MINUTES OF THE CITY OF BRISTOL, TENNESSEE CITY COUNCIL MEETING September 4, 2012 CALL TO ORDER: The City of Bristol, Tennessee City Council Meeting was called to order by Mayor Joel Staton on Tuesday, September 4, 2012, at 7:00 p.m. in the Slater Center Auditorium. ROLLCALL: Present: Mayor Joel Staton, Vice Mayor Ben Zandi, Councilwoman Michelle Dolan, Councilwoman Margaret Feierabend, and Councilman David Shumaker. Others Present: City Manager Jeff Broughton; City Attorney Jack Hyder; City Recorder Tara Musick; and members of City staff. INVOCATION AND PLEDGE OF ALLEGIANCE: Mayor Staton gave the invocation, and Councilman Shumaker led the pledge of allegiance. AGENDA ADDITIONS AND/OR CHANGES: An additional proclamation for Imagination Library Week was added to the agenda. PROCLAMATIONS AND RECOGNITIONS: Diaper Need Awareness Week - Councilwoman Feierabend read a proclamation designating September 10-17,2012, as Diaper Need Awareness Week. The proclamation was presented to Mr. Samuel Jones, Director of the Tri-Cities Diaper Ministry. YWCA Children's Center - 25 th Anniversary - Councilman Shumaker read a proclamation recognizing the 25 th Anniversary of the YWCA's Children's Center. The proclamation was presented to Ms. Kathy Waugh, Executive Director. Imagination Library Week - Vice Mayor Zandi read a proclamation designating the week of September 16-22,2012, as Imagination Library Week. This proclamation was requested by the Board of Directors of the Sullivan County Imagination Library. PRESENTATIONS: None.  City Council Meeting September 4,2012 Page 2 of 5 PUBLIC HEARINGS: Ordinance 12·10 - An Ordinance to Amend Section 216,D.2 of the Zoning Ordinance Relating to Temporary Signs City Manager Broughton reviewed this ordinance that amends section 216.D.2 of the Zoning Ordinance regarding temporary signs. This amendment establishes new provisions for special signage for a new business grand opening or re-opening of an existing business. This amendment will allow all signage and devices for a period of 30 consecutive days surrounding a business opening and re-opening. For the purposes of this ordinance a "re-opening" is defined as construction of a significant real property improvement as evidenced by the issuance of a building permit. APPEARANCE OF CITIZENS: None. APPOINTMENTS: A. Industrial Development Board - David Hyde, Rob Nicar, and Mark Byington were appointed to the Industrial Development Board for a six-year term ending August 31, 2018, by a unanimous vote. B. Parks and Recreation Commission • Chris Connally was appointed to the Parks and Recreation Commission for a three-year term ending June 30, 2015, by a unanimous vote. ORDINANCES AND RESOLUTIONS: A. First Reading of New Ordinances: I. Ordinance 12·11· An Ordinance to Amend the Appropriation of Funds and Budget for the Fiscal Year July 1, 2011 through June 30, 2012 City Manager Broughton reviewed this Ordinance, which increases appropriations to the General Fund of $785,000. City Manager Broughton identified some of the major causes for the increase including the treatment of TIF disbursements, insurance proceeds, and others. Councilwoman Feierabend moved to approve the ordinance on first reading, and Councilman Shumaker seconded. The motion passed by unanimous roll call vote. 2. Ordinance 12·12 - An Ordinance to Amend the Zoning Map of Bristol Tennessee by Designating Certain Properties as B.3, General Business District (Volunteer Parkway)  City Council Meeting September 4,2012 Page 3 of5 City Manager Broughton reviewed this Ordinance, which rezones property at 960, 974, 1000, 1020, 1030, and 1102 Volunteer Parkway from M-I and B-IA to B-3, General Business District. Councilman Shumaker moved to approve the ordinance on first reading, and Vice Mayor Zandi seconded. The motion passed by unanimous roll call vote. 3. Ordinance 12-12 - An Ordinance to Amend the Zoning Map of Bristol Tennessee by Designating Certain Properties as B-3, General Business District (Volunteer Parkway) City Manager Broughton reviewed this Ordinance, which rezones property at 960, 974, 1000, 1020, 1030, and 1102 Volunteer Parkway from M-I and B-IA to B-3, General Business District. Councilman Shumaker moved to approve the ordinance on first reading, and Vice Mayor Zandi seconded. The motion passed by unanimous roll call vote. 3. Ordinance 12-13 - An Ordinance to Amend the Zoning Map of Bristol Tennessee by Designating Certain Properties as PRD, Planned Residential District (120 Maple Tree Drive) City Manager Broughton reviewed this Ordinance, which rezones a five acre