CITY OF BRUSH! MINUTES OF THE NOVEMBER 30, 2015 JOINT CITY COUNCIL AND PLANNING COMMISSION MEETING The City Council and Planning Commission of the City of Brush, Colorado met in a special session on November 30, 2015. Mayor Chuck Schonberger called the meeting to order at 5:30 p.m. The meeting was held at Brush City Hall. The pledge of allegiance was given. Planning Commission present on roll call were: Tim Oakley, Chair Steve Treadway Rick Bain Mark Smith MontyTorres City Council present on roll call were: Mayor Chuck Schonberger Councilor Jeanine Anderson Councilor Rick Bain Councilor Kimberly Dykes Councilor Mark Smith Also present were City Attorney Bo Chapin, Assistant Administrator Karen Schminke and City Clerk Andrea Strand. Mayor Chuck Schonberger, was designated as the Chair for the joint public hearing. Planning Commission Chair Tim Oakley opened the Planning Commission public hearing regarding revisions to Chapter 16 Article 13 of the Brush Municipal Code concerning flood damage prevention regulations. Mayor Chuck Schonberger then opened the City Council public hearing regarding revisions to Chapter 16 Article 13 of the Brush Municipal Code concerning flood damage prevention regulations. Chair Oakley asked for the staff report. Assistant Administrator Karen Schminke provided a copy of the published notice of the combined hearing. She explained that in November 2010, the Colorado Water Conservation Board established new statewide floodplain rules that applied to all geographic areas in Colorado. The Rules became effective on January 14, 2011, and established new minimum standards in excess of those required by the National Flood Insurance Program. The City’s participation in the National Flood Insurance Program is what enables Brush property owners to obtain flood insurance which otherwise would not be available. She explained the differences of the old and newly recommended standards; she also noted that updating these new standards was important so as not to jeopardize grant funds or other financial support. 1 Public Comment: None. Planning Commission With the public comments concluded, Chairman Tim Oakley closed the Planning Commission public hearing at 5:42 p.m. Commissioner Treadway moved, second by Commissioner Smith to recommend approval of Resolution No. 2015-PC 02 Resolution Adopting and Recommending the Revision of Chapter 16 Article 13 of the Brush Municipal Code, Concerning Flood Damage Prevention Regulation. It was approved unanimously. City Council Mayor Schonberger declared the final report of the Planning Commission received by the Council. He closed the City Council public hearing at 5:45 p.m. Councilor Kim Dykes Introduced Ordinance No. 839-15, an “Ordinance Repealing and Reenacting Chapter 16 Article 13 of the Brush Municipal Code, Concerning Flood Damage Prevention Regulation. Councilor Dykes moved, second by Councilor Smith to approve Ordinance No. 839-15, an “Ordinance Repealing and Reenacting Chapter 16 Article 13 of the Brush Municipal Code, Concerning Flood Damage Prevention Regulation. It was approved unanimously by a roll call vote.
