The current language in the Village Code identifies a prior vendor used to track cross-connection devices connected to the Village's Community Water System. The proposed amendments will reflect the current practice of working with Brycer, LLC., the Compliance Engine, which began in 2022. Additional language updates reflect the current code for regulating backflow devices per the Illinois Department of Public Health's Plumbing Code. The proposed sewer amendments update the language, harmonizing the code to reflect the current mandates with Metropolitan Water Reclamation District (MWRD) requirements for its Watershed Management Ordinance. GENERALLY Sec. 56-199. Adoption of manual of procedures for processing sewer permits. The Manual of Procedures for the Administration of the Sewer Permit Ordinance (revised May 27, 1970) and adopted by the trustees of the Metropolitan Sanitary District of Greater Chicago on September 3, 1970, and the whole thereof of which not less than three copies have been and now are on file in the office of the clerk, is and the same is adopted as an integral part of the procedures of the administration for sanitary sewer permits. Reference § 48-100. (Code 1964, § 28-37.01; Ord. No. 1971-5, § 1, 4-12-1971) Sec. 56-200. Outhouses, thunderboxes privies, and vault connections to sewer prohibited; privies near streets, dwellings, shops or wells. (a) Outhouses, thunderboxes or privies shall not be constructed in the village nor shall any old vault be connected to a village sewer. (b) It shall be unlawful for any person to erect or maintain any outhouse, thunderbox or privy within the village (Code 1940, §§ 26.001(15)(28-6), 40.031(28-5); Code 1964, §§ 28-35, 28-36; Ord. No. 1968-43, §§ 7, 8, 12-23-1968) Sec. 56-201. Certain connections to storm drains or sewers prohibited. It shall be unlawful for any person to connect or cause to be connected any drain carrying or to carry any toilet, sink, basement, septic tank, cesspool or industrial waste, or any fixture or device discharging polluting substance, to any stormwater drain or storm sewer in the village. (Code 1964, § 28-37; Ord. of 3-26-1956, § 1(28-7); Ord. No. 1968-43, §§ 7, 8, 12-23-1968) Sec. 56-202. Building wall openings; overhead sewers. (a) The elevation of sewers, door sills, window sills, well openings in the village shall be in accordance with the requirements of the Metropolitan Water Reclamation Sanitary District of Greater Chicago and the flood control regulations of the village. (b) When the building wall encloses open space that is below the floodplain elevation, low level gravity building drain connections are prohibited and overhead sewers are required. (bc) All new buildings with basements, floors, rooms or occupancy areas below ground level at the building site and served by a public or private sewer system shall have overhead plumbing. Roof drains, foundation footing drains, parking and paved lot or area drains, groundwater drains or surface water connections to the sanitary sewer system are strictly forbidden in all areas. (Code 1964, § 28-37.03; Ord. No. 1971-5, § 1, 4-12-1971) Sec. 56-204. Footing drain specifications. Footing drains shall be connected to sump pumps for further discharge into storm sewer or drainage ditches. (Code 1964, § 28-37.03; Ord. No. 1971-5, § 1, 4-12-1971) Sec. 56-205. Maintenance and repair of sewer service pipe. It shall be the responsibility of the property owner to maintain and repair the sewer service pipe, servicing the building of the property owner, including the junction connection with the village main sewer. (Code 1964, § 28-38; Ord. of 8-31-1964, § 2(28-7.1); Ord. No. 1968-43, §§ 7, 8, 12-23-1968) Secs. 56-206—56-233. Reserved. DIVISION 2. SEWER CONNECTIONS Sec. 56-234. Persons authorized to tap or connect to water system. No person, except an authorized agent of the department of public works and services or a licensed plumber or drain layer, acting under the supervision of such department, shall tap or make any connections with the sewer mains in the village. (Code 1964, § 28-39; Ord. No. 1968-43, § 9, 12-23-1968) Sec. 56-235. Connections required. (a) Each premises in the village creating sewage waste shall be independently and separately connected by a separate sewer service pipe with a public sanitary sewer. if such sanitary sewer adjoins the lot or parcel of land on which the premises stands or where such sanitary sewer is located not less than 200 feet from the nearest lot line of said property. (c) Every premises in existence prior to the construction of a public sanitary sewer and located not more than 200 feet from the nearest lot line of said property on which the premises stands shall, upon the construction of such public sanitary sewer, and after written notice, be connected to said sanitary sewer within one year of notice, provided that if said premises is serviced by a septic tank system which ceases to function properly so that its