parcel at 120 Maple Tree Drive from RI-A and M-I to PRD, Planned Residential District. Vice Mayor Zandi moved to approve the ordinance for first reading, and Councilwoman Dolan seconded. The motion passed by unanimous roll call vote. B. Adoption of Ordinances (Second Reading): Ordinance 12-9 • An Ordinance to Repeal Ordinance 11-25 Relating to Synthetic Drugs. City Manager Broughton reviewed this Ordinance, which repeals Ordinance 11-25 relating to synthetic drugs. The action was recommended due to the enactment of statewide legislation by the Tennessee General Assembly this past legislative session regulating synthetic drugs. Vice Mayor Zandi moved to approve the ordinance on second reading, and Councilwoman Feierabend seconded. The ordinance passed by unanimous roll call vote. Ordinance 12-10 • An Ordinance to Amend Section 216.D.2 of the Zoning Ordinance Relating to Temporary Signs Reviewed as part of the public hearing portion of the agenda by City Manager Broughton, Vice Mayor Zandi moved to approve the ordinance amending Section 216.D.2 of the Zoning Ordinance relating to temporary signs on second reading, and Councilwoman Dolan seconded. Resolution 12-91 - A Resolution Authorizing the Use of City Property for the Sale of Beer During the 2012 Rhythm and Roots Reunion City Manager Broughton reviewed this resolution which allows the sale of beer on City property during the 2012 Rhythm and Roots Reunion. Permission to use this property is requested by Statice Inc., doing business as Machiavelli's restaurant located at 85 th Street. They desire to use a small grassy area of city owned property, located across the street from their restaurant, as part of a tented music venue which will include the sale of beer under a temporary permit previously issued by the Beer Board. Councilwoman Feierabend moved to approve the resolution, and Councilman Shumaker seconded. The resolution passed by unanimous roll call vote. CONSENT AGENDA: City Manager Broughton presented the Consent Agenda to Council. Councilwoman Dolan requested Resolution 12-84 be removed from the Consent Agenda. Councilwoman Feierabend moved to approve, and Councilman Shumaker seconded. The following items were approved by unanimous Council vote: • Minutes - August 7, 2012, City Council Meeting; • Minutes - August 21, 2012, City Council Work Session; • Resolution 12-85 - A Resolution Approving Agreement with the Federal Transit Administration for Transit Operating Assistance; • Resolution 12-86 - A Resolution Approving a Grant Agreement with the Tennessee Department of Transportation for Transit Operating Assistance; • Resolution 12·87 - A Resolution Designating the Official Zoning Map of Bristol Tennessee as of September 1,2012; • Resolution 12-89 - A Resolution Awarding a Bid for the Purchase of a SCADA System; • Resolution 12-90 - A Resolution Authorizing Payment of a Public Water System Maintenance Fee; • Resolution 12-92 - A Resolution Authorizing Participation in the TML Risk Management Pool Driver Safety Grant Program; • Resolution 12-93 - A Resolution Authorizing the Purchase of an Access Control System;  City Council Meeting September 4, 2012 Page 5 of 5 • Resolution 12-94 - A Resolution Awarding Bids for Roof Replacements; and • Resolution 12-95 - A Resolution Authorizing Disbursement of Insurance Proceeds for Damages to H.P. King Building. Considered separately was: • Resolution 12-84 A Resolution Selling a Business Special Promotional Event Application Fee. City Manager Broughton reviewed this item which will lower the application fee for a business special promotional event. The current fee of $50.00 per event would change to no charge for the first and second event, and $25.00 per event for the third, fourth, fifth, and sixth event. Councilwoman Dolan moved to approve, and Vice Mayor Zandi seconded. The resolution passed by unanimous roll call vote. CITY MANAGER'S REPORT: City Manager Broughton recognized and welcomed new Chamber of Commerce CEO, Joy Madison. He discussed the announcement made on August 31, 2012, that U.S. Solutions would be moving into the Touchtone Wireless building on West State Street creating new jobs for our region. The ground breaking at Bass Pro Shops located at the Pinnacle Center at Exit 74 was also mentioned. CITY COU CIL COMME TS: Director of Schools Dr. Gary Lilly gave special recognition to Avoca Elementary who received a designation as a rewards school from the State. The school was recognized as the top 5% in both achievement and student growth. Dr. Lilly also mentioned the Fortify the Castle campaign.
