CITY OF BRUSH! MINUTES OF THE MARCH 9, 2015 – REGULAR CITY COUNCIL MEETING The City Council of the City of Brush Colorado met in regular session on March 9, 2015. Mayor Chuck Schonberger called the meeting to order at 6:00 p.m. The meeting was held at Brush City Hall. The pledge of allegiance was given. Cory Hardy, Marketing Specialist Tyler Purvis and City Clerk Andrea Strand MINUTES The minutes of the regular meeting of February 23, 2015, and the special meeting of February 26, 2015, were approved as submitted. VISITORS AND DELEGATIONS None. MANAGEMENT Second and Final Reading of Ordinance 829-15 An Ordinance Annexing property known As Lot 1 of Farmland Minor Subdivision to the City of Brush Colorado, and Declaring an Emergency Administrator Torres presented Ordinance No. 829-15 An Ordinance Annexing property known As Lot 1 of Farmland Minor Subdivision to the City of Brush Colorado, and Declaring an Emergency. Councilor Smith moved, seconded by Councilor Bain, to adopt Ordinance No. 829-15 An Ordinance Annexing property knows as Lot 1 of Farmland Minor Subdivision to the City of Brush, Colorado, and Declaring an Emergency and publish by title only. The motion was approved unanimously by roll call vote. Council Proceedings – March 9, 2015 1 First Reading of Ordinance Number 830-15 An Ordinance Disbanding And Re-Creating The Water Advisory Board, And In Conjunction Therewith Repealing And Re-Enacting Article 11 Of Chapter 2 Of The Brush Municipal Code Relating To The Water Advisory Board Councilor Vicky Quinlin introduced Ordinance Number 830-15 and read it by title. Councilor Dykes moved, second by Councilor Smith, to adopt Ordinance No. 830-15 on first reading and order published in full, An Ordinance Disbanding and Re-Creating the Water Advisory Board, and in Conjunction therewith Repealing and Re-Enacting Article 11 of Chapter 2 of the Brush Municipal Code Relating to the Water Advisory Board. The motion was approved unanimously by roll call vote. Public Hearing – Jordan Place Zoning Proposed Rezoning of Various Properties from Industrial (I) to Residential Medium Density (RMD) The Mayor opened the Public Hearing at approximately 6:07 p.m. The staff report was given by Karen Schminke for the proposed rezoning of a 48,000 SF area bordered by S. Railway Street on the north Jordan Place on the east, and Knearl Street on the south from Industrial (I) to Residential Medium Density (RMD). The subject property consists of seven (7) parcels, all in Block 1 of the Brush Improvements Subdivision, March 3, 1956, and are knows as 520 S. Railway St., 516 S. Railway St. 112 Jordan Pl., 116 Jordan Pl., 120 Jordan Pl., 515 Knearl St., and 519 Knearl Street. She referenced a site location map in the packet. She reviewed the Comprehensive Plan and the Land Use Code details of each zoning district. She added that as part of the rezoning process, affected property owners were sent a letter regarding this proposed change. The Planning and Zoning Commission met on March 2, 2015, and voted to recommend to City Council that the zoning for 520 S. Railway St., 516 S. Railway St., 112 Jordan Pl., 116 Jordan Pl., 120 Jordan pl., 515 Knearl St., and 519 Knearl St to be changed from Industrial to Residential Medium Density. Citizen Comment: Brenda Garfio who owns property at 112 Jordan Place, spoke in favor of the rezoning as she feels this will help her sell this property. Public Hearing was closed by Mayor Schonberger at 6:12 p.m. Jordan Place Zoning - First Reading of Ordinance No. 831-15 An Ordinance Rezoning Certain Lands In The City Of Brush Located In Brush Improvements Subdivision, The City Of Brush, Morgan County, Colorado Councilor Jeanine Anderson introduced, Ordinance No. 831-15, An Ordinance Rezoning Certain Lands in the City of Brush Located in Brush Improvements Subdivision, The City of Brush, Morgan County Colorado. Councilor Bain moved, second by Councilor Smith, to adopt Ordinance No. 831-15 on first Council Proceedings – March 9, 2015 2  reading and order published in full, entitled, An Ordinance Rezoning Certain Lands in the City of Brush Located in Brush Improvements Subdivision, The City of Brush, Morgan County Colorado. . The motion was approved unanimously by roll call vote. Resolution No 2015-2, Modifying Rules and Regulations for the Collection and Disposal Municipal Solid Waste by the City Of Brush, And Establishing Charges Therefor Councilor Quinlin moved, second by Councilor Anderson, to adopt Resolution No. 2015-2, Modifying Rules and Regulations for the Collection and Disposal Municipal Solid Waste by the City Of Brush, And Establishing Charges Therefor. The motion was approved unanimously by roll call vote. FINANCE City Disbursements Councilor Quinlin moved, second by Councilor Anderson to approve City bills from February 23 to March 9, 2015. Marketing • Reported that the quarterly City newsletter will be distributed door to door in April of every year. Other months, will be posted on the City’s website and distributed to the Library, Chamber, Hospital and available at City Hall. Council Proceedings – March 9, 2015 3 City Clerk • Read upcoming meetings and events. Assistant City Administrator • Reported on a grant received from the Colorado Tree Project and Xcel Energy to place trees at East Morgan County Hospital as a part of Arbor Day. City Administrator • City Administration continues discussion with the Golf Course. • Will be meeting with officials of Upper Platte and Beaver Canal Company concerning the special use permit for the augmentation pond. • The City of Brush is featured in National Civic Review Magazine MAYOR AND COUNCIL REPORTS • Councilor Anderson asked the status of negotiations with Charter Communication. Administrator Torres responded that they are ongoing. • Councilor Anderson reported that the East Morgan County Library Board will meet tomorrow night.