continued operation constitutes a nuisance or menace to health, said building shall be connected to the adjoining public sanitary sewer immediately. (Code 1964, § 28-40; Ord. of 12-23-1958, § 8; Ord. No. 95-48, 11-14-1995) Secs. 56-236—56-263. Reserved. DIVISION 3. SEWER CHARGES Sec. 56-264. Method of assigning service classes. (a) The village has designated certain sewer service classes. The service class designation is largely dependent upon the assigned billing period. (b) Sewer service customers are assigned a monthly or quarterly billing period based on the size of the water meter required and based upon the volume of water use measured. Customers with water meter sizes greater than one inch are generally assigned a monthly billing period. Customers with volumes of water use less than 1,200 cubic feet per month may be are considered for quarterly billing periods. Uncertainties over assignment will be resolved by the water department with an evaluation of the specific service needs of the customer. (Code 1964, § 28-45; Ord. No. 1969-8, § 1, 6-23-1969; Ord. The charge for sewer service shall be based upon 27.1 percent of the water rate billed, less the amount of the water rate attributed to the lead service line replacement component of $1.24 per 748 gallons. (a) It shall be the duty of the consumer at premises on which backflow prevention devices are required by these regulations are installed to have inspections, tests, maintenance and repairs made in accordance with the following schedule or more often where inspections indicate a need or specified in manufacturer's instructions: (1) Fixed proper air gap separations shall be inspected at the time of installation and at least annually thereafter. (2) Double-check valve assemblies shall be inspected and tested for tightness at time of installation and at least annually thereafter, and required service performed within 15 days or as requested by the Village. (3) Reduced pressure principle backflow prevention devices shall be tested at least annually or more frequently if recommended by the manufacturer. (b) Testing shall be performed by a person who has been approved by a Cross-Connection Control Device Inspector (CCCDI). the agency as competent to service the device. Proof of approval shall be in writing. (c) Each device shall have a tag attached including the information as required in this article. (d) Whenever backflow prevention devices required by these regulations are found to be defective, they shall be repaired or replaced at the expense of the consumer within 15 days or as specified by the Villagedirector of public works. (e) Backflow prevention devices shall not be bypassed, made inoperative, removed or otherwise made ineffective without specific authorization by the Villagedirector of public works. (f) Copies of all test results shall be forwarded to the director of public worksVillage’s authorized representative, Backflow Solutions, Inc., through its online backflow tracking system (BSI Online) at the time of each inspection as described in section 56-307. (Contact Backflow Solutions, Inc. at www.backflowsolutions.com.) (g) Each backflow testing company performing backflow testing within the village shall set up an account in the designated reporting system BSI online system, supplying and maintaining required information pertaining to the testing company, testers, test kits and licenses. Each testing company shall create a user name and password to be used on the BSI online system. Each testing company shall adhere to all BSI online procedural policies and agree to all terms specified in the BSI online system. (h) In order to access applicable water customer information within the BSI online system for the purposes of backflow test report submittal, the backflow testing company shall obtain from their customer the customer confirmation number (CCN). This number is randomly generated and supplied in writing to the water customer prior to the applicable annual backflow test due date. (hi) For each backflow test report submitted by the testing company via the BSI online system, the testing company will be required to pay a filing fee in the amount provided in the village fee schedule, due at the time of submittal. All backflow test reports must be submitted electronically via the BSI online system. (Ord. No. 2010-43, § 2(21-4.13), 5-24-2010) Created: 2023-08-22 13:36:48 [EST] (Supp. No. 29) Page 1 of 1 Page 7 of 16 Committee Item Memo Meeting Date: January 22, 2024 Staff Contact: Bob Uphues, Management Analyst Department: Village Manager's Office Subject: Discussion About Amending Various Sections of the Village Code Pertaining to Advisory Commissions and Committees Background Information: The Village Board on occasion has acted to amend the Village Code to repeal advisory commissions or committees that either are no longer functioning or have been made redundant through other actions by the Village