Background Information: On October 9, 2023, staff came before the Committee of the Whole (Committee Item Memo) to discuss the matter of the Brookfield Zoning Map not accurately reflecting park parcels with the appropriate zoning designations for this type of land use and the matter of some parks consisting of multiple parcels. The Village Board directed staff to bring forward the matters by application to the Planning and Zoning Commission for Map Amendments and PIN Consolidations. On December 8, 2023, the Village made an application to the Planning and Zoning Commissioner for Map Amendments related to nine (9) parks, but the request was revised to eight (8) parks: Creekside, Candy Cane, Harrison, Madison Tot Lot, Maple Park North, Maple Park South, Veterans Memorial, and portions of Ehlert to either the S-1 or S-2 Open Space District designation. Madlin Park was removed from the request as further research indicated it unlikely that the Village has exclusive ownership of the park. The Planning and Zoning Commission held a public hearing on December 28th, 2023, to consider the application for Map Amendments (Case 23-15). During the public hearing, the Village Planner gave the staff report and Commissioners raised questions regarding the PIN Consolidation portion of the efforts and requested confirmation that all the existing uses and conditions on the park properties would become legal uses with approval of the map amendments. Findings of Fact The Commission deliberated the standards for review. Commissioners supported the proposed map amendments as they preserve, protect, and enhance public lands and meet the standards for promoting and protecting the public health, safety, comfort, convenience, and the general welfare of the population. By a vote of 7 ayes, 0 nays and 0 abstaining, the Planning and Zoning Commission moved to recommend approval of the following map amendments: Page 2 of 6  From A-1 Single-Family Residence District Zoning to S-2 Restricted Planned Open Space District Zoning for Portions of Ehlert Park.  From A-1 Single-Family Residence District Zoning to S-1 General Open Space District Zoning for Candy Cane Park, for Harrison Park, for Madison Tot Lot, for Maple Park South and for Veterans Memorial Park.  From B Multiple-Family Residence District Zoning to S-1 General Open Space District Zoning for Creekside Park.  From A Single-Family Residence District Zoning and SA-6 Residential Multi-Unit District Zoning to S-1 General Open Space District Zoning for Maple Park North. Recommendation(s): Village staff recommends the Committee of the Whole discuss the petition request and attached recommendation from the Planning and Zoning Commission and determine if it is appropriate to direct the Village Attorney to prepare an Ordinance for vote at the next Village Board meeting. Absent: None Others Present: Trustee Liaison Hendricks, Village Planner Por�llo. III. Approval of Minutes Chairperson Grund entertained a mo�on to approve the mee�ng minutes dated November 16, 2023. Commissioner Sabourin so moved. The mo�on was seconded by Commissioner Evans. AYES: Evans, Grund, Miller, Sabourin, Weber. NAYS: None. ABSTAIN: Svoboda. Mo�on Passed 5-0. IV. Public Comment No public comment. V. Commissioner Miller so moved. The mo�on was seconded by Commissioner Evans. AYES: Evans, Grund, Miller, Sabourin, Svoboda, Weber. NAYS: None. ABSTAIN: None. Mo�on Passed 6-0. Village Planner Kate Por�llo presented the staff report. Chairperson Grund opened the floor for Public Comment. Resident Barbara Dahm came forward to comment regarding the amount of �me it has taken the Village to come forward with map amendments for the parks, and to ask for confirma�on that the proposed zoning designa�ons would allow a community center to be built in the parks. Resident Robert Sheehan came forward to comment on his concerns that the grading of gravel alleys around some parks poses poten�al health risks to park users present during the grading and also following the grading due to the cement dust and its setling on park equipment. Chairperson Grund requested clarifica�on from the Village Planner to confirm that a community center would be allowed in any of the parks under the new zoning designa�ons, and Ms. Por�llo confirmed that is correct. Chairperson Grund entertained a mo�on to close the public hearing for Case 23-15. Commissioner Sabourin so moved. The mo�on was seconded by Commissioner Miller. AYES: Evans, Grund, Miller, Sabourin, Straka, Svoboda, Weber. NAYS: None. ABSTAIN: None Mo�on Passed 7-0. Commissioners requested clarifica�on of the Map Amendments before them and if PIN consolida�ons for some park sites were included. Planner Por�llo indicated the consolida�ons would be a separate applica�on in the near future. Commissioners asked ques�ons as to whether all the exis�ng uses and condi�ons on the park proper�es would become legal uses with the poten�al approval of the map amendments. Commissioners deliberated the proposed map amendments and stated that the standard of promoting and protecting the public health, safety, comfort, convenience, and the general welfare of the population had been met through preserving, protecting, and enhancing public lands. Commissioner Straka entertained a mo�on to approve the requested Map Amendments as stated in Case 23-15. Commissioner Svoboda seconded the mo�on. Other Business 2 Planning and Zoning Commission Record of Minutes – Meeting Date: December 28, 2023 Page 5 of 6 Village Planner Kate Por�llo noted that Case 23-15 would be brought to the Commitee of the Whole on January 8th, 2024. Ms. Por�llo men�oned the Community Development department would release its 2023 Annual Report in the early part of 2024, that she expected a Resolu�on awarding a contract for the Zoning Code Update project to go before the Village Board in January, and passed along President Garvey’s thanks and gra�tude to the Commission for their service to the community. VII. Adjournment Chairperson Grund entertained a mo�on to adjourn the mee�ng. Commissioner Straka respec�ully interjected with an apology to the Commission, staff, and the public for being late to the mee�ng, and the apology was acknowledged and accepted. Commissioner Evans entertained a mo�on to adjourn the mee�ng. Commissioner Miller seconded the mo�on. AYES: Evans, Grund, Miller, Sabourin, Straka, Weber. NAYS: None ABSTAIN: None Mo�on Passed 6-0.
