CITY OF BRUSH! MINUTES OF THE AUGUST 22, 2016 – REGULAR CITY COUNCIL MEETING The City Council of the City of Brush, Colorado met in regular session on August 22, 2016. Mayor Chuck Schonberger called the meeting to order at 6:00 p.m. The meeting was held at Brush City Hall. The pledge of allegiance was given. Present on roll call were: Mayor Chuck Schonberger Councilor Jeanine Anderson Councilor Marlene Baker Councilor Heath Becker Councilor Vicky Quinlin Absent: Councilor Rick Bain Councilor Kimberly Dykes Also present were City Administrator Monty Torres, City Attorney Bo Chapin, Assistant Administrator Karen Schminke, Finance Director Joanne Gosselink, Police Chief Travis Anderson and City Clerk Andrea Strand. MINUTES The minutes of the regular meeting of August 8, 2016, were approved as submitted. VISITORS AND DELEGATIONS None. MANAGEMENT Public Hearing – Subdivision Request by Eben Ezer Lutheran Care Center Mayor Schonberger opened the public hearing at 6:03 p.m. City Attorney Bo Chapin and Councilor Vicky Quinlin recused themselves from the public hearing due to conflicts with Eben Ezer. Bo Chapin is on the Board and Vicky Quinlin is an employee. Assistant Administrator Karen Schminke stated that the request from Eben Ezer Lutheran Care Center was for approval of a final plat for Eben Ezer Subdivision. It will replat Tabor Subdivision and an unplated 31 acre parcel into three lots. The property is zoned Residential Medium Density (RMD) and Industrial (I). The property is located at the southwest corner of Hospital Road and Edison Street (Hwy 34) and is also known as 122 Hospital Road, 1900 and 1920 Edison Street. She provided background on the property and stated the need for the subdivision was related to Eben Ezer campus redevelopment. She highlighted the Comprehensive Plan, zoning, streets, easements and access as it related to the property. She had conveyed one citizen comment from Colorado Interstate Gas Company who noted their Council Proceedings –August 22, 2016 1 meter stations and pipeline on the south side of the railroad tracks would not be affected by the subdivision. She concluded that at the August 11, 2016, Planning and Zoning Commission, it was their recommendation that Council approve the plat for Eben Ezer Subdivision with the following conditions: 1. Amend the plat and record the appropriate Release of Easement with the plat for the portion of the 20’ Ingress/Egress easement that is no longer necessary. 2. Add an easement to the plat for the existing sanitary sewer line that serves the Arbors. 3. Unless otherwise completed and recorded, approval of this final plat shall expire twelve (12) months from the date of Council approval. Applicant - Shelly Griffith, CEO of Eben Ezer was present to answer questions about the campus redevelopment. There were no public or Council comments. Mayor Schonberger closed the public hearing at 6:08 p.m. Councilor Baker offered a motion, second by Councilor Becker to approve the Subdivision request by Eben Ezer Lutheran Care Center with the conditions identified by staff. The roll call vote was as follows: Yes: Schonberger, Baker, Becker No: Anderson Abstain: Quinlin Public Hearing – Amend Table 6-1 District Uses of the City of Brush Land Use Code to Allow Medical Clinics by Special Use Permit in an Industrial (I) Zone Mayor Schonberger opened the public hearing at 6:10 p.m. Assistant Administrator Karen Schminke presented an ordinance that would amend the City’s Land Use Code by modifying the zoning districts in which a medical clinic would be permitted. A request from a property owner caused staff to review how the City currently defines and permits this use in Brush. Staff’s conclusion was that several changes to the ordinance related to this use would be beneficial. At the August 11th meeting, the Planning Commission discussed the proposed definition at length and requested a change to the original proposal, the revised definition recommended by the Commission was: Medical Clinic means an establishment where members of the medical profession, dentists, chiropractors, osteopaths, physicians, psychologists, state licensed therapists or counselors provide diagnosis and treatment without overnight accommodation. The second change is to amend the Use Table and the Off-street Parking Requirement Table to reflect the change. There was no one present from the public. Councilor Anderson stated that she was opposed to this change, specifically as to a clinic in an Industrial Zone. Mayor Schonberger stated that a special use permit would be necessary. Mayor Schonberger closed the public hearing at 6:10 p.m. Council Proceedings –August 22, 2016 2 First Reading of Ordinance 848-16 Adopting an Amendment to Chapter 16 of the Brush Municipal Code Concerning Medical Clinics Councilor Quinlin introduced and offered a motion on first reading and ordered publication in full for Ordinance 848-16 Adopting an Amendment to Chapter 16 of the Brush Municipal Code Concerning Medical Clinics. Second by Councilor Baker. The roll call vote was as follows: Yes: Schonberger, Baker, Becker and Quinlin No: Anderson Resolution 2016-4 City and Towns Week Clerk Strand presented Resolution 2016-4 for Council consideration. Councilor Anderson offered a motion, second by Councilor Quinlin to approve Resolution 2016- 4 and to celebrate City and Towns Week September 12-16, 2016, in Brush, Colorado. The roll call vote was unanimous. 2017-2018 Brush City Council Priorities Councilor Anderson moved, second by Councilor Quinlin, to approve the 2017-2018 Council Priorities as presented. The roll call vote was unanimous. FINANCE City Disbursements Councilor Quinlin moved, second by Mayor Schonberger to approve City bills from August 8-22, 2016. The roll call vote was unanimous. Property owners are being contacted but several have stated that the tree trimmers are booked out for several months. • Brush officers were involved in a pursuit. City Clerk Strand • Read upcoming meetings and announcements. Administrator Torres • Director Schwindt will present a letter asking for Council support on the Recreation Master Plan that was identified in Council priorities. • Office of Economic Development and International Trade will have a conference call with staff tomorrow on planning for the English Feedlot re-use project.
