MINUTES OF THE CITY OF BRISTOL, TENNESSEE CITY COUNCIL MEETING December 4, 2012 CALL TO ORDER: The City of Bristol, Tennessee City Council Meeting was called to order by Mayor Joel Staton on Tuesday, December 4, 2012, at 7:00p.m. in the Slater Center Auditorium. ROLLCALL: Present: Mayor Joel Staton, Vice-Mayor Ben Zandi, Councilwoman Michelle Dolan, Councilwoman Margaret Feierabend, and Councilman David Shumaker. Others Present: City Manager Jeff Broughton; City Attorney Jack Hyder; City Recorder Tara Musick; and members of City staff. INVOCATION AND PLEDGE OF ALLEGIANCE: Mayor Joel Staton gave the invocation, and Councilman David Shumaker led the pledge of allegiance. AGENDA ADDITIONS AND/OR CHANGES: None. PROCLAMATIONS AND RECOGNITIONS: Citizens Municipal Academy - The fifteen graduates of the fall Citizen's Municipal Academy were recognized for their participation. The following graduates successfully completed the six- week course and earned their certification: Richard Allison, Dale Carrick, Sara Carrick, Jennifer Carrier-Berkley, John Cartwright, Chris Connally, Tammy Connally, Charlotte Duncan, Julian Hernandez, Kenny Hopkins, Kathe Rainwater, Robert Rainwater, David Ring, Joshua Shaffer, and Mary Lou Sproles. Certificate of Achievement for Excellence in Financial Reporting - Tara Musick, Director of Finance, for the City of Bristol, Tennessee was recognized for the City's receipt of the Certificate of Achievement for Excellence in Financial Reporting from the Government Finance Officers' Association (GFOA). This award is the highest honor to be received in governmental accounting. This is the ninth consecutive year that the City of Bristol, Tennessee has received this award. Mayor Joel Staton presented the award to Ms. Musick. PRESENTATIONS: None.  City Council Meeting December 4, 2012 Page 2 of6 PUBLIC HEARINGS: Ordinance 12-16 - An Ordinance to Amend Section 404.2 of the Zoning Ordinance Relating to Uses Allowed Under Special Use Permit in the B-3 General Business District. City Manager Broughton reviewed this Ordinance, which would amend section 404.2 of the Zoning Ordinance regarding the warehouse use group classification in the B-3 District. This amendment will replace warehouse use group 23622 with warehouse use group 531130 which reflects the use code rather than an occupation or construction activity code. Land Use Plan and Policy Update City Manager Broughton asked Ms. Shari Brown, Director of Community Development, to review the updated Land Use Plan and Policy. Ms. Brown explained that the Land Use Plan and Policy serves as the general regional guide for the physical development of the City and Urban Growth Boundary. She also explained that the update incorporates new data, land use components of other documents, as well as an updated communications plan. This plan was formally approved by the Plarming Commission at their November 19, 2012, meeting and a resolution adopting the plan will be placed on the January 2013 meeting for approval. APPEARANCE OF CITIZENS: None. APPOINTMENTS: A. Library Board - Rita Hawkins and Julian Hernandez were unanimously appointed to the Library Board with Ms. Hawkins randomly selected to serve a three-year term of office ending December 31, 2015 and Mr. Hernandez a two-year term ending December 31,2014. ORDINANCES AND RESOLUTIONS: A. First Reading of New Ordinances: Ordinance 12-17 - An Ordinance to Amend Section 407 of the Zoning Ordinance Relating to the Planned Development Area Overlay. City Manager Broughton reviewed this Ordinance, which would amend section 407 of the Zoning Ordinance regarding Plarmed Development Area Overlay. The Ordinance would expand the eastern boundary of the central business district overlay area to include the east side of Martin Luther King Jr. Boulevard. Councilman Shumaker moved to approve the Ordinance on first reading, and Councilwoman Feierabend seconded. The motion passed by unanimous roll call vote.  City Council Meeting December 4, 2012 Page 3 of6 Ordinance 12-18- An Ordinance to Abandon an Unnamed Public Alley Right-of-Way (Between 316 and 320 71h Street). City Manager Broughton reviewed this Ordinance, which would abandon an unnamed alley located between 316 and 320 7th Street. The City will retain a utility and stormwater easement in the area being abandoned. Councilwoman Feierabend moved to approve the Ordinance on first reading, and Councilwoman Dolan seconded. The motion passed by unanimous roll call vote. Ordinance 12-19 -An Ordinance to Abandon a Portion of Bristol West Boulevard and to Accept the Dedication of Property for Use as Public Street Right-of-Way City Manager Broughton reviewed this Ordinance, which would abandon a portion of Bristol West Boulevard in accordance with the planning of The Pinnacle destination retail center. The northernmost portion of Bristol West Boulevard is being abandoned for the roadway to be realigned in conjunction with the overall plan of development. Vice-Mayor Zandi moved to approve the Ordinance on first reading, and Councilman Shumaker seconded. The motion passed by unanimous roll call vote. Ordinance 12-20 - An Ordinance to Amend the Zoning Map of Bristol Tennessee by Designating Certain Property as PBD, Planned Business District (The Pinnacle). City Manager Broughton reviewed this Ordinance, which would amend the Zoning Map for 296 acres located at the northeast intersection of U.S. 11 Wand Interstate 81. Currently the property is classified as R-2, M-2, and B-3 and would be rezoned to PBD, Planned