CITY OF BRUSH! MINUTES OF THE DECEMBER 28, 2015 – REGULAR CITY COUNCIL MEETING The City Council of the City of Brush, Colorado met in regular session on December 28, 2015. Mayor Chuck Schonberger called the meeting to order at 6:00 p.m. The meeting was held at Brush City Hall. The pledge of allegiance was given. Present on roll call were: Mayor Chuck Schonberger Councilor Jeanine Anderson Councilor Rick Bain Councilor Heath Becker Councilor Vicky Quinlin Councilor Mark Smith Absent: Councilor Kimberly Dykes Also present were City Administrator Monty Torres, Assistant Administrator Karen Schminke, and City Clerk Andrea Strand. MINUTES The minutes of the regular meeting of the December 14, 2015, were approved as submitted. VISITORS AND DELEGATIONS None. MANAGEMENT Second and Final Reading of Ordinance No. 839-15, An Ordinance Repealing and Reenacting Chapter 16, Article 13 of the Brush Municipal Code Concerning Floodplains and Adopting and Amending Certain Definitions in Connection Therewith The Mayor opened the public hearing at 6:00 p.m. Karen Schminke provided a staff report stating that this was the second public hearing and there were no changes from the first reading of the ordinance. There was no one from the pubic to provide comments and no Council comments. The Mayor closed the public hearing at 6:04 p.m. Councilor Becker moved, second by Councilor Smith, to adopt and publish by title only, Ordinance No. 839-15, An Ordinance Repealing and Reenacting Chapter 16, Article 13 of the Brush Municipal Code Concerning Floodplains and Adopting and Amending Certain Definitions in connection Therewith. The roll call vote was unanimous. Council Proceedings –December 28, 2015 1 Second and Final Reading of Ordinance No. 840-15 An Ordinance Approving the Leases of Certain Real Estate Owned by the City of Brush for Terms of Five Years Administrator Torres presented the Ordinance for second reading and explained that staff had completed the bid process for leasing the various farms owned by the City. Councilor Anderson moved, second by Councilor Smith, to adopt on second reading Ordinance No. 840-15 Approving the Leases of Certain Real Estate Owned by the City of Brush for a Term of Five Years and publish by title only. The roll call vote was unanimous. Charter Franchise Agreement Mayor Schonberger announced that the public hearing to approve the franchise agreement with Charter Communications has been continued to Monday, January 11, 2016, at 6 p.m. Council received the agreement in their packet to allow time to review. FINANCE City Disbursements Councilor Quinlin moved, second by Councilor Anderson to approve City bills from December 14-28, 2015. The motion was approved unanimously by roll call vote. General Fund $ 21,464.81 Capital Improvement Fund $ 16,357.00 Water Fund $ 5,919.90 Trash and Garbage Fund $ 289.91 Waste Water Fund $ 21,272.07 Storm Water Fund $ 462.73 Golf Course Fund $ 4,864.85 Community Enhancement Fund $ 400.00 Payroll and Cafeteria $ 62,590.92 Payroll Liability $ 27,234.98 Disbursements Total $ 160,857.17 Supplemental Budget Resolution Administrator Torres presented Resolution No. 2015-21, Supplemental Budget for council consideration. He explained that it was for the fire and police radios recently purchased. Councilor Bain added that the cost savings on the early purchase of these radios was significant. Councilor Bain moved to approve Supplemental Budget Resolution No. 2015-21, second by Councilor Anderson. The roll call vote was approved unanimously. Council Proceedings –December 28, 2015 2 STAFF REPORTS Assistant Administrator Schminke • Reported that the Planning Commission will be meeting on February 1, 2015 at 5:30 p.m. on a development application and site development plan. Council will hear this matter on February 8th. She encouraged Council to direct citizens to these hearings if they should have input, to avoid ex parte communication. City Clerk Strand • Announced upcoming meetings and announcements. January 18, 2016, at 5:30 p.m. in Council Chambers has been scheduled for Council orientation. A meal will be provided. Administrator Torres • Reported that he had met with members of the Rural Fire Protection District and Fire Chief to discuss the grant for the new fire department building. He also spoke to DOLA Representative Greg Etl who confirmed that a lease purchase option could be a grant match for the building. MAYOR AND COUNCIL REPORTS Mayor Schonberger • Asked Council members to consider which City Boards or Commission they would like to serve on, as these will be appointed in January 2016.