Board. However, there still remain in the Village Code either references to commissions/committees which have already been repealed or entire sections of the code dedicated to commissions/committees no longer functioning. References to Library Board, Electrical Commission and Special Events Committee Chapter 2, Article VI, Division 1, Sec. 2-423 of the Village Code lists village boards, commissions and committees that “shall be appointed or elected.” Among those listed are the Library Board, Electrical Commission and Special Events Committee. The Village Board has already taken action to repeal all three of those entities, and there is no other language in the Village Code about them. Board of Health While there is no Board of Health listed among the designated boards and commissions in Chapter 2-VI-1-2-423, language still exists in Chapter 2, Article VI, Division 8, establishing a Board of Health. The ordinance dates from 1964 with an update in 1980. However, there has not been a Board of Health appointed in Brookfield in recent memory. It’s unclear when it last served as an active entity. Streets and Infrastructure Commission Chapter 2, Article VI, Division 12 of the Village Code established a Village Board subcommittee called the Streets and Infrastructure Commission. Like the Board of Health, it is not listed in Sec. 2-423 of Chapter 2, Article VI, Division 1. The committee was created by ordinance in 1964 and the ordinance was updated last in 2001. There has not been a functioning Streets and Infrastructure Commission of the Village Board in at least 20 years. Page 8 of 16 The committee was created generally to recommend infrastructure improvement policies and prioritize infrastructure projects. In the last 20 or so years, the Village Board has worked collaboratively with the Village Engineer to identify infrastructure improvement priorities, making the subcommittee redundant. Planning, Zoning and Economic Development Committee In January 2007, the Village Board voted to approve an ordinance creating a Planning, Zoning and Economic Development Committee, a body appointed by the Village President and consisting of three Village Trustees. The chairperson of the PZED committee served as its liaison to the Village Board. The committee met as needed, typically prior to regularly scheduled Village Board meetings. From 2007 to 2015, PZED does not appear to have met frequently, but it became more active in 2015 as a forum for Village staff to solicit feedback and recommendations from elected officials on various economic development initiatives. Subjects considered by the committee often would then move on to consideration by the full Village Board at a Committee of the Whole meeting. The committee appears to have stopped convening in 2018, and since that time the Village Board has taken a variety of other steps to address subjects formerly considered by PZED. In 2021, the Village Manager with the consent of the Village Board hired a part-time economic development coordinator, who spearheaded the creation of an Economic Development Plan and manages a variety of economic development-related initiatives. In May 2022, the Village Board voted to approve an ordinance creating the Brookfield Economic Development Commission, an advisory group consisting of nine Brookfield business owners and leaders. Since its creation, the Economic Development Commission has been tasked with considering initiatives that were once the purview of PZED, including reviewing and making recommendations on applications for Brookfield’s Property Improvement Program, reviewing and providing feedback on proposed redevelopment projects, reviewing the Village’s Economic Development Plan, and considering other economic development initiatives, such as Shop Local campaigns to support Brookfield businesses. In December 2023, the Village Board approved its 2024 Operating Budget, which includes funding to create the new position of Business Development Specialist, who would be tasked with focusing on business retention/attraction efforts. The Business Development Specialist will also work closely with the Community Development Department and the Economic Development Commission. Impact of PZED Committee repeal on Fair Housing Advisory Committee Page 9 of 16 If the Village Board agrees that the Planning, Zoning and Economic Development Committee is no longer needed, that decision will have an impact elsewhere in the code. In 2007, the Village Board voted to amend Chapter 2, Article VI, Division 3 of the Village Code, creating a Fair Housing Advisory Committee. The amendment was done to update the Village’s Fair Housing Policy as established in the Village Code (Chapter 32, Article II) to “ensure compliance with the Village ADA standards, align the Village’s definitions with the Fair Housing Act, require reasonable rental accommodations for persons with disabilities, and streamline the complaint intake and hearing process.” The