MINUTES OF THE CITY OF BRISTOL, TENNESSEE CITY COUNCIL MEETING June 4,2013 CALL TO ORDER: The City of Bristol, Tennessee City Council meeting was called to order by Mayor Joel Staton on Tuesday, June 4,2013, at 6:59 p.m. in the Slater Center Auditorium. ROLL CALL: Present: Mayor Joel Staton, Vice Mayor Ben Zandi, Councilwoman Michelle Dolan, Councilwoman Margaret Feierabend, and Councilman David Shumaker. Others Present: City Manager Jeff Broughton; City Attorney Jack Hyder; City Recorder Tara Musick; Secretary Megahn Eads; and mernbers of City staff. INVOCATION AND PLEDGE OF' ALLEGIANCE: Mayor Joel Staton gave the invocation, and also led the pledge of allegiance. AGENDA ADDITIONS AND/OR CHANGES: City Manager Broughton added a proclamation designating June as National Home Ownership Month. PROCLAMATIONS AND RECOGNITIONS: National Home Ownership Month - Councilman Shumaker read a proclamation recognizing June as National Home Ownership Month. The proclamation was presented to Shari Brown, Community Development Director. PRESENTATIONS: City Council Presentations - Plaques were presented to Mayor Staton and Councilman Shumaker in recognition of their years of service on the City Council. Mayor Staton presented the plaque of recognition to Councilman Shumaker and Councilwoman Feierabend presented the plaque of recognition to Mayor Staton.  City Council Meeting June 4,2013 Page2 of 6 PUBLIC HEARINGS: Ordinance 13-3 - An Ordinance to Amend the Appropriation of Funds and Budget for the Fiscal Year July 1,2012 through June 30,2013. City Manager Broughton reviewed the Ordinance that will amend the current budget. City Manager Broughton explained that this is a routine activity. The current budget is being adjusted to reflect spending requirements that were not anticipated. Seven city funds and two school funds require an adjustment. City Manager Broughton also noted that timing is generally the reason for an amendment. APPEARANCE OF CITIZENS: Mr. Tom Highball, 716 Bluff City Highway, addressed the Council on several matters including the proposed budget. Mr. Jerry Miller, 98 Holston View Drive, addressed Council regarding his interest that the Avoca Branch Library not be closed. Ms. Christina Blevins, Executive Director of Believe in Bristol, addressed Council about the services provided by BIB. Mr. John Rainero, Birthplace of Country Music Chairperson, addressed Council on the role that the Birthplace of Country Music plays in enhancing the local economy. Audrey Jackson, 306 Linville Road, addressed Council regarding her interest that the Avoca Branch Library not be closed. . 'Wayne Cheney, 224 Greenway Road, addressed Council on the impending tax increase. Judd Bany, Executive Director of Bristol Public Library, addressed Council conceming the importance of maintaining the Avoca Library Branch. Earl Nelson, Tennessee Hills, addressed Council regarding his interest that the Avoca Branch Library not be closed. Ed Harlow, Bristol Virginia City Council Member, thanked Mayor Staton, Councilman Shumaker, and City Manager Broughton for their service to the City. Don Ashley, Bristol Virginia City Council Member, addressed Council requesting their cndorsement of a Tennessee Ernie Ford postage stamp. Lisa Cofer, Executive Director of United Way of Bristol, thanked the Council for their support of the United Way over the years.  City Council Meeting June 4,2013 Page 3 of6 Don Melton, 116 St. James Place, addressed Council regarding his interest that the Avoca Branch Library not be closed. Michelle Knight addressed the Council regarding her interest that the Avoca Branch Library not be closed. Kimberly Leonard, Senior Director of the Bristol Convention and Visitors Bureau, addressed Council conceming the economic impact of her organization. Lynn Heller, 149 Lick Meadow Road, addressed Council regarding her interest that the Avoca Branch Library not be closed. Vicie Dotson, Celebrate Bristol.Committee, notified Council of the upcoming Star Spangled Bristol event io be held on July 4th. Clifford Cox, Bluff City, Tennessee, addressed Council regarding his interest that the Avoca Branch Library not be closed. APPOINTMENTS: None ORDINANCES AND RESOLUTIONS: A. First Reading of New Ordinances: Ordinance 13-4 - An Ordinance to Abandon a Portion of Bristol West Boulevard and to Accept the Dedication for Use as a Public Street Right-of-Way. City Manager Broughton reviewed this Ordinance, which will abandon a portion of Bristol V/est Boulevard and accept its dedication for use as a public street right-oÊway. Mr. Broughton stated that this action will facilitate more productive use of the property. Councilman Shumaker moved to approve the Ordinance on first reading, and Vice-Mayor Zandi seconded. The motion passed by unanimous roll call vote. B. Adoption of Ordinances (Second Reading): Ordinance 13-1 - An Ordinance to Levy a Privilege Tax on Litigation in the Municipal Court. City Manager Broughton reviewed this Ordinance, which will adopt a privilege tax of $13.75 on litigation in the Municipal Court. This tax will only be applied to those found guilty. It is expected that