CITY OF BRUSH! MINUTES OF THE SEPTEMBER 12, 2016 – REGULAR CITY COUNCIL MEETING The City Council of the City of Brush, Colorado met in regular session on September 12, 2016. Mayor Chuck Schonberger called the meeting to order at 6:00 p.m. The meeting was held at Brush City Hall. The pledge of allegiance was given. Present on roll call were: Mayor Chuck Schonberger Councilor Jeanine Anderson Councilor Rick Bain Councilor Marlene Baker Councilor Heath Becker Councilor Kimberly Dykes Councilor Vicky Quinlin Absent: None. Also present were City Administrator Monty Torres, City Attorney Bo Chapin, Finance Director Joanne Gosselink, Police Chief Travis Anderson, Community Service Director Lance Schwindt, Marketing Specialist Tyler Purvis and City Clerk Andrea Strand. MINUTES The minutes of the regular meeting of August 22, 2016, were approved as submitted. VISITORS AND DELEGATIONS None. MANAGEMENT Second and Final Reading of Ordinance 848-16 Adopting an Amendment to Chapter 16 of the Brush Municipal Code Concerning Medical Clinics Administrator Torres stated that the change for the definition of medical clinics was necessary for a clinic to be placed in Industrial Zoning. Attorney Chapin added that any existing clinic in this type of zone would be grandfathered in. Councilor Quinlin offered a motion, second by Councilor Dykes to adopt Ordinance No. 848-16 Adopting an Amendment to Chapter 16 of the Brush Municipal Code Concerning Medical Clinics on second reading and ordered publication by title. The roll call vote was as follows: Yes: Schonberger, Bain, Baker, Becker, Dykes, Quinlin No: Anderson Council Proceedings –September 12, 2016 1 Public Hearing – Special Use Permit 320 Colorado Avenue Mayor Schonberger opened the public hearing at 6:05 p.m. Administrator Monty Torres stated that David Samples had submitted an application requesting a special use permit for a single family dwelling in the Commercial Core zone at 320 Colorado Avenue. He reviewed the approval criteria and concluded that should Council find that the proposal had met the review criteria, staff recommended that Council grant a special use permit for a single family dwelling with on-street parking at 320 Colorado Avenue. David Samples was present and restated the requested. There was no one present from the public. Mayor Schonberger closed the public hearing at 6:08 p.m. Councilor Bain offered a motion, second by Councilor Anderson to approve the special use permit requested for a single family dwelling with on-street parking at 320 Colorado Avenue. The roll call vote was unanimous. Grant Application for Recreation Master Planning with GOCO Director Schwindt presented a letter asking for Council approval to apply for a Great Outdoors Colorado Grant for recreation master planning. This would also authorize spending $15,000. Councilor Dykes offered a motion, second by Councilor Quinlin, to approve the GOCO grant application for recreation master planning and authorize $15,000. The roll call vote was unanimous. Intergovernmental Agreements on the Brush Fire Station and Lease-Purchase Agreements between the City of Brush and Brush Rural Fire Protection District Administrator Torres and City Attorney Bo Chapin provided a summary of the Intergovernmental Agreements that will be executed for the fire department building. Councilor Bain offered a motion, second by Councilor Anderson to approve the Joint Use Agreement Between the City of Brush and the Brush Rural Fire Protection District as presented by staff with minor word changes. The other documents will be presented once the cost of the building is determined. The roll call vote was unanimous. 2017 Property Casualty-Workers Compensation Insurance Quotes Councilor Dykes moved, second by Councilor Quinlin, to accept the property casualty-workers compensation quotes from CIRSA. The roll call vote was unanimous. Council Proceedings –September 12, 2016 2 FINANCE City Disbursements Councilor Quinlin moved, second by Bain to approve City bills from August 22 – September 12, 2016. The roll call vote was unanimous. General Fund $ 90,591.88 Capital Improvement Fund $ 75,642.91 Capital Reserve Fund $ 918.61 Water Fund $ 134,270.20 Trash and Garbage Fund $ 5,542.36 Waste Water Fund $ 15,341.94 Storm Water Fund $ 1,641.48 Golf Course Fund $ 27,261.63 Conservation Trust $ 6,281.25 Community Enhancement Fund $ 4,834.28 Joslin Needham Fund $ 8,351.74 Payroll and Cafeteria $ 79,068.64 Payroll Liability $ 42,250.35 Disbursements Total $ 491,997.27 STAFF REPORTS Finance Director Gosselink • Reported the City assessed value went down by $23,000 • The August financial report will be presented at the next meeting • Department head line items will be presented at the next meeting. Police Chief Anderson • Will participate in the senior Olympics on September 30. • A washer and dryer have been purchased for the animal shelter. • The department hosted an ethics class and several area agencies attended. • Meet with representative of S.A.R.A and S.H.A.R.E. Community Service Director Schwindt. • Record number of youths participating in soccer. • Completed men and women’s golf league and reported 163 members. City Clerk Strand • Read upcoming meetings and announcements. Council Proceedings –September 12, 2016 3 MAYOR AND COUNCIL Councilor Anderson stated she had received a call from S.H.A.R.E who stated that have a problem with dual arrests. Police Chief Travis Anderson explained that a dual arrest is made on a domestic violence case when the officer cannot determine who the aggressor was, so both parties are arrested. Members of various Boards and Commissions for the City of Brush were recognized for their service and a reception was held after the meeting.
