MINUTES OF THE CITY OF BRISTOLO TENNESSEE CITY COUNCIL MEETING May 2,2017 CALL TO ORDER: The City of Bristol Tennessee City Council meeting was called to order by Mayor Chad Keen on Tuesday, }day 2,2017, at7:00 p.m. in the Slater Center Auditorium. ROLL CALL: Present: Mayor Chad Keen, Vice Mayor Jack Young, Councilwoman Margaret Feierabend, Councilwoman Lea Powers, and Councilwoman Michelle Reuning. Others Present: City Manager TVilliam L. Sorah, City Attorney Danielle Kiser, City Recorder Tara Musick, and members of City staff. INVOCATION AND PLEDGE OF ALLEGIANCE: Evangelist John V/heeler, God Bless America Rally gave the Invocation and Boy Scout Troop #5 led the Pledge of Allegiance. AGENDA ADDITIONS AND/OR CHANGES: None. PROCLAMATIONS AND RECOGNITIONS : Full Gospel Fellowship Church 50th Anniversary - Councilwoman Feierabend read a proclamation recognizing the 50th Anniversary of the Full Gospel Fellowship Church. Rev. Jerry Taylor accepted the proclamation. Ron Necciai Day - Councilwoman Powers reada proclamation designating May 13,2017 as Ron Necciai Day in Bristol, Tennessee. Mahlon Luttrell, President, Bristol Baseball, Inc. accepted the proclamation. Recognition - Bristol First Program Award - Community Relations Director Terrie Talbert 'Works, recognized Bob V/illiams, Public as the Bristol First Program Award winner for April 2017. He was nominated by a citizen for taking the time to stop and help her carry a heavy piece of furniture to the side of the road for pick up. Mr. 'Williams was in attendance to receive the award.  City Council Meeting May 2,2017 Page2 of 6 PRESENTATIONS: None PUBLIC HEARINGS: Ordinance 17-2 An Ordinance Amending the Official General Plan for Land Use City Manager Sorah reviewed Ordinance 17-2. The City engaged the consulting firm of McGill Associates, of Knoxville, Tennessee, to perform a comprehensive study of the City's existing trail system and recommend future improvements and strategies for implementing and funding a new trail and greenway infrastructure. This is the City's first effort to develop a comprehensive plan for the trail system and is a critical element of any grant funding opportunity. The effort solicited input from several individuals and groups having any interest in the development of a city-wide trail system. The comprehensive plan was presented to the Parks and Recreation Commission and Planning Commission on Monday, March 20th. The Planning Commission formally adopted the plan during their March20th meeting. Representatives from McGill Associates presented the plan to City Council during their March 28th work session. City Council passed Ordinance l7-2 onfirst reading on April 6,2017. In order for the plan to become a part of the City's Official Plan for Land Use, Ordinance 17 -2 is an item for consideration on second reading. APPEARANCE OF CITIZENS: Remy Galjour, stated that he is against Intimate Treasures being located at the front of Sunnybrook Subdivision, He stated that the store carries and sells pornography material. He also stated that the school bus stops in front of the where store is to be located. Eddie Mabry, 109 Sunnybrook Drive, stated he wanted to renew his concern on Intimate Treasures locating at the entrance of the Sunnybrook Subdivision. He stated that he felt the Board of Zoning Appeals meeting was not run properly. Ben Phillips, 104 Sunnybrook Drive, stated that he was at the Board of Zoning Appeals meeting and felt it went badly. He called for removal of every member of the Board of Zoning Appeals. Maggie Hess, 245 McDowell Street, stated that she did not feel that the Invocation or Pledge of Allegiance should take place at the City Council meeting.  City Council Meeting May 2,2017 Page 3 of6 APPOINTMENTS: None ORDINANCES AND RESOLUTIONS: A. First Reading of New Ordinances: Ordinance 17-3 An Ordinance to Adopt a Budget, and Appropriate Funds for the Fiscal Year July lr20l7 through June 30,2018 City Manager Sorah stated that Ordinance 17-3 is considered on first reading for formal adoption of the Fiscal 2018 Budget and Appropriations for the fiscal year beginning July 1,2017. The Fiscal20lsBudgettotals$106,310,082. Thisreflectsanincreaseof$7,294,108 orT. Yofromthe Fiscal2017 Budget. The municipal government portion of the budget stands at $61 ,466,806, an increase of $5,130,099 from the Fiscal 2017 Budget. The proposed budget focuses on the key themes of economic development, enhanced city services, and improved quality of life. The budget continues all city programs and services as in the past while making strategic capital investments to meet the future needs of the community. Major projects include the opening of Fire Station #5, reconstruction of East Cedar Street, and major improvements at the water filtration and wastewater treatment plants. Key partnerships include the