amendment adopted in 2007 created a Fair Housing Advisory Committee, a subcommittee of the Village Board, to handle complaints. The members of that committee according to the Village Code “shall be comprised of all current members of the Planning, Zoning, and Economic Development Committee.” If the PZED Committee is abolished, the section of the code establishing the Fair Housing Advisory Committee will need to be amended with respect to how its members are appointed. If the Board is amenable to amending these various sections of Village code, staff will work with the Village attorney to present the recommended amendments. Recommendation(s): 1. Village staff recommends amending Chapter 2-VI-1-2-423 of the Village Code to remove the references to the Library Board, Electrical Commission and Special Events Committee. 2. Village staff recommends repealing Chapter 2, Article VI, Division 8 of the Village Code, pertaining to the Board of Health. 3. Village staff recommends repealing Chapter 2, Article VI, Division 12 of the Village Code, pertaining to the Streets and Infrastructure Commission. 4. With PZED inactive for the past six years and with the Village taking steps since 2018 to create an Economic Development Commission and budget for the hiring in 2024 of a new Business Development Specialist, Village staff recommends repealing Chapter 2, Article VI, Division 15 of the Village Code pertaining to the Planning, Zoning and Economic Development Committee and to remove the reference to the PZED Committee in Chapter 2-VI-1-2-423. 5. As the Fair Housing Advisory Committee was created in response to ensuring the Village was providing necessary safeguards for fair housing, staff does not recommend repealing that committee, and instead would recommend amending the language in the code regarding the appointment of its membership. BOARD OF HEALTH DIVISION 8. BOARD OF HEALTH Sec. 2-727. Established; members; terms. The village has created the board of health for the village. The board of health shall consist of three members: a doctor who either resides or practices in the community who shall be appointed by the president by and with the consent of the village board for a four-year term and a village trustee and the administrative assistant. (Code 1964, § 02-180; Ord. No. 1980-37, 12-8-1980) Sec. 2-728. General duties. (a) The board of health shall have the powers and perform the duties assigned to it by statute or ordinance. It shall be the duty of the board of health to enforce all ordinances of the village which relate to public health, or relate to nuisances and to make such inspections of food stuffs and of the premises used for storing or selling of provisions as may be provided by ordinance. (b) The board of health shall make all necessary rules and regulations for the protection of the health of the inhabitants of the village and to guard against the spread of contagious diseases, and to prevent by necessary rules the induction of diseases, contagious or otherwise, within the corporate limits of the village. (a) The board of health is hereby authorized to make such reasonable rules as may be necessary regarding quarantine and vaccination, for the prevention and spread of contagious diseases, and to quarantine premises where such diseases occur for such time as may be necessary to protect the public health. (b) The said board shall have the power to prevent persons from entering or leaving premises upon which a case of contagious or epidemic diseases occurs or is found, and to placard the same with signs indicating the nature of such disease and the existence of the quarantine. Any person violating any order of the board of health or refusing to obey any such order or destroying, mutilating or concealing any notice posted by or under the authority of the board of health shall be fined not less than $25.00 nor more than $500.00 for each offense. The board of health shall make recommendations for rulings, orders or ordinances respecting the public health whenever it is necessary or whenever they are requested to do so by the village board. The village has created the streets and infrastructure commission that shall consist of three village trustees appointed by the president, subject to the advice and consent of the board of trustees. (Code 1964, §§ 02-500, 02-501; Ord. No. 2001-23, 6-11-2001) Sec. 2-864. Terms of members, vacancies. The terms of the commission members shall be for four years, but shall not extend beyond the term of the president who appoints the members. All vacancies shall be filled in the same manner as the original appointments. (Code 1964, § 02-502; Ord. No. 2001-23, 6-11-2001) Sec. 2-865. Chair and secretary. (3) To prepare and recommend priorities and criteria for selection of street and infrastructure improvements and maintenance. (4) To exercise such other powers germane to the powers granted by this section as may be conferred by the board of trustees.