this tax would bring in an estimated revenue of $45,000. Councilman  City Council Meeting June 4,2013 Page 4 of6 Shumaker moved to approve the Ordinance on second reading and Vice-Mayor Zandi seconded. Ordinance 13-3 - An Ordinance to Amend the Appropriation of X'unds and Budget for the Fiscal Year July 1, 2012 through June 30,2013. City Manager Broughton reviewed this Ordinance, which was the subject of the public hearing that would amend the current budgets of nine funds to reflect the projected amounts in excess of that originally budgeted. Councilwoman Feierabend movèd to approve the Ordinance on first reading, and Vice-Mayor Zandi seconded. The motion passed by unanimous roll call vote C. Resolutions: Resolution 13-55 - A Resolution Authorizing the Issuance of Generat Obtigation Refunding Bonds. City Manager Broughton reviewed this Resolution, which would authorize the issuance of up to $10,100,000 in General Obligation Refunding Bonds. The bonds will be used to refund borrowings made in 2005, 2007 , and 2008, and thus effectuate cost savings for the City. Mr. Tom Highball voiced concems about the issuance of bonds. Councilman Shumaker moved to approve the Resolution, and Councilwoman Feierabend seconded. The motion passed by the following roll call vote: Councilman Shumaker Yes Vice-Mayor Zandi No Councilwoman Dolan Yes Councilwoman Feierabend Yes Mayor Staton Yes Resolution 13-64 - A Resolution Appointing an Interim City Manager. City Manager Broughton reviewed this Resolution, which will appoint Bill Sorah as interim City Manager beginning at the close of business on June 20,2013 and provide a l5Yo pay increase while so serving in this capacity. Vice-Mayor Zandi moved to approve the Resolution, and Councilwoman Feierabend seconded. The motion passed by unanimous roll call vote. CONSENT AGENDA: City Manager Broughton presented the Consent Agenda to Council. Councilwoman Feierabend requested Resolutions 13-57 and 13-65 be removed from the Consent Agenda. The following items were approved by unanimous Council vote: Minutes - May 7,2013 City Council Meeting; a Minutes - May 28,2013 Special Called City Council Meeting; a Minutes - April 16,2013 City Council Work Session; a Resolution 13-56 - A Resolution Authorizing the Execution of a Contract for the Maintenance of State Highways with the Tennessee Department of Transportation; Resolution 13-58 - A Resolution Approving a Grant Agreement with the Virginia Department of Transportation for the Utilization of Federal Highway Administration Funds for the Bristol Metropolitan Planning Organization; a Resolution 13-59 - A Resolution Designating the Name of a Public Street; a Resolution 13-60 - A Resolution Designating thc Name of a Private Street; a Resolution 13-61 - A Resolution Authorizing the Purchase of Software Support for Computer Aided Dispatch System; a Resolution 13-62 - A Resolution Establishing a Solid Waste Collection and Disposal Fee; a Resolution 13-63 - A Resolution Awarding the Purchase of Video Production Server; a Resolution 13-66 - A Resolution Authorizing Payment in Support of Bristol Tennessee City Schools for Fiscal2}l4; and a Resolution 13-67 - A Resolution Authorizing payment in support of the Bristol Library and Literacy Academy for Fiscal 2014. Resolution 13-57 - A Resolution Approving the Acceptance of a Donation of Real Property. City Manager Broughton reviewed the Resolution, which would approve the acceptance of a donation of real property located at36 24'n Street. This property was acquired by a bank and is being donated to the City. Upon the acceptance of the donation it will be tumed over to a home agency. Councilwoman Feierabend moved  City Council Meeting June 4,2013 Page 6 of 6 to approve the Resolution, and Councilwoman Shumaker seconded. The motion passed by unanimous roll call vote. Resolution 13-35 - A Resolution Establishing a Slater Center Non-Resident Guest Fee. City Manager Broughton reviewed the Resolution which would establish a non- resident guest fee of $120 annually effective January l, 2014. Councilwoman Feierabend moved to approve the Resolution, and Vice-Mayor Zandi seconded. The motion passes by unanimous roll call vote. CITY MANAGER'S REPORT: City Manager Broughton thanked the Council for the opportunity to serve as City Manager CITY COUNCIL COMMENTS: Councilwoman Dolan thanked Mayor Staton, Councilman Shumaker, and City Manager Broughton for their service and stated that she looked forward to working the new members of Council. Vice Mayor Zandi thanked Mayor Staton, Councilman Shumaker, and City Manager Broughton for their service and welcomed the new members of Council. Councilman Shumaker stated that serving on the City Council had been a tremendous honor for himself and his family. Councilman Shumaker stated that he was very proud of what had been accomplished over the last 15 years by the City and City Council. He thanked all and wished the new council well. Mayor Staton thanked all for their support and offered wished the new Council all the best. He closed with the hope that the new council would keep Bristol going in the right direction.
