ADJOURNMENT Page 1 of 6 Committee Item Memo Meeting Date: January 10, 2022 Staff Contact: George Issakoo, Assistant Village Manager Department: Village Manager's Office Subject: Discussion Regarding a Video Gaming Application from Luigi's Paisans Pizza II, Inc. Located at 3720 Grand Boulevard Background Information: The Village currently has 14 licensed video gaming locations and total of 78 gaming terminals. The Village Code currently allows for 15 licenses. The Village code requires a business seeking to request a Video Gaming license to hold a State of Illinois and Village liquor license for at least one year before qualifying. Luigi's Paisans Pizza II, Inc d/b/a Paisans Pizzeria has held both a State of Illinois and Village of Brookfield license for more than one year. This license request would be the fifteenth license issued for video gaming and would not require the Board to approve an increase to the available Video Gaming licenses. Further, the Village Code requires “All video gaming terminals must be located in those areas of a licensed video gaming location with restricted visibility from areas outside of the business.” State law requires that the terminals be located in a separated section of business, which is restricted to those under 21. Luigi's Paisans Pizza II, Inc d/b/a Paisans Pizzeria plans to ensure this requirement is met. Page 2 of 6 Committee Item Memo Meeting Date: January 10, 2022 Staff Contact: Emily Egan, Community Development Director Department: Community Development Subject: Discussion of Potential Text Amendments to Revise Uses Related to Massage Background Information: Staff recommends the Committee of the Whole discuss potential changes to the uses allowed by right within the “Office; medical, dental and health practitioner” as defined by Chapter 62-25 section J part 2 of the Zoning Ordinance. This includes practitioners of massage therapy as defined by 225 ILCS 57/10, when performed solely by state-licensed professionals. Currently, this use is permitted in the C1, C3, C4, SA1, SA3, and SA4 zoning districts by right (see zoning map below). Several public nuisance events have occurred in the C1 zoning district, and a review is recommended by staff to determine if this is an appropriate land use within the C1 corridor and other commercial areas within the Village. If, after review and discussion by the Planning and Zoning Commission, the Village Board decides the use should be more restrictive either by a special use permit or a text amendment, any existing businesses with a business license and having good standing would be allowed to remain and continue per Section 62-2 Definitions Discontinuance along with Article IV Division 2 Nonconforming Uses of the Zoning Ordinance. There is presently one state licensed massage business within the SA 4A General Mix Zoning District in downtown Brookfield. Page 4 of 6 Committee Item Memo Meeting Date: January 10, 2022 Staff Contact: Emily Egan, Community Development Director Department: Community Development Subject: Discussion of Potential Text Amendments to Revise Parking Requirements Downtown Background Information: Staff recommend the Committee of the Whole discuss potential changes to the parking requirements for commercial uses in one or more of the downtown zoning districts. Many storefronts in downtown Brookfield do not have on-site parking and no available land to meet parking requirements. The Downtown has on-street parking available to the public during peak times and this use of the right-of-way may reduce the burden on existing and new business owners. The proposed zoning changes would streamline the process for new businesses, encourage a vibrant walkable neighborhood, and could reduce vacancies in downtown. Staff recommends eliminating parking requirements in the SA 1 Core Mixed Use for commercial uses but to continue to require it for residential uses. See the Village Zoning Map below.