Business District. Vice-Mayor Zandi moved to approve the Ordinance on first reading, and Councilwoman Feierabend seconded. The motion passed by unanimous roll call vote. B. Adoption of Ordinances (Second Reading): Ordinance 12-16 - An Ordinance to Amend Section 404.2 of the Zoning Ordinance Relating to Uses Allowed Under Special Use Permit in the B-3 General Business District. City Manager Broughton reviewed this Ordinance as part of the public hearing. The City Manager explained that the amendment will update an incorrect group code that was originally passed. Councilwoman Feierabend moved to approve the Ordinance on second reading, and Councilman Shumaker seconded. Resolutions: Resolution 12-114- A Resolution Requesting the Sullivan County Election Commission to Hold a General City Election for the City of Bristol in 2013. City Manager Broughton reviewed this Resolution that will authorize a request for the Sullivan County Election Commission to hold a general City election for the City of Bristol, Tennessee in May 2013. The offices to be placed on the ballot are the East District, South District, and West District for City Council and the East District, South District, and West District for the Board of Education. Vice-Mayor Zandi moved to approve this Resolution, and Councilman Shumaker seconded. This motion passed by unanimous roll call vote. Resolution 12-121 - A Resolution Authorizing the Purchase of a Police Wireless Field Reporting Software. City Manager Broughton reviewed this Resolution that will authorize the purchase of a police field reporting software system from Data Driven LLC for $154,540. City Manager The purchase will be paid with grant funds. Vice-Mayor Zandi moved to approve this Resolution, and Councilman Shumaker seconded. The motion passed by unanimous roll call vote. Resolution 12-125 - A Resolution Authorizing the Purchase of Automated Meter Reading Equipment City Manager Broughton reviewed this Resolution that will authorize the purchase of items to initiate Phase I of the automated meter reading system project. Included in the purchase are 2,500 meter box transmitters and connector cables, 2 drive-by receivers, and associated computer hardware and software from the MARS Company in the amount of $233,610. Include in the purchase from United Utilities are 2,500 encoded water meter registers and associated hardware in the amount of$141,250. In response to a question from Councilman Shumaker, Deputy City Manager Bill Sorah indicated that no person would be furloughed as a result of the implementation of this system. Councilman Shumaker moved to approve this Resolution, and Councilwoman Feierabend seconded. The motion passed by unanimous roll call vote. CONSENT AGENDA: City Manager Broughton presented the Consent Agenda to Council. Councilwoman Feierabend moved to approve, and Vice-Mayor Zandi seconded. The following items were approved by unanimous Council vote: • Minutes- November 6, 2012, City Council Meeting; • Minutes - November 20, 2012, City Council Work Session;  City Council Meeting December 4, 2012 Page 5 of6 • Resolution 12-115 - A Resolution Amending the Rules and Procedures of the City Council Regarding Appointments; • Resolution 12-116- A Resolution Awarding Bid for the Purchase of Bulk Concrete Products; • Resolution 12-117 - A Resolution Awarding Bid for the Purchase of Fire Turnout Gear; • Resolution 12-118 -A Resolution Endorsing the Joint Legislative Policy of the Tri- Cities for the 2013 Session of the Tennessee General Assembly; • Resolution 12-119 - A Resolution Authorizing the Submittal of an Application for Grant Funding under the Safe Routes to School Program; • Resolution 12-120 - A Resolution Approving a Grant Agreement with the Federal Transit Administration for Transit Operating Assistance; • Resolution 12-122- A Resolution Authorizing Repair of a High-Service Pump; • Resolution 12-123 - A Resolution Awarding Bid for the Purchase of a Knuckleboom Trash Loader; and • Resolution 12-124- A Resolution Approving the Sale of Surplus Real Property. CITY MANAGER'S REPORT: City Manager Broughton reviewed the 2013 meeting schedule and asked for approval as presented. The schedule was approved unanimously by a roll call vote. CITY COUNCIL COMMENTS: Mayor Joel Staton recognized Joy Madison, CEO of the Chamber of Commerce, who reminded everyone to attend the Christmas parade. Dr. Gary Lilly was also recognized and spoke briefly about Anderson Elementary and the two- year $200,000 dollar grant that they received. Dr. Lilly also recognized Avoca Elementary for their designation as an award school, and Hope Malone for her participation in an ambassador program. Dr. Lilly also stated that Haynesfield Elementary, Holston View Elementary, Tennessee High School, and Vance Middle School were on the cusp of the being award schools.  City Council Meeting December 4, 2012 Page 6 of6 Councilwoman Feierabend recognized Pastor Charlie Murphy of Windsor Avenue Presbyterian Church on his retirement. Councilwoman Feierabend also announced her candidacy for City Council in the 2013 election as a representative for the South District. Councilman Shumaker announced his candidacy for City Council in the 2013 election as a representative of the West District. Mayor Staton spoke briefly about the Council's attendance at a recent conference and his realization that Bristol is ahead of the curve. He also announced his candidacy for City Council in the 2013 election as a representative for the East District.