development of Tri-Cities Airport's aerospace park, site development at Bristol Business Park, improvements at Partnership Park II, and the construction of the new Petworks county-wide animal shelter. The budget includes a total average wage adjustment of 3.0o/o for employees. This includes a2.5%o merit increase for employees meeting performance expectations and an additional lo/o for employees who are below the market wage study recommendations. The proposed budget maintains the current property tax rate, solid waste fees, stormwater fees, and water and sanitary sewer rates. An ordinance adopting the tax rate will be scheduled following the certification of the tax rolls later this year. The school system portion of the budget totals 544,843,276, an increase of 52,164,009 or 5.1o/o from the Fiscal 2017 Budget. The municipal government portion of the Fiscal 2018 Budget remains unchanged from that presented to City Council during the April 25th work session. Adoption of Ordinances (Second Reading): Ordinance l7-2 An Ordinance Amending the Official General Plan for Land Use City Manager Sorah reviewed this ordinance which was the earlier subject of a public hearing. Councilwoman Powers made a motion to approve the ordinance on second reading, and Councilwoman Feierabend seconded the motion. The motion passed by a unanimous roll call vote C. Resolutions: Resolution 17-43 - A Resolution Authorizing the Sale of Certain Surplus Real Property Located at l0l4 Anderson Street City Manager stated that Resolution 17-43 authorizes the sale of real property at I0I4 Anderson Street. The property had been issued an order to demolish by the Better Property Board on July 8, 2013. The property owner was delinquent on real estate taxes in the amount of $6,700.00 and decided to donate the property to the City. The City tried to find a buyer willing to purchase and rehabilitate the structure. Mitch Skaggs, a local contractor, has made an offer of $6,700.00. He plans to rehabilitate the house and make it livable again. Vice Mayor made a motion to approve the resolution, Councilwoman Reuning seconded the motion. The motion passed by a unanimous roll call vote. CONSENT AGENDA: City Manager Sorah presented the Consent Agenda to Council. Vice Mayor Young made a motion to approve the consent agenda, and Councilwoman Feierabend seconded the motion. He commended the emergency responders for doing a great job in handling the accident. He stated that the next week would be Advanced Placement Testing week. Teacher Appreciation Week is coming up. He stated that the school has some very talented teachers and asked that everyone thank them. Tennessee High School graduation will take place on Saturday, May 20.  City Council Meeting May 2,2077 Page 6 of6 CITY MANAGER'S REPORT: City Manager Sorah stated that there will be three Bristol Exchange Meetings to discuss the budget, Tuesday, March 9, in the cafeteria of the Slater Center, Thursday, May 1 1, at Slater Center, and Tuesday, May 23,inthe Frank Winston Auditorium at Tennessee High School. He reminded City Council of a joint meeting on May 4, at 6:00 p.m. at the School Administration offices. There will be a breakfast on June 1 at 8:30 a.m. atthe Bristol Essential Services offices to discuss the roll-out of the brand. The first Full Moon Concert will be held on June 1. He thanked City departments for their work during the spring race. City Manager Sorah spoke about the branches of government within the City and how they work. He stated that the Board of ZoningAppeals reviews staff s interpretation of the regulations. There is a 60 day window to appeal a decision of the Board of Zoning Appeals. CITY COUNCIL COMMENTS: Vice Mayor Young stated that Saturday,May 6, is the Farmet's Market opening. Councilwoman Feierabend stated that Rhythm and Roots will have their first reveal on Thursday, May 4, at 5:30 p.m. Friends of Steele Creek have a meeting on Saturday, May 6, at2:00 p.m. There will be a 'oDark Sky" presentation on May 18 in the Tennessee High School Auditorium. May 21't will be Bristol Train Station Day. She asked City Manager Sorah to send out a memo to the Board and Commissions concerning attendance. She stated that the Board of Zoning Appeals is made up of citizens and they do the best they can. Vice Mayor Young stated that appointing a steering committee for the Comprehensive Plan will be helpful. He asked that everyone get out and vote. Councilwoman Powers stated that the Comprehensive Plan is exciting. She stated that she is excited about the Aerospace Park and the grant that BTES received for Partnership Park II. Councilwoman Reuning congratulated Bob'Williams on being the Bristol First Award winner. She stated that she felt the budget was growing after some lean times. She was looking to meeting with the School Board on Thursday,May 4.
