman will work on a draft.
